1969 07 28CHANHASSEN VILLAGE COUNCIL MEETING_JULY 28, 1969 The Chanhassen Village Council met on July 28, 1969, at 7:30 p.m. for the purpose of conducting public hearings on rezoning. The following members were present: Mayor Coulter, Councilmen Hill, Bennyhoff, Klingelhutz, and Pearson. PUBLIC HEARING ON REZONING OF SCHNEIDER AGENCY, INC. PROPERTY: There being no persons present objecting to the rezoning a motion was made by Councilman Klingelhutz and seconded by Councilman Hill to adjourn the public hearing. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Hill, Klingelhutz, and Pearson. No negative votes. Motion carried. PUBLIC HEARING ON REZONING OF JOHN HUBER PROPERTY: There being no persons present objecting to the rezoning a motion was made by Councilman Pearson and seconded by Councilman Klingelhutz to adjourn the public hearing. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Hill, Klingelhutz, and Pearson. No negative votes. Motion carried. PUBLIC HEARING ON REZONING OF JOHN BROSE PROPERTY: There being no persons present objecting to the rezoning a motion was made by Councilman Klingelhutz and seconded by Councilman Pearson to adjourn the public hearing. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Hill, Klingelhutz, and Pearson. No negative votes. Motion carried. VILLAGE BROCHURE: - The Administrator presented a brochure that the Chamber of Commerce has started working on which would promote the Village of Chanhassen to prospective interested industrial and commercial people who desire to locate in this area. This brochure is designed to explain what facilities and services the Village would have to offer also relationship to important facilities in the metropolitan area. It should, be noted that the Industrial Commission has done some basic research on this brochure with the possibility that the Village would participate with the Chamber of Commerce on some of the expenses of this brochure. 68 -1B STORM SEWER PUBLIC HEARING: Mayor Coulter turned the meeting over to acting Mayor Councilman Klingelhutz stating that his property lies within the affected area. Councilman Klingelhutz stated that he is the brother of Tom Klingelhutz who is a partner in the Hansen and Klingelhutz Construction Corporation which is the developer of Western Hills and that if there is any objection he would turn the Chair over to some other Councilman. No objection was stated by any of the persons present. The hearing proceeded. The following persons were present: Jim Payseno, Mr. and Mrs. Walter Eldred, Mrs. Gary Baker, John Yager, Lyle Ricklifs, Denis Stedman, Hubert Forcier, Willis Nelson, Ward Passe, Bob Scholer, Richard Muggli, Sylvester Chastek, Albin Olson, Thomas Lentz, Ronald Mielke, Francis Bjornson, Tom Klingelhutz, Douglas Hansen, Raymond Dietz, Bernard Harroun, Mrs. John Kirtland, Mr. and Mrs. Bonn Clayton, Ralph Thrane, Michael Walsh, and Tom Faust. r. The Administrator read a copy of the official publication. The Village Engineer (Bill Schoell) gave a report for the proposed project in detail explaining the areas that would-be served and assessed. Bonn Clayton: A number of us are concerned about the loss of trees on our rear lot lines where the utility easement is and where the storm sewer would be installed. The Engineer stated that everything would be done to protect as many trees as possible. A number of people expressed concern over the size of pipe, if it would be large enough to sufficiently serve the area without backing up the water. The Engineer stated that the design was on a five year frequency maximum rainfall also stating that when construction plans are drawn up.all size and locations of lines would then be determined., Eugene Coulter: Are the streets going to be assessed? Engineer: This is a matter of Council policy and a decision would be made prior to the final assessment by the Council. Eugene Coulter: I would like to question the Council if the streets are going to be assessed. Councilman Hill: This is a hearing and no decision will be made at this time. Hubert Forcier, Jr.: Also expressed concern on the pipe size feeling that