1969 09 15CHANHASSEN VILLAGE COUNCIL MEETING SEPTEMBER 15, 1969 The Chanhassen Village Council Meeting on September 15, 1969, at 8:00 p.m. was opened with the Pledge to the Flog. The following members were present: Mayor Coulter, Councilmen Bennyhoff, Pearson, Klingelhutz, and Hill. MINUTES On the minutes dated - August 26, 1969, the date should reflect that the correct date was August 25, 1969. A motion was made by Councilman Klingelhutz and seconded by Councilman Pearson to approve the August 25, 1969, minutes as amended. The following voted in-favor thereof: Mayor Coulter, Councilmen Bennyhoff, Pearson, Klingelhutz, and Hill. No negative votes. Motion carried. A motion was made by Councilman Pearson and seconded by Councilman. Hill that the August 26, 1969, Planning Commission minutes were read and noted. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Pearson, and Hill. No negative votes. Motion carried. A motion was made by Councilman Hill and seconded'by Councilman Klingelhutz that the Park and Recreation minutes of August 22, September 2, and September 9, 1969, were read and noted. The following voted in favor thereof:. Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Pearson, and Hill. No negative votes. Motion carried. STREET - NAMES A motion was made by Mayor Coulter and seconded by Councilman Hill that the Planning Commission hold a public hearing on the proposed street naming map prior to submitting it to the council for final approval. The following voted in favor.thereof: Mayor Coulter, Councilman Bennyhoff,.Klingelhutz, Pearson, and Hill. No negative votes. Motion 68 -3 SANITARY_ SEWER A motion was made by Councilman Hill and seconded by Councilman Bennyhoff to accept the low bid of Midwest Mechanical Services in the amount of $36,119.15 using the alternate plastic pipe; completion date December 3, 1969. All will be subject to easements being signed. The following voted in favor thereof: Mayor Coulter, Councilmen'Bennyhoff, Hill, Pearson. Councilman Klingelhutz voted no. December 31, 1969 As Required November 20, 1969 December 1, 1969 December 15, 1969 A motion was made by Mayor Coulter and seconded by Councilman Klingelhutz to accept the low bid from the firm of Fox & Weiler, Inc., in the amount of $58,997.54;completion date December 15, 1969. The contractor being allowed . to start work immediately and the Village Attorney be author- ized to proceed to acquire final easements. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Pearson, and Hill. No negative votes. Motion carried. VICTORIA SALES TAX SUIT A motion was made by Councilman Klingelhutz and seconded by Councilman Bennyhoff to adopt the following resolution: VILLAGE OF CHANHASSEN CARVER AND HENNEPIN COUNTIES, MINNESOTA RESOLUTION 1 1 WHEREAS, The 1969 regular session of the Legislature of the State of Minnesota enacted Chapter 1116, being an act relating to the apportion- ment of certain taxes collected by the State to the City of Chaska and the Villages of Chanhassen and Victoria, and WHEREAS, said Act provides for the determination of population of the respective municipalities through agreement between said municipalities for the purpose of tax apportionment based on population by the State until the completion and filing of the 1970 Federal decennial census, and WHEREAS, said Act takes effect upon approval of the governing bodies of said municipalities and upon compliance with Minnesota'Statutes, Section 645:021. NOW, THEREFORE, BE IT RESOLVED, That the Council of the Village of Chanhassen hereby approved Chapter 1116, Laws of 1969, and for the purpose of tax apportionment based on population by the State determines that population of the Village of Chanhassen for the years 1968 and 1969, and until the completion and filing of the 1970 Federal decennial census, to be 4,112 persons. BE IT FURTHER RESOLVED, That the Council of the Village of Chanhassen agrees that the population of the City of Chaska for said period is 3779 persons and that the population of the Village of Victoria for said period is 684 persons. FIRE DEPARTMENT A motion was made by Councilman Pearson and seconded by Councilman Bennyhoff that the question_of a $50,000.00 bond issue be placed on the November 4 election ballot for funds for.the Fire Department to acquire and equip a pumper and a.tanker. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Pearson, and Hill. No negative votes. Motion carried. BILLS A motion was made by Mayor Coulter and seconded by Councilman Klingelhutz to approve all bills with the exception of the bill from the Village Attorney for work done for the Southwest Sanitary Sewer District. