1968 06 10Public Hearing, Bluff Creek Highland Rezoning
The Chanhassen Village Council met on June 10, 1968, at 8:00 P.M.
for the purpose of conducting a public hearing on rezoning of
Bluff Creek Highlands. The following members were present: Mayor
Coulter, Councilmen Hill, Bennyhoff, Pearson, and Klingelhutz.
Mr. Dave Halla stated he was against the rezoning of this property
as this would not be beneficial to the contiguous rural areas.
We feel that by rezoning this to residential this property would
be asking for water, sewer, blacktop streets, and, we, as rural
property owners do not want to be assessed for these suburban
improvements.
Mr. Halla, Sr., also present, voiced the same objections and
stated that in Edina and Bloomington, in some cases, rural areas
were not assessed if suburban improvements were needed on one
side of the street and the other side of the street was rural.
Mr. Roy Johnson, resident within Bluff Creek Highlands Addition,
did not get a notice. He stated that he had purchased his two
acres in a rural area so that he could raise chinchillas.
The hearing adjourned at 9:00 P.M.
Public Hearing, Moline Addition
The Chanhassen Village Council met on June 10, 1968, at 9:00 P.M.
for the purpose of conducting a public hearing on Moline Addition.
The following members were present: Mayor Coulter, Councilmen
Pearson, Bennyhoff, Klingelhutz, and Hill.
The Planning Commission Chairman gave a report. Mr. Moline was
present and gave a report as to miscellaneous I questions on plat.
The hearing adjourned at 9:15 P.M.

CHANHASSEN_ VILLAGE COUNCIL MEETING. JUNE. 10., 1968
The Chanhassen Village Council met in special meeting on June 10,
1968 at 9:15 P.M. The following members were present: Mayor
Coulter, Councilmen Bennyhoff, Klingelhutz, Hill, and Pearson.
M. A. GEDNEY RESOLUTION: Attorney Larson gave a report on a..
Resolution in the matter of the petition of the City.of Chaska,
Carver County, Minnesota, to annex certain land in the Town of
Chaska, Carver County, Minnesota. This is in regard to property
now owned by the American Crystal_Sugar Company and which.said
land may be acquired by the.M..A. Gedney Company. Attorney Larson
stated that it would be in the best interest of all concerned
if this property is acquired by the M. A. Gedney Company that it
be annexed to the Village. of .Chanhassen.
A motion was made by Councilman Bennyhoff and seconded by Councilman
Hill to approve the Resolution submitted by Attorney Larson. The
following voted in favor thereof: Mayor Coulter, Councilmen
Klingelhutz, Hill, Pearson, and Bennyhoff. No negative votes.
Motion carried.
ANTIQUE SHOP ON HIGHWAY #41: A motion was made by Councilman
Bennyhoff and seconded by-Councilman Pearson that Mr. Fenstermaker
should appear before the Planning Commission at their next meeting
for a Non - Conforming Use Permit. He should be warned not to go
further with changing of the existing building as he is in violation
of the Zoning Ordinance. The:foliowing voted in favor thereof:
Mayor Coulter, Councilmen Hill, Pearson, Bennyhoff, and Klingelhutz.
No negative votes. Motion carried.
SANITARY LANDFILL SITES: The Planning Commission Chairman gave a
report as to the proposed sites. A motion was made by Councilman
Hill and seconded by Councilman Bennyhoff that no further action
would be made by the Council until a more complete report from
the Village Engineer on the Klein and Teich applications and
feasibility to operate in accordance with Ordinance No. 15. The
following voted in favor thereof: Mayor Coulter, Councilmen
Pearson, Bennyhoff, Klingelhutz, and Hill. No negative votes.
Motion carried.
STORAGE OF HOUSE ON PALMER PROPERTY: Mr. Nels Hanson requested
the Council grant him permission to store a moved in house on the
Palmer property for approximately 30 days.
Councilman Hill moved and Councilman Klingelhutz seconded that
the Council reject the application to store a house on the Palmer
property. The following votes were cast: Councilman Klingelhutz -
aye, Councilman Hill - aye, Councilman Bennyhoff - no, Councilman
Pearson - no, Mayor Coulter - no. Motion defeated.
A motion was made by Councilman Pearson and seconded by Councilman
Bennyhoff that Mr. Nels Hanson be allowed to move in and store

a house on Palmer property until August 1, 1968, at which time
it must be moved to a permanent location. Before moving in,
Mr. Hanson must file with the Village a bond of $4,000. If house
has not been moved to approved location by deadline, the bond or
house will be turned over to the Village. The following votes
were cast: Councilman Bennyhoff - aye, Councilman Hill - aye,
Councilman Pearson - aye, Councilman Klingelhutz - no, Mayor
Coulter - no. Motion carried.

GRAVEL PITS (LOVETANG): Mr. and Mrs. Lovetang voiced their concern
as to what and when will something be done in regard to_a.Village
ordinance concerning Gravel Pits. Their specific concern is with.
the Gravel Pit located on Highway 101 directly north of their
property, owned and operated by.Mr..Bloomberg — They stated,that
he was not using this only .for ._his own property _but _is _al,so. _selling
gravel.
A motion was made by Councilman Bennyhoff and seconded by..Councilman
Pearson _.that Mr.. Bloomberg will _have to-,stop-immediately the sale
and hauling of material .from .his property .on __the. _north end .of
Colonial Grove.:.Also no more.-excavation will be.._allowed .as of
this date.. The property should be graded.to an-acceptable grade
of the Village Engineer taking care of .any drainage problems.. -
All grading must be completed by June 21, 1968. The following
voted in favor thereof: Mayor Coulter, Councilmen Hill, Bennyhoff,
Pearson, and Klingelhutz. No.negative votes.. Motion carried.
