The Chanhassen Village Council met in regular meeting on March 18, 1968,
at 8:00 P.M. The following members were present: Mayor Coulter,
Councilmen Hill, Pearson, Bennyhoff, and Klingelhutz. None absent.
MARCH 11 MINUTES: Councilman Hill stated that in regard to the
Maintenance Report at the March 11th 1968, meeting the minutes should
reflect it was all discussion and no decision was made.
MINUTES: The change under "Minutes" should read as follows: The Council
requested that the minutes from the Park and Recreation Commission and
Planning Commission meetings go to the paper for publication and that
all minutes from the previous week be in the Council hands by Monday
night so as the Council approved minutes can be turned over to the
reporter.
On a motion made by Councilman Hill and seconded by Councilman Pearson
that the minutes of the March 11, 1968, Council Meeting be approved
with the above amendments. The following voted in favor thereof:
Councilmen Hill, Klingelhutz, Bennyhoff, and Pearson. No negative
votes. Motion carried.
LOAD LIMITS: Councilman Pearson moved to amend the previous action of
the Village Council to leave the roads as posted but exceptions to
those load limits could be made by approval of the Village Engineer.
Councilman Hill seconded the motion. The following voted in favor
thereof: Councilmen Pearson, Hill, Bennyhoff, and Klingelhutz. Motion
carried. No negative votes.
PARK AND. RECREATION_ MINUTES The Clerk read the March 7, Park
and Recreation minutes. -The C:ouncil.advised-the Clerk to instruct
the Park.and Recreation and Planning Commission Secretary:.to send each
Councilman the minutes of their meetings.
ASSESSMENT COMPLAINT: Mr. Vern Zetah- was present inquiring as to why
he.was assessed-for lots for water and sewer and - asking why he
was charged for seal coating when he did not request it and further
stating that the road that was seal coated is his own private road.
Mayor Coulter stated that= :there would be some research on his inquiries
and he would be so notified as to the results.. .
FENCE COMPLAINT: Mrs. Ida Johnson was present again. The Council
advised Mrs. Johnson of the action taken at the last Council meeting.
Mayor Coulter instructed the Maintenance.Committee to.settle this with
her.
DISPOSITION OF BUILDING: A discussion was held on hazardous buildings
in the Village. Councilman Bennyhoff moved that the Building Inspector,
Adolph Tessness be instructed to start proceedings under section 203
of the Uniform Building =:Code for the disposition of the building located
on Lot 1, Block 2, Village of Chanhassen. Councilman Pearson seconded
the motion. The following voted in favor thereof,: Councilmen Hill,
Bennyhoff, Klingelhutz, and Pearson. No negative votes. Motion carried.
BOARD OF EQUALIZATION: The Assessor was instructed to set the dates of
the Board of Equalization for the evenings of June 24 and 25.

GRAVEL. BIDS: Councilman Klingelhutz moved that.the Village Council
advertise for gravel with bids to be opened on April 11, 1968, at
2:00 P.M. Councilman Bennyhoff seconded the motion. The following
voted in favor thereof: Councilmen Hill, Klingelhutz, Pearson, and
Bennyhoff. No negative votes. Motion carried.
MAINTENANCE: Councilman Bennyhoff moved that the Maintenance Committee
be instructed to replace all the six foot posts with eight foot posts
where the "Village of Chanhassen, Building Permits Required" signs
are posted. Motion seconded by Councilman Klingelhutz. The following
voted in favor thereof: Councilmen Bennyhoff, Pearson, Klingelhutz,
and Hill. No negative votes. Motion carried.
REPORT: Mayor Coulter gave a report on the meeting he attended regarding
the Southwest Sanitary Sewer District. Mayor Coulter stated that the
Village Officials of Shorewood would like to meet with the Officials
of Chanhassen regarding mutual problems. The Clerk is instructed to
check with Shorewood Officials if April 2nd at 8:00 P.M. would be
agreeable with them to hold this joint meeting in Chanhassen.
SPECIAL PROJECT FUNDS: A discussion was held on special project funds
the Village undertakes. When these projects are under construction
considerable time and expense under general administration is incurred.
The following schedule was then outlined. Project costs amounting
from: $1.00 to $9,999.00 - 5%
10,000.00 to 49,999.00 - 4%
50,000.00 to 99,999.00 - 3%
100,000.00 and over - 2%
The amount of percentage of the various projects would go into the
general fund for administration purposes. The Council feels that this
should be drawn up in resolution form and presented at a future Council
meeting for approval.
SEPTIC PROBLEM: A letter was read from the Plumbing Inspector regarding
the septic problem at Johnson's Resort. This was turned over to the
Utility Committee to make a feasible study.
BONDS: Councilman Hill moved the following resolution be adopted:
WHEREAS, the merger of the Township and Village of Chanhassen
was effected May 8, 1967, and
WHEREAS, the newly elected Village Council took office on July 3,
1967, and that thereupon the Township offices ceased to exist.
NOW, THEREFORE, BE IT RESOLVED:
1. That Western Surety Company be and it hereby is released
from all liability resulting from the acts of the following
township officers committed subsequent to July 3, 1967, and
covered by the following bonds:
Bond No. 5214551 - Margaret Rossing, Treasurer
Bond No. 5214552 - Basil Bastian, Clerk
Bond No. 5214553 - Shirley Kucher, Deputy Clerk
Bond No. 5214555 - A. E. Otterdahl, Constable
Bond No. 5214554 - Bernard Leach, Justice of Peace
Bond No. 5215374 - Katherine Diethelm, Assessor
2. That the Village Clerk furnish Western Surety Company or its
agent, Schneider Agency, Inc., with a copy of this resolution.
Adopted this 18th day of March, 1968.
Councilman Pearson seconded the motion. The following voted in favor
thereof: Councilmen Hill,,Pearson, Klingelhutz, and Bennyhoff. No
negative votes. Motion carried.

