1968 10 07CHANHASSEN VILLAGE COUNCIL MEETING OCTOBER 7, 1968 The Chanhassen Village Council meeting on October 7, 1968, at 8:00 p.m. was opened with the Pledge to the Flag. The following members were present: Mayor Coulter, Councilmen Hill, Bennyhoff, Klingelhutz, and Pearson. MINUTES: On a motion made by Councilman Hill and seconded by Councilman Bennyhoff to approve the minutes of the September 23, 1968, meeting. The following voted in favor thereof: Mayor Coulter, Councilmen Hill, Bennyhoff, Klingelhutz, and Pearson. No negative votes. Motion carried. The September 24 and October 1, 1968, Planning Commission minutes were read and noted. The September 26, 1968, Park and Recreation Commission minutes were read and noted. DINING THEATRE: The Village Engineer gave a report as to the status of the construction to date. The Village Engineer will meet with Mr. Bloomberg and his structural engineer Tuesday at 9:00 a.m.. All plans will be signed by a' registered structural engineer that the building is structurally sound. Mr. Bloomberg stated that he has met with the fire underwriters and that the sprinkler system has been approved. On a motion made by Councilman Hill and seconded by Councilman Pearson that full plans be submitted and signed by a structural engineer also stating that the building to date is structurally sound. A letter be submitted by the Fire Marshal approving the condition.of.the building. When these steps have been approved, authorization to occupy will be granted. The following voted in favor thereof: Mayor Coulter, Councilmen Hill, Pearson, Klingelhutz, and Bennyhoff. No negative votes. Motion carried. PROJECTS 1967 -2, 3 and 4: The Village Engineer explained different points as to the status of these projects. Projects 2 and 3 will be ready for final payment October 21. Project 4 should be ready in approximately one month. FIRE DEPARTMENT: FIRE JEEP: Councilman Pearson moved the adoption of the following resolution: BE IT RESOLVED that $1,100.00, check #1999, General Account, be paid to James Thompson on a warrant. Resolution seconded by Councilman Klingelhutz. The following voted in favor thereof: Mayor Coulter, Councilmen Hill, Bennyhoff, Klingelhutz, and Pearson. No negative votes. Motion carried. PAINTING INTERIOR: Authorization was given the Village Treasurer to pay the balance of the $1,000 allowed to the Fire Department for finishing the interior of the Fire Station to be paid towards the balance of the painting. FRANK BEDDOR: Chairman of the Board of Adjustments and Appeals, Councilman Hill, gave a report as to several meetings that the Board has had regarding a request for a variance in the side yard requirement. The request was for six feet, the Zoning Ordinance requires 35 feet. The Board of Adjustments and Appeals recommendations were as follows: 1. That with a letter of approval from the adjacent property owner, Miles Lord, that they would recommend the Council grant the request. 2. If Mr. Beddor would not_ -.have a letter.of approval from the adjacent property owner they recommend the Council set a date for a public hearing. 3. Mr. Beddor could build his.house, not build his garage at this time as the house would not necessitate the granting of any variance. An explanation was given by Mr. Beddor and Mr. Miles Lord regarding the request for a side yard of'.six feet. The minutes should reflect Mr. Lord was not interested in granting his approval on a six foot side yard. On a.motion made by Councilman Pearson to grant approval for a 15 foot side yard (this would be a variance from the Ordinance stating 35 feet). Motion died for lack of a second. On a motion made by Councilman Hill to deny the request of Mr. Beddor. for a six foot side yard (the Ordinance states 35 feet). Motion died for lack_ of a second. : On a motion made by Councilman Pearson and seconded by Councilman Bennyhoff to grant Mr. Beddor approval to build as per his plans with a side.yard of 15 feet on west property line on property described as follows: 2.04 acres.in the NEB, Section 2, Township 116, Range 23. The following votes.were. cast: Councilman.Bennyhoff.- yes,.Councilman Hill - no, Councilman Pearson - yes, Councilman Klingelhutz - yes, Mayor Coulter -,no.. Motion carried. SALE.OF PROPERTY IN CHANHASS.EN (COUNTY AUDITOR): A letter was read from the Carver County with a submitted list of lands that.is be approved.by the.Council prior to the County setting the date of sale. The.Council decided to table a decision until next meeting, in the meantime refer this to the Park and'Recreation Commission to study and see if any of this property could be utilized in their overall plan..
