The Chanhassen Village Council meeting on September 23, 1968, at 8:00
p.m. was opened with the Pledge to the Flag. The following members were
present: Mayor Coulter, Councilmen Pearson, Klingelhutz, Hill, and
Bennyhoff.
MINUTES: Councilman Klingelhutz wants the minutes to reflect that he
was not present - at the time of 'voting on Development Contract and Ray
Brenden Housemove. On a motion made by Councilman Klingelhutz and
seconded by Councilman Pearson to approve the minutes of the September
9, 1968, with the above changes. The following voted in favor thereof:
Mayor Coulter, Councilmen Hill, Bennyhoff, Klingelhutz, and Pearson.
No negative votes. Motion carried.
The Park and minutes of September 5 were read and note
The Planning Commission minutes of September_10 were.read and.noted.
INDUSTRIAL COMMISSION: Discussion was held on how the Village should set
up an Industrial Commission . The Council Committee in charge of this
are to submit a more detailed report at a later date.
1968 -6. (KERBER''DRIVE): On 'a motion made by Councilman Pearson and
seconded by Councilman Hill to hold a public hearing for assessing the
cost for street improvement on Kerber Drive at 7:00 p.m..on October 14,
1968. The following voted in favor.thereofi Mayor Coulter, Councilmen
Hill, Bennyhoff, Klingelhutz, and Pearson. No negative votes. Motion
carried.
PARK AND RECREATION COMMISSION: Rev. Paul Flucke, Chairman, requested
that the area directly behind the Village Hall be leveled and used for
a hockey rink this winter. On a motion made by Councilman Hill and
seconded Councilman Bennyhoff to grant,permission to the Park and
Recreation Commission for use of this site for a hockey,rink. The
following voted'in favor thereof: Mayor Coulter, Councilmen Hill,
Pearson, Bennyhoff, and Klingelhutz. No negative votes. Motion carried.
BUDGET: Fiscal Agent, Don Nolte, explained recommendations and normal
procedures on budget requests. On a_motion made.by Councilman Hill and
seconded by Councilman Bennyhoff that the budget beset as follows:

HOUSEMOVE.: ..On a motion made.by Councilman..Pear and s,econded.
Councilman�Bennyhoff, tp : approve.Ray.,Brenden. . - moving house number l onto
his property on County Road 117 as set up on a separate parcel of
30,000 square feet showing a permanent easement for future roadway.
This, easement, or roadway not. to be_maintained.. "by the Village until
broug4i .up.,to Village standards. The following voted in favor thereof:
Mayor.,Coulter, Councilmen.Hill, Bennyhoff.,.Pearson, and Klingelhutz.—No
negative votes. Motion carried.,.
FIRE. "DEPARTMENT:,."On,a motion.made by Councilman Hill and seconded by
Councilman Bennyhoff to grant approval to the. Fire Department. to purchase
a used Jeep and fix up to be used for a grass fire Jeep. The following
voted-in favor _thereof: Mayor Coulter, Councilmen.Pearson, Klingelhutz,
Bennyhoff, and.H:ill. No negative votes. Motion carried.
DINING THEATRE: The Engineer gave a report on his letter dated July 24
on.the.,items.listed that were..to..be corrected. As of this date.many
have.. not been made also the behlan" .roof. ,was designed for, a: 40 pound live
load and five pound auxiliary. .. The Village.has.not'reaeiVed:.a.'. certified
statement from Mr. Bloomberg's structural engineer on the design and/or
weight.of.the. auxiliary. load that.the behlan.roof.is carrying. The
Village-Attorney stated in "his. opinio.n.there were three ways this could
be handled.
;: 1. A stop order . issued ..until corrections could be made..,
2. - Owner.appear before Council and show why license should not.
be revoked::
3. No further occupancy until corrections are made.
Mr. Bloomberg's engineer should submit a certified statement as to the
structural design of the- dining..theatre building.
On a. motion. made. by_ Councilman, M and. seconded" by Councilman Pearson
that the Viilag.e.Attorney.write a_letter to.Mr.,.Bloomberg..stating the,
Village's position. The . fo.11owing voted .i'n favor thereof.-, Coulter,
.. Councilmen Hill,'.Bennyhoff, Pearson, and Klingelhutz.. No negative votes.
Motion carried.
,S,UMMONS BY Mayor Coulter stated that he.had attended a hearing
in Glencoe with the Village Attorney and, felt that the minutes should
reflect that the Village Attorney did an outs.tanding.job,. From the
action presented by the Village Attorney, Victoria`s Attorney asked that
the Court grant them 15,days in which to file a brief.
REPLAT OF SUNRISE HILLS SECOND ADDITION: Councilman Klingelhutz felt
that this was a reasonable request. It should be noted at.this_ time that
the minutes of the Planning Commission September 10 meeting reflect same.
On a motion made by Councilman Hill and seconded by Councilman Klingelhutz
that the public hearing for said plat be set for October 14,.19.68, at
7:30 p.m. The following voted in favor thereof: Mayor Coulter; Councilmen
Hill, Bennyhoff, Pearson, and Klingelhutz. No negative.votes. Motion carri
BEIERS COMPANY: On a motion made by Councilman Klingelhutz and
seconded by Councilman Pearson that the Beiers Company Planned Industria
Development plat be approved as submitted which shows the deletion of
utility easements between Lots 1 and 2, and 2 and 3, Block.l,_upon the
condition that a purchaser does exercise his option,by.September 30 to
purchase Lots 1, 2, and 3, in the event the option is not exercised the

