The Chanhassen Village Council met in regular meeting on January 15,
1968, at 8:00 P.M. The following members were present: Mayor Coulter,
Councilmen Klingelhutz, Pearson, Hill, and Bennyhoff. None absent.
The Clerk is instructed to order a flag stand. Councilman Bennyhoff
moved that the minutes of the January 2 meeting be approved as
submitted. Motion seconded by Councilman Pearson and the following
voted in favor thereof: Councilmen Hill, Pearson, Bennyhoff and
Klingelhutz. No negative votes.
HALLA NURSERY: A complaint has been received that Halla Nursery
has been dumping and burning - that there are times when the flames
engulf the public roadway. The Clerk is instructed to send Halla
Nursery a speed letter stating that no more burning or dumping will
be permitted.
SALT AND SAND BARREL: It was suggested that a sand and salt barrel
be placed wherever there is a hill. This was referred to the
Maintenance Committee.
SNOW PLOWING: Several complaints were received that the Maintenance
Department was not plowing roads which have not been accepted by the
Village. Again, the Council stated that no maintaining of roads
will be done unless they have been brought up to Village standards
and accepted by the Village.
DUMP: Mr. Roy Kelm was present desiring information about his
application for a pay dump. The Council stated that no definite
decision will be reached until sometime in March or April. The
Dump Ordinance will have to be passed first. The Council also
advised Mr. Kelm that his junk cars are an eyesore and that he should
have them removed as soon as possible.
SAINT JOHN'S STREET: Attorney Russell Larson updated the Council
as to the status of the litigation pending on St. John's Street.
Mr. Robert Scholer was present. Councilman Bennyhoff moved that the
Village Attorney be directed to conclude a settlement with Scholer,
Inc. concerning a portion of St. John's Street with a payment of
$1,100.00 to the Village from Scholer, Inc. and dismissal of Scholer,
Inc. counterclaim of $283.50. Motion seconded by Councilman Hill
and the following voted in:,favor thereof: Councilmen Bennyhoff,
Hill, Pearson, and Klingelhutz. No negative votes.
CEDAR CREST ROAD: The Attorney and Engineer reported to the Council
as to the status of the road in Bunger's Addition known as Cedar
Crest Road. Councilman Bennyhoff moved to accept the Cedar Crest
Road and advise the Attorney to drop the lawsuit against the Bungers
and directing the Maintenance people to plow the snow on said road.
Motion seconded by Councilman Klingelhutz and the following voted
in favor thereof, Councilmen Bennyhoff, Klingelhutz, Pearson and
Hill. No negative votes.
DUMP ORDINANCE #15: A discussion was held on the proposed Dump
Ordinance. Councilman Bennyhoff moved that the Village adopt the
Dump Ordinance #15 as per changes. Motion seconded by Councilman
Klingelhutz and the following voted in favor thereof, Councilmen
Bennyhoff, Klingelhutz, Hill, and Pearson. No negative votes.

DISORDERLY CONDUCT ORDINANCE #16: After discussing the proposed
Disorderly Conduct Ordinance, Councilman Hill moved the adoption
of Ordinance #16. Motion seconded by Councilman Klingelhutz and
the following voted in favor thereof, Councilmen Hill, Klingelhutz,
Pearson, and Bennyhoff. No negative votes.

ORDINANCE #17: A discussion was held on the
Councilman Pearson moved the adoption of the
Ordinance #17 as per changes. Motion seconded

