1969 08 04CHANHASSEN VILLAGE COUNCIL MEETING AUGUST 4, 1969
The Special Chanhassen Village Council Meeting on August 4, 1969, at
8:00 p.m. was opened with the Pledge to the Flag. The following members
were present: Mayor Coulter, Councilmen Bennyhoff, Hill, Klingelhutz,
and Pearson.
MINUTES: A moti= was made by Councilman Hill and seconded by Councilman
Klingelhutz to approve the Council minutes of July 14, 21, and 28.
The following voted in favor thereof: Mayor Coulter, Councilmen Hill,
Bennyhoff, Pearson, and Klingelhutz. No negative votes. Motion carried.
A motion was made by Councilman Pearson and seconded by Councilman Hill
that the Park and Recreation Commission minutes of July 22 were read
and noted. The following voted in favor thereof: Mayor Coulter,
Councilmen Hill, Pearson, Klingelhutz, and Bennyhoff. No negative
votes. Motion carried.
A motion was made by Councilman Hill and seconded by Councilman Klingelhutz
that the Planning Commission minutes of July 29 were read and noted.
The following voted in favor thereof: Mayor Coulter, Councilmen Hill,
Pearson, Bennyhoff, and Klingelhutz. No negative votes. Motion carried.
WESTERN HILLS ESCROW ACCOUNT: Attorney Larson presented bills for the
Council to approve so that Hansen and Klingelhutz can draw on the escrow
account. The bills submitted have been approved by the Village Engineer
and Attorney.
A motion was made by Councilman Bennyhoff and seconded by Mayor Coulter
to approve a reduction of $17,600 in storm sewer escrow, plus $7,740
which is the total of $5,100 on engineering on the Village required
improvements and $3,500 for labor and materials on streets, less 10%
until completion of project as per development contract. The total
amount to be released at this time is $25,340. The following voted
in favor thereof: Mayor Coulter, Councilmen Hill, Bennyhoff, Pearson,
and Klingelhutz.. No negative votes. Motion carried.
Councilman Hill would like the minutes to reflect that the.Council
would like a more definite bill on what is to be paid, not just a verbal
report.
Bills should be submitted to the Village Engineer by the first of each
month so they can be approved at the regular Council meeting.
SUBDIVISION OF PROPERTY (ARTHUR LARSON): The Village Attorney read his
letter of recommendation dated August 1, 1969, also Planning Commission
recommendations in minutes of July 29. He also stated a public hearing
is not needed for this division of property.
A motion was made by Councilman Pearson and seconded by Councilman
Klingelhutz to authorize the Village Attorney to proceed to obtain
necessary easements. After easements are obtained the matter will
receive further consideration by the Council. The following voted
in favor thereof: Mayor Coulter, Councilmen Hill, Bennyhoff, Pearson,
and Klingelhutz. No negative votes. Motion carried.
Costs of surveying and legal fees for street to be paid by benefitted
property owners.

NURSERY (HIGHWAY #41): This property is zoned Farm Residence District.
Commercial greenhouses and nurseries are permitted in this District.
The Village Attorney stated he found nothing that would take this -
nursery out of a Farm Residence use, of the land..
TRAILER HOUSE - PATZWALD: The Village Attorney stated no further .
action has been taken at this time.
FRANK BEDDOR: This has gone to Municipal Court. The Administrator is
to check on this.
STATE AID PROJECT: A motion was made by Councilman Hill and seconded
by Councilman Klingelhutz to transfer $209.59 to the General Fund.
The following voted in favor thereof: Mayor Coulter, Councilmen Hill,
Pearson, Klingelhutz, and Bennyhoff. No negative votes. Motion carried.
SOUTHWEST SANITARY SEWER DISTRICT: Mayor Coulter stated that the
Southwest Sanitary Sewer District has recommended- that the Village
purchase Lake View Hills Sewer Plant for the sum of $1.00 and turn
over to the Sewer District. -
EXTERIOR METERS: 'the Council would like to try these meters to see how
they would withstand the-winter.
PRIVATE WELL ORDINANCE: The Village Attorney was instructed to draw
up a private well ordinance.
