1968 07 01CHANHASSEN VILLAGE COUNCIL MEETING JULY 1, 1968
The Chanhassen Village Council met in regular meeting on July 1, 1968,
at 8:00 P.M. The following members were present: Mayor Coulter,
Councilmen, Hill, Klingelhutz, Bennyhoff, and Pearson. The meeting
was called to order and the Pledge to the Flag was,given.
MINUTES: On a motion made by Councilman Pearson and seconded by
Councilman Hill to approve the June 17th minutes amended as follows,
Roy Johnson property is not part of the proposed land to be rezoned.
The following voted in favor thereof: Mayor Coulter, Councilmen Hill,
Bennyhoff, Pearson, and Klingelhutz. No negative votes. Motion
carried.
On a motion made by Councilman Hill and seconded by Councilman Bennyhoff
to approve the June 24th minutes amended as follows, change the word
foregoing to following. The following voted in favor thereof: Mayor
Coulter, Councilmen Hill, Pearson, Bennyhoff, and Klingelhutz. No
negative votes. Motion carried.
On a motion made by Councilman Pearson and seconded by Councilman Hill
to approve the June 18th Planning Commission minutes. The following
voted in favor thereof: Mayor Coulter, Councilmen Hill, Bennyhoff,
Klingelhutz, and Pearson. No negative votes. Motion carried.
On a motion made by Councilman Hill and seconded by Councilman Pearson
to approve the June 25th Planning Commission minutes. The following
voted in favor thereof: Mayor Coulter, Councilmen Pearson, Bennyhoff,
Hill, and Klingelhutz. No negative votes. Motion carried.
ANTIQUE SHOP: The Administrator is to contact Mr. Fenstermaker and
compile necessary data to submit to the Council before final approval
is given.
MOLINE ADDITION: On a motion made by Councilman Klingelhutz and
seconded by Councilman Pearson to approve the plat with alternate
possible water and sanitary sewer lines on right -of -way on each side
outside the limits of the road surface, revised plat 5- 12 -68. The
following voted in favor - thereof: Mayor Coulter, Councilmen Hill,
Pearson, Bennyhoff, and Klingelhutz. No negative votes. Motion carried.
FIRST AID: A report was given by Robert Amiot on the need for some
improvements regarding first aid responsibilities and training and
suggested a number of things that should be improved.
INDUSTRIAL COMMISSION REPORT: A report was given by Robert Reichert
on the prepared report that he has submitted to the Council for study.
A decision will be made on July 8 as to the inception of this Commission.
URBAN - RURAL TAXATION: On a_motion made by Councilman Klingelhutz and
seconded by Councilman Bennyhoff to approve the proposed ordinance
with one amendment to Section 7, Subsection (b) land in a rural service
district must be open, rural in character, and may include pasture,
timber, waste, unusable wild land and land included in Federal farm
programs and•used primarily for agricultural purposes. The following
votes ere:;_ - cast: Councilman Pearson - aye, Councilman Bennyhoff - aye,
Councilman Klingelhutz - aye, Mayor Coulter - no, Councilman Hill - no.
Motion carried.
1967 -4 SUNRISE HILLS CIVIC ASSOCIATION: A report was given by Mr.
Passe, President of the Sunrise Hills Civic Association, as to some
of the problems with this project.
1. Who has the say when final work has been done?
Answer - Village Council.
2. Will property owners be consulted on the work to be done
in the final landscaping? Answer - Yes.
3. When will work be completed? Answer - Penalty clause will
be enforced in regard to inclement days.
The following property owners were present:
Mr. and Mrs. Ken Erickson, Mr. and Mrs. Scott, Mr. and Mrs. Leo Bovy,
Mrs. Barrett, Mr. Thrane, and Mr. Scholer.
On a motion made by Councilman Pearson and seconded by Councilman
Bennyhoff that the Village Engineer put pressure upon the contractor
to complete this project as soon as possible. The following voted
in favor thereof: Mayor Coulter, Councilmen Hill, Pearson, Bennyhoff,
and Klingelhutz. No negative votes. Motion carried.
Mr. Erickson feels more coordination between owners, contractor, and
Village Engineer is needed.
On a motion made by Councilman Bennyhoff and seconded by Councilman
Klingelhutz Village Engineer meet with property owners personally to
determine what should be done to complete project to satisfaction of
all owners, if any extra costs are involved the engineer will report
to Council for their final decision on such problems. The following
voted in favor thereof: Mayor Coulter, Councilmen Hill, Pearson,
Klingelhutz, and Bennyhoff. No negative votes. Motion carried.
The Administrator was instructed to have engineer present a report
on July 8 at 9:00 P.M.
KELM PROPERTY: Attorney Larson advised the Council that Judge Arlo
E. Haering of District Court signed the order for permanent injunction
on Friday., June 28 restraining Roy Kelm and his wife and all persons
acting under them from maintaining and operating a junk yard and motor
vehicle wrecking dump and that the order gives the Kelm's until
December 31, 1968, in which to remove the presently existing offending
materials.
PROPOSED ORDINANCE-ON EXTENSION OF:-SANITARY SEWER: The Council Committee
will research this ordinance and will submit a final draft.
STOP SIGNS: A motion was made by Councilman Pearson and seconded by
Councilman Klingelhutz that the four stop signs presented by Police
Chief Klein be approved and installed immediately. The following
voted in favor thereof: Mayor Coulter, Councilmen Hill, Bennyhoff,
Klingelhutz, and Pearson. No negative votes. Motion carried.
DUTCH.ELM...ORDINANCE: The.proposed ordinance will.be submitted to
Park and Recreation Commission for their recommendation.
WESTERN "HILLS: On a motion made by Councilman Pearson and seconded
by Councilman Bennyhoff that the Village accept the water and sanitary
sewer system as of April 5, 1969. The following voted in favor thereof:
Mayor - Coulter , ,.Councilmen Hill, Bennyhoff, and Pearson. Councilman
Klingelhutz abstained. No negative votes. Motion carried.

SOUTHWEST SANITARY SEWER DISTRICT: A report given by the Administrator
in regard to meetings he has attended on the Southwest Sanitary Sewer
District. It is noted that the Fiscal Agent had been hired by the
name of Zane Mann.
Discussion as to the necessity of Chanhassen Village Council to arrive
at a decision soon.
HUMAN RIGHTS: Names of prospective people to be appointed to this
Commission will be submitted to the Council before study commission
will be appointed.
On a motion made by Councilman Pearson and seconded by Councilman
Klingelhutz the meeting adjourned.