it may be designed too small. There being no persons objecting to this project a motion was made by Councilman Hill and seconded by Councilman Pearson to adjourn the public hearing. The following voted in favor thereof: Councilmen Hill, Pearson, Klingelhutz, and Bennyhoff, Mayor Coulter. No negative votes. Hearing adjourned at 9:45 p.m. LAKE RILEY: A motion was made by Mayor Coulter and seconded by Councilman Pearson that the Village allocate the costs to purchase copper sulphate in the quantity setforth by the Conservation Department for one treatment. The following voted in favor thereof: Mayor Coulter, Councilmen Pearson, Hill, and Klingelhutz. Councilman Bennyhoff voted no. Motion carried. Robert Lindahl stated that the Lake Riley Homeowners Association would administer the application of copper sulphate if the Village would purchase it. Also that the homeowners would apply for the permit from the Conservation Department to apply copper sulphate. The minutes should reflect that the main reason that the Council felt that the Village should participate with this project was that the sewer plant effluent did ultimately drain into Lake Riley. POLICE DEPARTMENT: The Mayor read a letter from the Sheriff requesting an additional $3,UOO for the year 1969. The Mayor stated that the Victoria Policemen give Chanhassen more help than Chanhassen Policemen give Victoria. A motion was madE—by, Councilman Klingelhutz and seconded by Mayor Coulter that $2,000 be added to the Police Budget for 1969. The followin voted in favor thereof: Mayor Coulter, Councilmen Hill, Pearson, Bennyhoff, and Klingelhutz. No negative votes. Motion carried. Council Minutes, July 28, 1969 -3- SOUTHWEST SANITARY SEWER DISTRICT: Councilman Hill moved the adoption of Resolution number 7 -28 -69 Accepting the Village of Shorewood as -a party to a joint-powers agreement dated March 29, 1969. Resolution seconded by Councilman Pearson. The following voted in favor thereof: Mayor Coulter, Councilmen Hill, Pearson, Bennyhoff, and Klingelhutz. No negative votes. Motion carried. Said Resolution is on file in the Village Office. REZONING: A motion was made by Councilman Bennyhoff and seconded by Councilman Pearson to rezone the following described tract of land from a Farm Residence District to a Business District: All that part of the East 433 feet of the Southwest Quarter of the Southwest Quarter of Section 12, Township 116, Range 23, Carver County, Minnesota, lying Southerly of the North 864.98 feet thereof, excepting therefrom the South 295 feet thereof. The following voted in favor thereof: Mayor Coulter, Councilmen Hill, Bennyhoff, Klingelhutz, and Pearson. No negative votes._ Motion carried. A motion was made by.Councilman Bennyhoff and seconded by Councilman Pearson to rezone the following described tract of land from a Farm Residence District to a Business District: All that part of the East 990 feet of the Southwest Quarter of the Southwest Quarter of Section 12, Township 116, Range 23, Carver County, Minnesota, lying Southerly of the North 864.98 feet thereof, excepting therefrom the East 433 feet thereof. The following voted in favor thereof: Mayor Coulter, Councilmen.Hill, Bennyhoff, Klingelhutz, and Pearson. No negative votes._ Motion carried. A motion was made by Councilman Bennyhoff and seconded by Councilman Pearson to rezone the following described tract of land from a Farm Residence District to a Business District: The South 295 feet of the East 433 feet of the Southwest Quarter of the Southwest Quarter of Section 12, Township 116, Range 23, Carver County, Minnesota. The following voted in favor thereof: Mayor Coulter, Councilmen Hill, Bennyhoff, Klingelhutz, and Pearson. No negative votes. Motion carried. 68 =1B STORM SEWER: A motion was made by Councilman Hill and seconded by Councilman Pearson to authorize the Village Engineer to prepare detailed plans and specifications for the storm sewer project titled 68 -1B. The following voted in favor thereof: Councilmen Hill, Pearson, Klingelhutz, and Bennyhoff. Mayor Coulter abstained as he is a property owner in this area. Motion carried.
