1968 04 08The Chanhassen Village Council held a Public Hearing on April 8, 1968,
at 8:00 P.M. on preliminary ordinance regulating the installation,
construction, alteration, financing and assessment of Storm Sewers
and other public drainage facilities.
The affidavit of publiclation in Minnetonka Sun, South Shore Edition
was presented and read. The Administrator read the preliminary
ordinance verbatim stopping periodically for comments from those in
attendance.
Tom Klingelhutz asked; with this ordinance will all existing homes
and areas not assessed in another storm sewer district be.on the
same square foot charge as any new area needing a storm sewer installed?
Mayor Coulter answered yes.
Tom Klingelhutz asked; does the developer have the right to put in
the storm sewer in accord with this ordinance? Tory Flateto, Village
Engineer, answered yes, but with Village supervisory inspection and
control over the project.
Ralph Kant asked; if an extension out to Kerber Drive were necessary
would I be assessed in addition to this assessment being heard tonight?
Tory Flatebo answered no, once an area has been assessed it cannot
be re- assessed.
Ralph Kant asked; why is the ratio being changed from 1 -2 -3 to 3 -4 -5?
Mayor Coulter stated the amount assessed and the new ordinance seem to
be what most of the communities are doing. The preliminary ordinance
will be given to the Village Attorney for legal wording and form
then return to Village Council for final approval.
On a motion by Councilman Pearson and seconded by Councilman
Klingelhutz the hearing was adjourned.

A Public Hearing was called to order at 9:OO P.M., April 8, 1968,
on the Storm Sewer Assessment.
The affidavit.of publication in Minnetonka Sun, South Shore Edition
was presented and read. Also presented was a certification that
the notices had been sent to all persons affected.
Mayor Coulter explained how different areas were assessed such as:
commercial, residential, etc.
Ralph Kant stated he did not understand why Hansen & Klingelhutz
received a rebate of $5,810 on the assessment roll pertaining to
construction costs. Tory Flatebo- stated this was put in and paid
for by Hansen and Klingelhutz when they installed blacktop streets
in Highland Park. Now they will be assessed on the assessment roll
in the same proportion as everyone else.
Assessment Hearing, April 8, 1968 continued
George Beniek asked when will this be payable? Mayor Coulter
stated that the actual date has not been :decided but the Council
will notify all persons by mail.
A complaint letter was read from St. Hubert's Church.
"Request that the following reasons be considered by Village Council:
1. St. Hubert School grounds have no blacktop, hence the runoff is
less than the multi- dwellings in town.
2. St. Hubert's School is not a profit establishment in town.
Request that the rate be considered proportionately less, possibly ,
l per square foot.
3. xequest tnat the Vii7age' authorities take a good and hard look at
the street along school grounds, as the mat is cracking up now
it will never be acceptable."
Lambert Peters asked why the storm sewer is so low behind the
Quick Clean Center and Colonial Center? Tory Flatebo stated this
was on the old storm sewer tile line and was at the lowest elevation
of the property at that time. When the "property is developed it can
be raised to the proper elevation.
Mayor Coulter stated, "I believe while construction was in progress
some damage was done to Colonial Center Parking Lot by heavy equipment
driving on it while not able to drive on road. I would like the
Engineerand Administrator to look into this with Mr. Gleason to
determine what damage is a proportinate share.

The Chanhassen.Village Council met in special meeting on April 8, 1968,
at 9:25 P.M. The following members were present; Mayor Coulter,
Councilmen Hill, Bennyhoff, Pearson, and Klingelhutz. Councilman
Klingelhutz moved and Councilman Pearson seconded to dispense with
all formalities. The following voted in favor thereof: Councilmen
Hill, Pearson, Bennyhoff, and Klingelhutz. No negative votes. Motion
carried.
On a motion made by Councilman Pearson and seconded by Councilman Hill
that the Church assessment be reduced from 2 to l because of the
objections raised at the assessment hearing. The following voted in
favor thereof: Councilmen Hill, Klingelhutz, Bennyhoff, and Pearson.
No negative votes. Motion carried.
On a motion made by Councilman Klingelhutz and seconded by Councilman
Pearson to accept the Assessment Roll as amended. The following voted
in favor thereof: Councilmen Bennyhoff, Hill, Klingelhutz, and Pearson.
No negative votes. Motion carried.
Mayor Coulter presented the Planned Industrial District Ordinance for
comments from the Councilman.
Councilman Pearson stated its a very tight ordinance and would be
quite difficult to build and categorize all industry under this
ordinance.
Richard Lyman, Chairman of the Planning Commission, that other
industrial ordinances are in the making ■ & and will be presented as
soon as possible.

Clyde Hehl, resident of Chanhassen, stated he felt that this was
a very restrictive ordinance and if industry does not move into
Chanhassen this would hurt our overall growth and tax base.
Mayor Coulter stated that this is just one of the many ordinances
that will be adopted such as heavy , light industrial, commercial,
residential, etc.
Councilman Hill moved and Councilman Pearson seconded that we approve"
the Planned Industrial District Ordinance. The following voted in
favor thereof: Councilmen Hill, Pearson, Bennyhoff, and Klingelhutz.
No negative votes. Motion carried.
The Administrator was instructed that the Planned Industrial District
Ordinance be forwarded to the Village Attorney for final checking
before publication.
A motion was made by Councilman Pearson and seconded by Councilman
Klingelhutz to sell the old Village Road Patrol to Merle Volk for
$600.00. The following voted in favor thereof: Councilmen Pearson,
Hill, Klingelhutz, and Bennyhoff. No negative votes. Motion carried.
Councilman Pearson moved and Councilman Klingelhutz seconded that we
approve the service contract on the Apeco copier.
Mayor Coulter stated he received a call from Mr. Brose regarding
property that is adjacent to County Road 16 asking if it was a limited
access road. Mr. Flatebo will check, into this and the Administrator
to report to the Council at the next meeting.
The Village Engineer gave an explanation and details of Village
parking lot as to costs. On a motion by Councilman Hill and seconded
by Councilman Klingelhutz that we advertise for bids on the proposal
for parking area around the Municipal Building. The following voted
in favor thereof: Councilmen Pearson, Klingelhutz, Hill and Bennyhoff.
No negative votes. Motion carried.
Richard Lyman reported on the Golden Age Group as to their desire for
kitchen equipment in the basement. Mayor Coulter stated the Administrator
would compile figures and present them as soon as possible.
Councilman Hill stated he would be ready with the proposed Merit
System Ordinance for discussion at the next meeting.
On a motion made by Councilman Bennyhoff and seconded by Councilman
Hill meeting adjourned.