subdivider will reinstate the utility easements. The following voted
in favor thereof: Mayor Coulter, Councilmen Hill, Pearson, Bennyhoff,
and Klingelhutz. No negative votes. Motion carried.
SIGN ORDINANCE: On a motion made by Councilman Pearson and seconded
by Councilman Hill to return the Sign Ordinance to the'Planning Commission.
The following voted in favor thereof: Mayor Coulter, Councilmen Hill,
Pearson, Klingelhutz, and Bennyhoff. No negative votes. Motion carried.
TRUNK SEWER LINE: A discussion was held on a.major trunk line extension
both -.by the Council and Village Engineer upon recommendation by the
Planning Commission September 17th. On a motion.made by Councilman
Pearson and seconded by Councilman Bennyhoff to table further action on
this major trunk line until further study and data has been presented.
The following voted in favor thereof: Mayor Coulter, Councilmen Hill,
Pearson, Bennyhoff, and Klingelhutz. No negative votes. Motion carried.
On a motion-made by Councilman Bennyhoff and seconded by Councilman
Klingelhutz to authorize the Village Engineer to make preliminary layout
of trunk line extension from existing lift station to the property north
of Highway 5 and east of Highway 101 to be presented on October 14.
The following voted in favor thereof: Mayor Coulter, Councilmen Hill,
Bennyhoff, Pearson, and Klingelhutz. No negative votes. Motion carried.
WELL SITE: On a motion made by Councilman Klingelhutz and seconded by
Councilman Pearson that the Administrator present sites available on
October 14. The following voted in favor thereof: Mayor Coulter,
Councilmen Hill, Bennyhoff, Pearson,.and.Klingelhutz. No negative votes.
Motion carried.

Councilman Bennyhoff moved the adoption of the following resolution:
BE I.T RESOLVED.that $1,520.8.4, check. #1985, General Account, to paid to
First National Bank of Saint Paul on a warrant. Resolution seconded.
by Councilman Hill. The following voted in favor thereof:. Mayor
Coulter, Councilmen Hill, Bennyhoff, Pearson, and Klingelhutz. No.
negative votes. Motion carried.
DEPARTMENT,PROCEDURE: Any department.desiring.the use of another:
departments equipment shall first have the approval of both department
heads involved and Administrator approval prior to actual use:._
PROJECTS: .On,a.motion made by,-Councilman Hill and-seconded-by
Councilman Pearson the Administrator draw up a--.-special form for change
orders that will be used on various.projects,in the Village The
following voted. in. favor thereof: Mayor Coulter.,. Councilmen Hill,
Bennyhoff, Pearson, and Klingelhutz. No negative votes. Motion carried.
From now on all change orders will be made and signed on.any changes,
on any.projects will be required to be signed by the engineer and
countersigned the Administrator., The Administrator is-,to notify the
Council of any such action.
PROJECT BILLS: On a motion made by Councilman Klingelhutz and seconded
by Councilman Pearson that the bills presented for the.three projects
not be paid until a written and detailed explanation is given by the
Village Engineer at the next meeting. The following voted in favor thereof:
Mayor Coulter, Councilmen Hill, Bennyhoff, Klingelhutz, and Pearson. No
negative votes. Motion carried.
