1968 06 03CHANHASSEN VILLAGE COUNCIL MEETING JUNE 3, 1968 The Chanhassen Village Council met in regular session on June 3, 1968. The following members were present: Mayor Coulter, Councilmen Hill, Bennyhoff, Klingelhutz, and Pearson. The meeting was opened with the pledge to the Flag. MINUTES OF MAY 20th COUNCIL MEETING: A motion was made by Councilman Hill and seconded by Councilman Bennyhoff to amend FORCIER "WATERSHED section as submitted by Attorney Harroun, to read "A report from Hansen & Klingelhutz Const. Corp. by Attorney Harroun was given. No final plans can be submitted but a preliminary proposal that Hansen & Klingelhutz feel would solve some of the problems concerning the storm sewer watershed area was presented. They would excavate a pond area approximately six feet deep north of the Village water tower site for a ponding area also an area surrounding this pond and adjoining Village water tower site would be donated to the Park and Recreation Commission. There would be approximately three acres donated and would be accessible by road. This would be in the Park and Recreation overall design. A check dam would be put in at the east property line and a rip rap would be installed about 250 to 300 feet west of the first sharp bend in the creek bed on the Forcier property. The bank of the creek at the point of this sharp bend and at the second sharp bend further down stream would be reinforced and stabilized with concrete. The stream bed between these two sharp bends would be straightened out where possible and any areas where the cover had been disturbed by these operations would be reseeded to rye grass in an effort tore-establish the ground cover. A motion was made by Councilman Bennyhoff and seconded by Councilman Klingelhutz that no decision will be made until Village Engineer, Park and Recreation Commission and Planning Commission have evaluated this proposal and /or other proposals to be presented on July 22, 1968. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff and Klingelhutz. No negative votes. Motion carried." The - following voted in favor thereof: Councilmen Hill, Bennyhoff; Pearson, and Klingelhutz. Mayor Coulter - negative. - Ohte negative vote. Motion carried. MINUTES OF MAY 20th PUBLIC HEARING: On a motion by Councilman Hill and seconded by Councilman Pearson.the minutes of May 20th Public Hearing be approved as submitted. The following voted in favor thereof: Mayor Coulter, Councilmen Hill, Pearson, Bennyhoff, and Klingelhutz. No negative votes. Motion carried. MINUTES OF MAY 27th PUBLIC HEARING ON RURAL TAXING DISTRICT AND SPECIAL COUNCIL MEETING: On a motion by Councilman Hill and seconded by Councilman Klingelhutz the minutes of May 27th Public Hearing and special Council Meeting by approved as submitted. The following voted in favor thereof: Mayor Coulter, Councilmen Hill, Pearson; Bennyhoff, and Klingelhutz. No negative votes. Motion carried. PARK AND Hill and RECREATION COMMISSION MINUTES: On a motion made by Councilman that the May 2nd and 16th seconded by L;ounvilmdn Bennyhoff Park and Recreation minutes be approved. The following voted in favor thereof: Mayor Coulter, Councilmen Hill, Bennyhoff, Klingelhutz, and Pearson. No negative votes. Motion carried. PLANNING COMMISSION MINUTES: On a motion by Councilman Klingelhutz and seconded by Councilman Bennyhoff that the May 7th, 14th, 21st, and 28th minutes of the Planning Commission be approved. The following voted in favor thereof: Mayor Coulter, Councilmen Hill, Bennyhoff, Pearson, and Klingelhutz. No negative votes. Motion carried. ROSE LANE: A letter was read from Shorewood Village asking that a key be given to them for Shorewood residents that live on Christmas Lake but use Rose Lane to put their boats in the water. Councilman Hill moved that .a key be sent to Shorewood Village Clerk with instructions that a record by set up on the key use - when taken, when returned, by. whom, _also if key was given to individual or Village employee was in charge of key. If key use is abused this service will be discontinued. Motion seconded by Councilman Pearson. The following voted in favor thereof: Mayor Coulter, Councilmen Hill, Pearson, Klingelhutz, and Bennyhoff. No negative votes. Motion carried. MINUTES OF MEETINGS On a motion by Councilman Hill and seconded by Councilman Klingelhutz that prior minutes by approved first on agenda at each meeting. The following voted in favor thereof: Mayor Coulter, Councilmen