" ''REZONING TO PLANNED INDUSTRIAL DISTRICT
The Chanhassen Village Council met on July 8, 1968, at 7:00 P.M. for
the purpose of conducting a rezoning - hearing. The following members
were present: Mayor Coulter and Councilman%Klingelhutz. Councilmen
Bennyhoff, Hill,-and Pearson appeared late.
The following interested�adToininI property owners were present: Don
Lyman, Reed Maurer. ` and'Wal1y Kerber. Richard Lyman, Anne Neils, Al
Barnacle, and Nicholas Waritz were present from the Planning Commission.
Mr. Max Otto,* Attorney representing the Beiers Company`, gave a-report
in detail and stated that the only variance they were requesting was a
reduction in acreage as listed in Section 4 of Ordinance #26; also
that the street and plat had been given a name. The plat to' named
Beiers Company Planned Industrial Park and the street be called Science
Circle,'East and West. He also 'stated that'in the final plat that if
a lift station for the sanitary sewer was necessary that an outlot
would be incorporated with the necessary easements, etc. This has been
discussed with the Village Engineer.
Attorney Larson gave a report.as.to the Abstract and Covenants. He has
not had time.to present a: written report and would do so immediately,
but that he has read over the Abstract apd Covenants and would give his
approval.

Councilman Hill questione drainages The Village Engineer reported
that the basic drainage was shown and that the preliminary plat would
be submitted to the State Highway Department for their approval.
The public hearing closed at 8:30 P.M.