Klingelhutz, Hill, and Bennyhoff. No negative
ABOLITION OFFICE OF CONSTABLE ORDNANCE #18: The Clerk submitted to
the Council a resignation from Daniel Ross and one from Al Otterdahl
resigning from the Office of Constable. A discussion was held on
the proposed Ordinance dissolving the Office of Constable. On a
motion made by Councilman Hill and seconded by Councilman Bennyhoff
adopting Ordinance #18 Abolition of the Office of Constable. The
following voted in favor thereof, Councilmen Klingelhutz, Hill,
Pearson, and Bennyhoff. No negative votes.
CIVIL DEFENSE ORDINANCE #19: On a motion made by Councilman Klingelhutz
and seconded by Councilman Hill adopting Ordinance #19, Civil Defense
Ordinance. The following voted in favor thereof, Councilmen Bennyhoff,
Pearson, Klingelhutz, and Hill. No negative votes.
VOTER REGISTRATION ORDINANCE #20: A discussion followed on voter
registration. Councilman Hill moved that the Village adopt the
Voter Registration Ordinance #20. Motion seconded by Councilman
Pearson and the following voted in favor thereof, Councilmen Hill,
Bennyhoff, Pearson, and Klingelhutz. No negative votes.
The Attorney advised the Clerk that the Secretary of State must
receive a notice of the passage of this ordinance within 30 days
after passage.
WEED ORDINANCE #21: Councilman Bennyhoff moved the adoption of the
Weed Ordinance # 1. Motion seconded by Councilman Pearson and the
following voted in favor thereof, Councilmen Hill, Pearson, Bennyhoff,
and Klingelhutz. No negative votes.
LAKEVIEW HILLS: A complaint has been received regarding the sewer and
water system in Lake View Hills. Councilman Bennyhoff moved that the
Engineer be instructed to inspect the sewer and water system in Lake
View Hills. Motion seconded by Councilman Pearson and the following
voted in favor thereof, Councilmen Pearson, Hill, Bennyhoff, and
Klingelhutz. No negative votes.
TEL- E -LECT: The Council was reminded that there is a meeting on
January 22 at 8:00 P.M. with Tel- E -Lect.
LUTHERAN CHURCH: A letter was read from Rev. Russell B. Helgesen
regarding the possible site of a new Lutheran Church in the Village
of Chanhassen. The Council agreed that nothing in the letter needs
immediate action taken at this time and that the letter, herewith,
become part of the minutes.

CIVIL DEFENSE: Earl McAllister requested a file, chair and desk
for the Civil Defense Committee. The Civil Defense Committee
advises that this will be taken under advisement.
FIRE DEPARTMENT: A request has been received from the Fire Department
for 1,000 feet of hose. On a motion made by Councilman Klingelhutz
and seconded by Councilman Hill that if the Fire Committee sees the
need for said hose they be authorized to let it out on bids. The
following voted in favor thereof, Councilmen Hill, Klingelhutz,
Pearson, and Bennyhoff. No negative votes.
VICTORIA MEETING: On February 8, 1968, at the Village Hall there
will be a meeting with Victoria Officials regarding the annexation.
Councilman Bennyhoff moved that Mayor Coulter and Councilman Klingelhutz
be the two delegates appointed to meet with them. Motion seconded
by Councilman Pearson and the following voted in favor thereof,
Councilmen Pearson, Bennyhoff, Hill, and Klingelhutz. No negative
votes.
FIRE CONTRACT WITH SHAKOPEE: The Clerk advised the Council that the
contract that the Township had with the Shakopee Fire Department
servicing the southeastern portion of the Township will expire
February 1, 1968. On a motion made by Councilman Pearson and seconded
by Councilman Klingelhutz that the Village of Chanhassen will not
renew the contract with the City of Shakopee for fire protection.
The following voted in favor thereof, Councilmen Pearson, Klingelhutz,
Hill, and Bennyhoff. No negative votes.
BILLS: On a motion made by Councilman Hill and seconded by Councilman
Klingelhutz to pay all approved bills. The following voted in favor
thereof, Councilmen Hill, Bennyhoff, Klingelhutz, and Pearson. No
negative votes. The Clerk was advised that when the contractors
have completed their work on the Municipal Building, they should be
paid. The Clerk was instructed to send a letter to Leo Bovy asking
for a settlement of $325.00 on the tile job.
The bill from Bob Reichert was discussed. Councilman Bennyhoff is
to take this bill under advisement with Reichert.
On a motion made by Councilmen Bennyhoff and seconded by Councilman
Pearson meeting adjourned.