Hill, Bennyhoff, Klingelhutz, and Pearson. No negative votes. Motion carried. MINNEWASHTA MANOR: Robert Bauer, R. B. Remund, and Milo Hennemann were present concerning streets in this subdivision. The committee was instructed to contact Administrator with problem. KELM PROPERTY: A hearing date is set for June 28, 1968, at Glencoe. ALLAN DAVIS - APPLICATION FOR TAX RELIEF: The Village Attorney recommended that.the application of Allan Davis for deferment of the sanitary sewer and municipal water assessmend be,denied. A motion was made by Councilman Hill and seconded by Councilman Bennyhoff to deny the petition. The following voted in favor thereof: Mayor Coulter, Councilmen Hill, Bennyhoff, Klingelhutz, and Pearson. No negative votes. Motion carried. SANITARY LANDFILL: A motion was made by Councilman Hill and seconded by Councilman Pearson to have the Planning Commission mane an unequivocal decision on the Sanitary Landfill Site also as to a time schedule as to when the Village could inform residents that a site will be available. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Hill, and Pearson. No negative votes. Motion carried.. PURGATORY CREEK WATERSHED: Councilman Hill reported that work has been initiated. The committee has been sent letters and some data. UTILITY VAN: Bids were opened on June 3, 1968, at 2:00 P.M. The following bids were received: Town's Edge Dodge $2,279.00 Southview Chevrolet 2,294.00 Both could have van available in ten days on colors in stock. A motion was made by Councilman Pearson and seconded by Councilman Hill to purchase Utility Van from Town's Edge Dodge. The following voted in favor thereof: Mayor Coulter, Councilmen Hill, Bennyhoff, Pearson, and Klingelhutz. No negative votes. Motion carried. June 3, 1968, minutes continued Page 3 ROAD SYSTEM: (SEALCOATING) A schedule on the streets for sealcoating and/or grading and graveling should be set up. A report will be submitted at the next meeting, if ready. POLICE AND SCHOOL LIAISON: A letter and resolution from Excelsior Has been received. No action will be taken for a week to give time for more research. HUMAN RIGHTS COMMISSION: Mayor Coulter was instructed to submit three names to the Council for appointments to study the setting up of a Human Rights Commission. The names would be submitted when interested persons could be contacted. GRAVEL PITS AND EARTH REMOVAL: It was the feeling of the Council that we should have more control over this problem. A motion was made by Councilman Hill and seconded by Councilman Pearson to have the Administrator submit a proposed ordinance. The following voted in favor thereof: Mayor Coulter, Councilmen Hill, Bennyhoff, Pearson, and Klingelhutz. No negative votes. Motion carried. MAINTENANCE: The Maintenance Superintendent gave a report on two bridges on Lyman Road - County Engineer reported in poor condition and something should be done. On a motion by Councilman Hill and seconded by Councilman Klingelhutz to have the Village Engineer submit a report of condition and cost of repair for the two bridges. The following voted in favor thereof: Mayor Coulter, Councilmen Hill, Pearson, Bennyhoff, and Klingelhutz. No negative votes. Motion carried. Councilman Klingelhutz reported on a packer we could lease. A motion was made by Councilman Klingelhutz and seconded by Councilman Bennyhoff to have the Maintenance Committee look into and secure lease, then present to Council for approval. The following voted in favor thereof: Mayor Coulter, Councilmen Hill, Pearson, Bennyhoff, and Klingelhutz. No negative votes. Motion carried. A letter was read from the Chanhassen Chamber of Commerce concerning the sweeping of main street and parking lot. A schedule for this work will be set up and any sweeping costs will be billed. HALLA NURSERY: A motion was made by Councilman Hill and seconded by Councilman Bennyhoff that there will be no dumping allowed in ravine on the south edge of their property. The following voted in favor thereof: Mayor Coulter, Councilmen Hill, Bennyhoff, Pearson and Klingelhutz. No negative votes. Motion carried. SEWER STUDY: The engineer is instructed to proceed on sewer study. SENIOR CITIZENS: On a motion by Councilman Hill and seconded by Councilman Pearson to purchase refrigerator and sink cabinet also an upper unit at a bid of $287.00 plus installation. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Hill, Pearson, and Klingelhutz. No negative votes. Motion carried.