INSURANCE On a motion made by Councilman Hill and seconded by Councilman
Pearson that - the bill from Insurance Company be approved as
specified. :The following voted in.favor thereof: , Councilmen Hill,
Pearson, Klingelhutz, and Bennyhoff. No negative votes. Motion carried.
On a motion made by Councilman Klingelhutz and seconded by Councilman
Hill that the bill submitted- Schneider Insurance for Bonds on
the Township Officials for the amount of $150.00 be approved. The
following voted in favor thereof : Councilmen Hill, Bennyhoff, Pearson,
and Klingelhutz. No negative votes. Motion carried.
BILLS: Councilman Pearson moved that all bills submitted on the bill
sheet be approved with the Schneider Insurance bill adjusted as specified.
Councilman-Hill seconded the motion. The following voted in favor
thereof: Councilmen Pearson, Klingelhutz, Bennyhoff, and Hill. No
negative votes. Motion carried.
WARRANTS: Councilman Pearson moved the following bills be paid in
warrants: - Nason, Wehrman, Knight & Chapman, Inc. for the amount of
$1,325.00, Check #1551; Weber & Troseth - $1,388.00, Check #1559;
Schneider Insurance Co. - $1,817.38, Check #1563; Hennessy Insurance
Co. - $2,775.09, Check #1562. Motion seconded by Councilman Hill.
The following voted in favor thereof: Councilmen Hill, Bennyhoff,
Pearson, and Klingelhutz._ No negative votes. Motion carried.
FIRE DEPARTMENT: The Fire Department Budget was discussed. The Council
instructed the Fire Department that all billing for fires occuring
outside the Village should be done by the Village. A Burning Ordinance
was discussed.
ROAD - MAINTENANCE: The Council instructed the Engineer to check on
a road in Pleasant Acres as to the cost to bring this road up to Village
standards.

KENNEL LICENSE: The Council instructed the Clerk to issue a dog
Kennel permit to Joe Kenyon.
SHOOTING PERMIT: On a motion made by Councilman Hill and seconded
by Councilman Pearson to issue a shooting permit to Gordon Anderson.
The following voted in favor thereof: Councilmen Hill, Pearson,
Bennyhoff, and Klingelhutz. No negative votes. Motion carried.
VOTER REGISTRATION: On a motion made by Councilman Pearson and seconded
by Councilman Klingelhutz to advertise that Voter Registration will
begin in the Village of Chanhassen on April 1, 1968. This should be
advertised in the Sun Newspapers, Inc., Weekly Valley Herald, and the
Maverick twice, once on March 28, 1968, and on April 11, 1968.
ZONING VIOLATION: It was brought to the Council's attention that there
is a mobile trailer house parked by the Sunnybrook Motel. The Council
instructs the Police Department to check into this.
PARK AND RECREATION FUND: On a motion made by Councilman Bennyhoff and
seconded by Councilman Pearson that the Treasurer by instructed to put
the money collected from the Park Fund into a separate savings account.
The following voted in favor thereof: Councilmen Hill, Klingelhutz,
Bennyhoff, and Pearson. No negative votes. Motion carried.
