1968 03 04CHANHASSEN VILLAGE COUNCIL MEETING MARCH 4, 1968 The Chanhassen Village Council met in regular meeting on March 4, 1.968, at 8:00 P.M. The following members were present: Mayor Coulter, Councilmen Hill, Pearson, Bennyhoff, and Klingelhutz. None absent. The Mayor called the meeting to order and the pledge to the flag was given. On a motion made by Councilman Pearson and seconded by Councilman Klingelhutz the minutes from the Fenruary 26th meeting he apnrovpd as submitterl. Tne following votea in favor thereof: Louncilmen Hiil, Pearson, Benny,ioff, and \Iingelhu + a o negative votes. Motion carried. JUNK CARS: Attorney Larson updated the Council on the status of the Kelm junk cars. COMPLAINT: Mrs. Ida Johnson was present complaining that the Maintenance Department had torn down her fence when snow plowing. She wanted to know what the Council is going to do about it. Mayor Coulter stated this should be referred to the Maintenance Committee for study. MAINTENANCE: The Council instructed the Maintenance people to put "Dead End" signs up on Lake Street approximately on the end of the Pearson property and one in Carver Beach near the east turn by Al Barnacle. Councilman Bennyhoff reported that he has had a complaint regarding dumping by Halla.Nursery. The Clerk is instructed to send Halla Nursery a copy of Ordinance #15, Section 2 and Ordinance #22, Section 3, Subdivision 5, page 2. The Maintenance men are also instructed to do no more dumping there. On a motion made by Councilman Bennyhoff and seconded by Councilman Klingelhutz to purchase a Homelite Trash Pump with hose for $436.00 less 10% and $50.00 for hose. Roll call vote - Councilman Hill - no, Councilman Bennyhoff - yes, Councilman Pearson - yes, Councilman Klingelhutz - yes, Mayor Coulter - yes. One negative vote. Motion carried. BUILDING CODE: Attorney Larson read through the proposed Building Code Ordinance. After much discussion Councilman Hill moved that the Building Code Ordinance be put back to the Committee for correction of Section 2 -H and Section 2 -F for revision in accordance with discussion this evening. Motion died for lack of a second. Attorney Larson and Adolph Tessness were instructed to retire to the office and rewrite Section H -2507 and also include the fees for the Park and Recreation. On a motion made by Councilman Bennyhoff and seconded by Councilman Pearson to adopt Ordinance #23 Building Code as amended including fee change. The following voted in favor thereof: Councilmen Hill, Pearson, Bennyhoff, and Klingelhutz. No negative votes. Motion carried. March 4, 1968, minutes continued (page 2) SEWER AND WATER RATES: Mr. Roger Pauly, owner of the Pauly Office Building asked why his units for sewer were raised last year from two to three. Mayor Coulter explained -to him how the unit service charge system works. Each Councilman was presented with a list of sewer and water users. After studying each one and making recommendations the following motions were made. Councilman Pearson moves that the water rates for 1968 be as follows: $6.50 for the first 10,000 gallons minimum .40 per 1,000 gallons thereafter and that when figuring the water usage and amount that it be figured to the nearest 1,000 gallons, if its over 500 gallons add 40� less than 500 gallons drop 40�. Motion seconded by Councilman Hill. The following voted in favor thereof: Councilman Hill, Pearson, Bennyhoff, and Klingelhutz. No negative votes. Motion carried. On a motion made by Councilman Klingelhutz and seconded by Councilman Pearson adopting the $7.50 per unit charge for sewer as amended. The following voted in favor thereof: Councilmen Pearson, Klingelhutz, Bennyhoff, and Hill. No negative votes. Motion carried. ENGINEER FLATEBO: The storm sewer assessments were discussed. Mr. Flatebd "explained the two drainage areas - Sunrise Hills watershed, Western Hills watershed. These two projects were given the title 1968 -1. Mr. Flatebo suggested that the Village write an ordinance covering Storm Sewers. • well near the Gedney Pickle Company was discussed. • well in the far eastern part of the Village was discussed. The title assigned to this project was 1968 -2. Mr. Flatebo gave a report on the Southwest Sanitary Sewer District. Councilman Hill moved that the following letter be sent to Mayor Osterholt and that the letter become part of the minutes. "The Council of the Village of Chanhassen wishes to express a definite interest in the possibilities of joining with other communities to handle mutual sewage problems. Naturally no firm commitment can be made at this time. After the Council has a chance to consider the proposed costs of the above project and alternatives, a more positive answer can be given. Please include our Village in future correspondence." Motion seconded by Councilman Bennyhoff. The following voted in favor thereof: Councilmen Pearson, Bennyhoff, Hill, and Klingelhutz. No negative votes. Motion carried. Councilman Bennyhoff moves that the Sewer Committee with the Engineer negotiate for operating of the Private Sewer System at Lake View Hills. Councilman Pearson seconded the motion. The following voted in favor thereof: Councilman Hill, Pearson, Bennyhoff, and Klingelhutz. No negative votes. Motion carried. A discussion was held on bringing sewer and water to the Bloomberg property between the Chicago, Milwaukee, St. Paul and Pacific Railroad and Highway #5. This project will be given the title 1968 -3. Project 1968 -4 was given to water extension to Bloomberg's property across from McAllister's. Mr. Flatebo was directed to prepare a plan for grading, blacktopping, and landscaping around the Municipal Building, Project 1967 -5. March 4, 1968, minutes continued (page 3) HIGHWAY.169 AND 212: On a motion made by Councilman Bennyhoff and seconded by Councilman Hill that the following letter be sent to Marvin Borgelt: "The Council of the Village of Chanhassen prefers the northerly routing of Highway 212. It should be in the general area of County Road 14. It is felt that suitable overpasses should be provided and at least two access roads. A by -pass around Shakopee should be planned. Whether this by -pass becomes part of Highway 169 or is supplemental to it does not appreciably affect the Village of Chanhassen. Either routing of Highway 169 is acceptable." The following voted in favor thereof: Councilmen Hill, Pearson, Klingelhutz, and Bennyhoff. No negative votes. Motion carried. PROTEST AGAINST VILLAGE PARK FUND: A letter was read from Robert Mason protesting the fee taken for the Village Park Fund at the time a building permit is taken out. The letter was referred to our Attorney for his opinion. 1 ORDINANCE #24 - DOG: On a motion made by Councilman Pearson and seconded by Councilman Klingelhutz that the Village adopt Ordinance #24 entitled Dog Ordinance. The following voted in favor thereof: Councilmen Klingelhutz, Bennyhoff, Hill, and Pearson. No negative votes. Motion carried. The Council instructed the Clerk to order two copies of Uniform Building Code, Volume 1 at $8.65 each. The volumes should be sold for $10.00 each.