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Pearson, and Hill. No negative votes. Motion carried. The minutes should reflect that the statement fram the Village Attorney for legal work done in the amount of $120.00 should be billed to the Southwest Sanitary Sewer District. WARRENTS Councilman Pearson moved the adoption of the following resolution: Be it resolved that the following bills be paid by warrents: 1968 -3 - Sun Newspaper in the amount of $25.20 Check # 581 1968 -3 - Schoell & Madson in the amount of $1408.65 Check # 582 1967 -5 - First National Bank of St. Paul in the amount of $211.96 Check # 559 1968 -2 - Schoell & Madson in the amount of $136.90 Check # 583 1968 -2 - Berglund & Johnson in the amount of $5840.00 Check # 585 1968 -2 - Keys Well Drilling in the amount of $2194.70 Check # 586 1968- 1B.-- Schoell & Madson_in the amount Check # 587 Gen. MAINTENANCE A motion was made by Councilman Bennyhoff and seconded by Councilman Klingelhutz that the Maintenance Department be allowed to spend ,$5,000.00 over thier budget. The following voted in favor thereof: Mayor Coulter, Councilmen Klingelhutz, Hill, Pearson, and Bennyhoff. 'No negative votes. Motion carried. PARK AND RECREATION DEPARTMENT A motion was made by Councilman Pearson and seconded by Councilman Hill that Park and Recreation be given a $100.00 advancement to attend a seminar in Chicago. The following voted in favor thereof: Mayor Coulter, Councilmen Klingelhutz, Hill, Pearson, and Bennyhoff. No negative votes. Motion carried. ADMINISTRATIVE POLICY Councilmam.F3ill requested that a committee meeting beheld of all councilmen to discuss the overall Administrative Policy and duties of the Administrator. Attorney Larson was :appointed to chair the meeting. WESTERN HILLS A motion was made by Councilman Bennyhoff and seconded by Councilman Pearson to approve the bills submitted in the amount of $22,386.24 to be withdrawn from the escrow account in the Hutchinson Federal Savings and Loan Association. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Hill, and Pearson. No negative votes. Motion carried. BOND ISSUE ADVERTISING The Village Attorney explained what is legal for the village to pay for in regards to advertising or presenting information on a proposed bond issue. MINNEWASHTA HILLS A motion was made by Councilman Pearson and seconded by'Councilman Hill to approve the prelimenary plat.ona following three lots: 1 and 2, block 2 and lot block 1, only one house, -will be allowed until an approved street has been constructed adjacent to these lots. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Hill, Pearson. Councilman Klingelhutz voted no. Motion carried. A motion was made by Councilman Pearson and seconded by Councilman Hill to re-zone the Minnewashta Hills from a farm residential district to a resident district "A ". The following voted in favor thereof: Mayor Coulter, Councilmen Klingelhutz, Pearson, Hill, and Bennyhoff. No negative votes. Motion carried. HANUS BUILDING A motion was made by.Councilman Bennyhoff and seconded by Pearson that a variance be granted to allow the building to be built three feet from the north property line under the condition that an eight foot high basket weave fence be constructed across the entire north property line that is not faced with the building. Also the basket weave fence will continue south on both sides to a point where it can be adjoined to the existing building. The fence must be complete by July 1, 1970. The following voted in favor thereof: Mayor Coulter, Councilmen Klingelhutz Pearson, Hill, and Bennyhoff. No negative votes. Motion carried. The building permit will show fence details. .CHANHASSEN VILLAGE COUNCIL MEETING SEPTEMBER 15, 1969 -5- 1 PERSONNEL A motion was made by Councilman Pearson and seconded by Councilman Klingelhutz to hire Susan Jones at the rate of $350.00 per month and at the end of two months a salary will be reappraised. The following voted in favor thereof: Mayor Coulter, Councilmen Klingelhutz, Hill, Pearson, and Bennyhoff. No'negative votes. Motion carried. STORM SEWER_POLICY The Village Attorney explained the various types of storm sewer policies that other municipalities have. The Village Attorney was to draw up a storm sewer policy and present it to the village council for final approval. FIRE'DEPARTMENT; motion was made by Councilman Pearson and seconded by Councilman Bennyhoff that the Fire Department be allowed a per.diem allowance to attend conventions, fire schools, regional fire association meetings, etc., on a $25.00 "a day per diem allowance. The following voted in favor.- thereof: Mayor Coulter, Councilmen Klingelhutz, Hill, Pearson, and Bennyhoff. No negative votes. Motion carried.
