1968 09 09CHANHASSEN VILLAGE COUNCIL MEETING�SEPTEMB'ER 9, 1968 The Chanhassen Village Council meeting on September 9, 1968, at 8:00 p.m. was opened with the Pledge to the Flag. The following members were presents Mayor Coulter, Councilmen Hill, Bennyhoff', Pearson, and Klingelhutz. - MINUTES: On a motion made by Councilman Hill and seconded by Councilman Klingelhutz to approve the minutes of the August 26th meeting. The vollowing voted in favor thereof: Mayor Coulter, Councilmen Hill, Pearson, Bennyhoff, and Klingelhutz. No negative votes. Motion carried. PLANNING COMMISSION MINUTES: The Planning Commission minutes of August 27 and` 3 were notediand read. ANTIQUE SHOP: On a motion made by Councilman Hill and seconded by Councilman Klinge'lhutz to approvo'the Conditional Use Permit for T. W. Fendtermaker to operate an antique and old furniture shop in accordance with the Conditional Use Permit drawn up by Attorney Larson. The following voted in favor thereof: Mayor Coulter, Councilmen Hill, Pearson, Bennyhoff, and Klingelhutz. No negative votes. Motion carried. Mr. Fenstermaker was present'and voiced disapproval of point number 3 of the Conditional Use Permit regarding -the requirement of renewing this permit every 12 months. He would have liked to have it changed to five-years. STREET LIGHT: On a motion made by Councilman Bennyhoff and seconded by Councilman Hill to -the street light recommended by the Planning Commission on September 3. The following voted in favor thereof: Mayor. Coulter; Councilmen Bennyhoff, Hill, Klingelhutz, and Pearson. No negative votes. Motion carried. PHYSICAL.EXAMINATION: On a motion made by Councilman Hill and seconded by Councilman Pearson that it is the declared policy of the Village concerning permanent.employees, all.Village employees shall submit to a physical examination by the Village Health Officer after four months employment and before being classified as a permanent employee and that the Council` the right to terminate employment at that time upon a finding by the Village Health Officer of a condition of health which might impair the performance of service by the employee for the Village. The following voted in favor thereof: Mayor Coulter, Councilmen Hill, Pearson, Bennyhoff, and Klingelhutz. No negative votes. Motion carried. PLATTING ORDINANCE: Discussion was held on the Platting Ordinance. Page 6 (d ) would like sentence to read - larger than twice the average size. Page 6 (e) delete - gross. On:_a.motion.made:by Councilman Pearson and seconded by Councilman Klingelhutz that the-Council the Platting Ordinance with legal clarification and modification by the Village Attorney. The following voted in favor.thereof: - Mayor Coulter, Councilmen'Hill, Bennyhoff, Pearson,.and Klingelhutz. No negative votes. Motion carried. DEVELOPMENT­CONTRACT•: On a motion made by Councilman Bennyhoff and seconded-.by Councilman-Hill to approve the Development Contract which is to be signed by the Village and the developer before final approval is given on.any plat.. The following voted in favor thereof: Mayor Coulter, Councilmen:Hill, Bennyhoff_; Pearson, and Klingelhutz. No negative votes. Motion carried. The allowed age shall be 14.to 20i. comply wit °h.Fire. Marshal's letter prior to opening also Council may for any sufficient reason in the opinion of the Council recind this action. STATE AID PROJECT: Discussion on this project and a final inspection was -set up for September 10 at 9:00 a.m. Village Engineer, County Engineer, State Inspector, and Council will be present. MUNICIPAL- :SITE4.- On a motion made by-- Councilman Bennyhoff and seconded by Councilman Hill to blacktop the three narrow division strips on the south side of the building. HUMAN RIGHTS.STUDY COMMITTEE: On "a motion made by Councilman Bennyhoff and seconded'by Councilman Hill that Mrs. Russell L. O1son,'Mrs. Muriel J. Buell, Mrs. Ruth'Flucke and Mrs. Clara Bacon be appointed to determine what needs if any in the Village of Chanhassen regard to a Human Rights Commission are needed and report back to the Council with a recommendation. UTILITY DEPARTMENT: On a motion made by Councilman Pearson and seconded by Mayor Coulter to pay C. and L. Trenching $52.00 for the service latteral to the Elroy Williams property and deny the $42.50 charge of water latteral. The following voted in favor thereof: Mayor Coulter, Councilmen Klingelhutz, Hill, Bennyhoff, and Pearson. No negative votes. Motion carried. INDUSTRIAL COMMISSION: A report and budget will be submitted at the next meeting by the Council Committee.