The Chanhassen Village Council -met in special meeting on July 8 1968,
at 8:30 P.M. The following members were present: Mayor Coulter, Councilmen
Hill, Bennyhoff, Pearson, and Klingelhutz. The meeting was opened, with
the Pledge to the Flag.
MINUTES: On 'a motion made by Councilman Klingelhutz and seconded by
Councilman Pearson to approve the July 1st minutes amended as follows:
HUMAN RIGHTS: Names of prospective people to be appointed to a study
committee to determine the needs 'and - desires' of the Village of Chanhassen
as to the exigency for a Human- Commission. This Committee will
present their study-to the Council for further action:
The following voted in favor thereof: Mayor Coulter, Councilmen Hill,
Pearson, Bennyhoff, and Klingelhutz. No negative votes. Motion carried.
On a motion made by Councilman Bennyhoff and seconded by Councilman Hill
to approve the June 26th Park and Recreation Commission minutes. The -
following voted in favor thereof: Mayor Coulter, Councilmen Hill, Pearson,
Bennyhoff,'and Klingelhutz. No`negative votes. Motion carried.
On a motion'made by Councilman Hill•and seconded by Councilman Klingelhutz
to approve the July 2nd Planning Commission minutes. -The following voted
in favor thereof: Mayor Coulter, Councilmen Hill, Pearson, Klingelhutz,
and Bennyhoff: No negative votes. Motion carried.
BEIERS COMPANY REZONING: A motion was made by Councilman Hill to grant
approval for the rezoning from Farm,Residential to Planned - Industrial
District and grant a variance of Section 4, Ordinance 26, pertaining to
acreage.
That..part of ,the Southwest.,Quarter „ of-Section 7, Township
Range 22, Hennepin County, Minnesota, lying,.southerly of,the
right -of -way of the Chicago, M_,lwaukee,.St, Paul,. Pacific
Railroad, .,except the- west 628.,05 feet thereof.
in accordance with the preliminary plat presented ,, survey by Schoell
and Madson dated - December 1967, number 5752., Motion seconded by
Councilman Klingelhutz. The following voted in favor thereof: Mayor
Coulter, Councilmen Hill, Pearson, Bennyhoff, and Klingelhutz. No
negative votes. Motion carried.
DRAINAGE COUNTY.ROAD. #14: The Village Engineer gave a,report as to the
problems and- his- ,over,all ,decision by, visually, inspecting the site.
A motion was,,made by.Councilman seconded by Councilman Pearson
that the Village Engineer be- .instructed to prepare,an estimate preliminary
plan of what would be necessary to alleviate.this problem and present it
July 29, 1968, at 8:30 P.M. The following,voted in favor thereof: Mayor
Coulter, Councilmen Hill, Pearson, Bennyhoff, and Klingelhutz. No negative
votes. Motion carried.
1967 -4, PROJECT HILLS) . A- ,xePort was given by -the Village.Engineer.
Miscellaneous problems will be taken care of as per his meeting with
residents of the area. Mr. Robert Smith, resident of Sunrise Hills,
would like Village Engineer to meet with himself,- Bovy's and Barrett's
concerning the bank on- the,rear of their property. The Village Engineer
stated he would meet with them July 11th.
PLANNING COMMISSION: A motion was made by Councilman Klingelhutz and
seconded by Councilman Hill to defer action on appointments in
accordance with the Planning Commission Ordinance #28 to next meeting
with recommendation from Council Committee. The following voted in
favor thereof: Mayor Coulter, Councilmen Hill, Bennyhoff, Pearson, and
Klingelhutz:. No negative votes. Motion carried.`
DOG - CATCHING: _A motion was made by Councilman Hill -.and seconded,by
Councilman Bennyhoff to defer any action until next meeting for a report
from the Council Committee. The following voted in favor thereof: Mayor
Coulter,,,Councilmen Bennyhoff, Klingelhutz, Hill, and _Pearson. No negative
votes., Motion carried. _
INDUSTRIAL COMMISSION :. :. Attorney Larson stated there is- no state,, law he
could fiad.allowing. for a specific mill.levy but that a budget can be set
up out of general obligation - ,funds. A motion was made.by Councilman
Bennyhoff and seconded by Mayor Coulter that a Counci.i.,Committee of
Councilman Klingelhutz and Councilman Pearson work with Mr. Reichert in
setting up the Industrial Commission. The following voted in favor thereof:
Mayor Coulter,,Councilmen Klingelhutz, Pearson, Bennyhoff Hill.- No
negative votes. Motion carried.,.
FENCE COMPLAINT: Ida Johnson presented a bill in the amount of $24.60 for
the repair to fence that is shown on record in the Village Council
minutes , March ,4, 11, and 18, 1968. A motion was made by Councilman
Klingelhutz and seconded by Councilman Pearson that,the Viilage.Engineer
determine if the. €en,ce is on right -o,f- way -,or. on private property. If
after determination by E}zgineer,,the fence is on private property, the bill
submitted by Ida Johnson will be paid. The following voted in favor thereof:
Mayor Coulter, Councilmen Hill, Pearson, Klingelhutz, and Bennyhoff. No
negative votes. Motion carried.

SOUTHWEST SANITARY SEWER DISTRICT: A special meeting on July 22, 1968
at 9:00 P:M. in the Village Hall will be held to present the facts
so that the Village Council can make a decision whether to sign the
agreement to join the Southwest Sanitary Sewer District or not.
NEW MUNICIPAL WELL SITE: The Village Engineer reported that he had
contacted the public health office for their written approval of the
well site but had not received written approval as of this date.
BOARD OF REVIEW: A motion was made by Councilman Klingelhutz and
seconded by Councilman Pearson that we adjourn the Board of Review.
The following voted in favor thereof: Mayor Coulter, Councilmen Hill,
Pearson, Bennyhoff, and Klingelhutz. No negative votes. Motion carried.
SEWER UNIT CHARGE: A motion was made by Councilman Pearson and seconded
by Mayor Coulter to add six additional units to Ed's Super Fair for
sanitary sewer service until they would divert the water from air
conditioning to the storm sewer. The following voted in favor thereof:
Mayor Coulter, Councilmen Hill, Bennyhoff, Pearson,. -and Klingelhutz. No
negative votes. Motion carried.
On a motion made by Councilman Bennyhoff and seconded by Councilman
Pearson the meeting adjourned.
