1969 05 19PUBLIC HEARING MAY 19, 1969 SANITARY SEWER TRUNK LINE EXTENSION The Chanhassen Village Council met on May 19, 1969, at 7:30 p.m. for the purpose'o.f conducting a hearing on the proposed sanitary sewer trunk line extension to Bloomberg property. The following members were present: Mayor Coulter, Councilmen Hill, Bennyhoff, Klingelhutz, and Pearson. The Village explained the routes as shown on the preliminary feasibility study. - The Sinnen property on the South side of Highway 5 also the Second Addition of Chanhassen Estates have made preliminary requests of the Engineer for sewer and water as to the feasibility and timing of when they could be installed. The Village Attorney recommended continuing hearing until a fourth alternative could be presented to cover this additional area. A motion was made Councilman Hill and seconded by Councilman Bennyhoff to continue the public hearing on June 16 at 7:30 p.m. when all information would be available. The following voted in favor thereof: Mayor Coulter, Councilmen Hill, Bennyhoff, Klingelhutz, and Pearson. No negative votes. Motion.carrie.d. Public hearing adjourned at 8:00 p.m. MINUTES: The minutes should reflect that'the_Meeting May 5-was. not continued after the public on May 12 as was scheduled due to the time when the public hearing was adjourned. A motion was made by Councilman Pearson and seconded by Councilman Hill to approve the minutes of the April 14,,April 21 and May 5 Council meetings. The following voted in favor thereof: Mayor Coulter; Councilmen Hill, Bennyhoff, Pearson, and Klingelhutz. No negative votes. Motion carried. A motion was made by Councilman Bennyhoff and seconded by Councilman Hill that the Planning Commission minutes of April 28 and May 13 were read and noted. The following voted.in favor thereof: Mayor Coulter, Councilmen Hill, Bennyhoff, Klingelhutz, and Pearson. No negative votes. Motion carried. A motion was made by Councilman Klingelhutz and seconded by Councilman Pearson that the Park and Recreation minutes of April 17 and May 1 were noted and read. The following voted in favor thereof: Mayor Coulter, Councilmen -Hill, Bennyhoff, Pearson, and Klingelhutz. No negative votes. Motion carried. A motion was made by Councilman Klingelhutz and seconded by Councilman Hill that all minutes of;prior meetings be approved at each Council meeting. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Hill, Klingelhutz, and Pearson. No negative votes. Motion carried. PARK AND RECREATION: A by Councilman Bennyhoff and Edwin Seim from' voted in favor thereof: Klingelhutz, and.Pearso; motion was made by Councilman Hill and seconded to accept the resignations of Mervin Eisel Park and Recreation Commission. Minutes, May 19, 1969 -2- ELECTION PRECINCTS: Councilman Pearson moved the adoption of Resolution No. 5-19-69: BE IT RESOLVED by,the Village Council of the Village. Chanhassen, Minnesota, as follows: Section'l" It_is hereby found and determined that the geographical size of the Village of Chanhassen necessitates the establishment within the Village of three election precincts as hereinafter described. Section 2. ORDINANCE 5B, SANITARY SEWER ORDINANCE: A, motion was made.by Councilman Pearson and,seconded " by Councilman Hill approve the amendment to Ordinance 5 entitled 5B, as submitted, dated April 28, 1969. The.following voted in favor thereof: Mayor Coulter, Councilmen Hill, Bennyhoff, Klingelhutz, and Pearson. No negative,votes. Motion carried.. ORDINANCE 6A MUNICIPAL "WATER SUPPLY SYSTEM: A motion was made by Councilman Pearson ` and - seconded by Councilman Klingelhutz"to approve the amendment to Ordinance No. 6, entitled 6A, as submitted, dated April 28,.1969. The following voted in.favor thereof: Mayor Coulter, Councilmen Hill -, Bennyhoff, Klingelhutz,, and Pearson. No negative votes. Motion carried. CEDAR CREST -i - A motion was made by Councilman'Hi11_and se ;conded.by. Councilman Bennyhoff to table a decision until Village Attorney and Village Engineer have given approval. RILEY LAKE ROAD: "The Village Engineer gave a report on the status of Riley Lake Road as to work that has been done to date. HUD: A motion was made by Councilman Klingelhutz and seconded by Councilman Hill to authorize the.Mayor and Clerk - Administrator to sign the documents submitting a request to HUD for planning assistance on a comprehensive sanitary sewer and Village water "system. The following voted in favor thereof: Mayor Coulter, Councilmen Hill, Pearson, Klingelhutz, and Bennyhoff. No negative votes. Motion carried. Council Minutes, May 19, 1969 -3- SUNRISE HILLS 1967 -4: The Council Committee explained what has been done to date and the work necessary to complete the project. A motion was made by Councilman Klingelhutz and seconded by Councilman Pearson to remove one water and sewer assessment from the Western Hills Addition that was placed on the 1967 -4 project. The following voted in favor thereof: Mayor Coulter, Councilmen Hill, Bennyhoff, Klingelhutz,,and Pearson., negative votes. Motion carried. A motion was made by Councilman Bennyhoff and seconded by Councilman Hill to table any decision on Lots 1, 2, 3,,and 4, Block 3 until they are brought before the Council again by Mr. Scholer. The following voted in favor thereof: Mayor Coulter, Councilmen Hill, Bennyhoff, Pearson, and Klingelhutz. No negative votes. Motion carried. PARK AND RECREATION: A motion was made by Councilman Hill and seconded by Councilman Pearson to give preliminary approval to the Chanhassen Park Study. The following voted in favor thereof: Mayor Coulter, Councilmen Hill, Bennyhoff,_Klingelhutz, and Pearson. No votes. Motion carried. At this time there was a discussion on flood plain and drainage way zoning and what restrictions should be placed upon these areas so that future areas would.not be blocked by construction and cause miscellaneous flooding problems. The Planning Commission is working on a Flood Plain and Drainage Way Zoning Ordinance at this time. HIGHWAYS.212- 169 -41: The Clerk- Administrator informed the Council of a special meeting being held at the Eden Prairie Village Hall on May 21 at 8:00 p.m. at which time Mr. Brauer will explain how the alternates as presented in the Highway Department's Interim Report will affect Chanhassen and Eden Prairie also which.route he feels will be best for Chanhassen and Eden Prairie. SIGN_ORDINANCE: A motion was made by Councilman Bennyhoff and seconded by Councilman Hill to approve the.Sign Ordinance as submitted with changes as listed from the Village Attorney dated May 15, 1969. The following voted in favor thereof: Mayor Coulter, Councilmen Hill, Bennyhoff., Klingelhutz, and Pearson. No negative votes. Motion carried. CONNOR'S CORNER: Mr. Wannous was present requesting that the Council resurface areas on Houton Avenue that broke up this Spring. The Council.informed Mr: Wannous that this work was in the schedule of work to be done.: . KERBER DRIVE: A motion was made by Councilman Pearson and seconded by Councilman Hill that the Village Attorney be instructed to answer Pat Kerber's letters explaining the Village's responsibilities on this project. The following voted in favor thereof: Mayor Coulter, Councilmen Hill, Bennyhoff, Klingelhutz, and Pearson. No negative votes. Motion carried. Council, Minutes, May 19, 1969 -4- ROSE LANE: A motion was made by Councilman Bennyhoff and seconded by Councilman Hill that a new lock be placed on the - chain- across Rose Lane -and to notify Shorewood that they must contact the Chanhassen Police Department for any resident or landowner on Christmas Lake who wish access to Christmas Lake. -The following voted in favor thereof: Mayor Coulter, Councilmen Hill, Bennyhoff -, Klingelhutz, and Pearson.- No negative votes. Motion carried. At this time a-- •lenghy discussion as to the problems of Rose Lane involved about many possibilities on correcting this problem. The Village Attorney stated that the Council could start proceedings for vacating this roadway. At this time no further action.was taken. PELLAR: A motion was made by Councilman Hill and seconded by Councilman Pearson to give the Village Attorney authority to meet with Mr. Scholer concerning easements for water and sewer laterals across Outlot No.3 to serve Mr. Pellar's property. The following voted in favor thereof: Mayor Coulter, Councilmen Hill, Bennyhoff, Klingelhutz, and Pearson. No negative votes: Motion carried. BILTIS: A motion was.made by Councilman Hill and seconded by Councilman Pearson to approve all bills submitted. The following voted in favor thereof: Mayor Coulter, Councilmen Pearson, Klingelhutz, and Bennyhoff. No negative votes. Motion carried. Councilman Hill moved the adoption of the following resolution: BE IT RESOLVED that $2,619.45, check #232, be paid to Keys Well Drilling for project 68 -2. Motion seconded by Councilman Bennyhoff. The following voted in favor thereof: Mayor Coulter, Councilmen Hill, Bennyhoff, Klingelhutz, and Pearson. No negative votes. Motion carried. FIRE DEPARTMENT: A motion was'made by Councilman Hill and seconded by Councilman Pearson to approve paying the Fire Department $30.00 per call plus.$2.00 for each man answering the fire Ball retroactive to January 1, 1969. The following voted in favor thereof: Mayor Coulter, Councilmen Hill, Bennyhoff, Klingelhutz, and Pearson. No negative votes. Motion carried. PLUMBING INSPECTOR: A motion was made by Councilman Bennyhoff and seconded by Councilman Pearson to approve Plumbing Inspector's inspections at a rate of $5.00 per inspection to be paid with the automatic bills.. -The following voted in favor thereof: Mayor Coulter, Councilmen Hill, Bennyhoff, Klingelhutz, and _Pearson. No negative votes. Motion carried. SUNRISE HILLS THIRD ADDITION: A motion was made by Councilman Bennyhoff and seconded by Councilman Klingelhutz to authorize the Mayor and Clerk - Administrator to sign the final plat of Sunrise Hills Third Addition.
