1969 09 22CHANHASSEN VILLAGE'COUNCIL MEETING SEPTEMBER 22, 1969 The Chanhassen Village Council Meeting on September 22, 1969, at 8:00 p.m. was opened with the Pledge to the Flag. The following members were present: Mayor Coulter, Councilmen Bennyhoff, Pearson, Klingelhutz, and Hill. MINUTES A motion was made by Councilman Hill and seconded by Councilman Klingelhutz to approve the Council Minutes of September 15, 1969. The following voted in.favor thereof: May6k Coulter, Councilmen Bennyhoff, Pearson, Klingelhutz, and Hill. No negative votes. Motion carried. A motion was made by Councilman Hill and seconded by Councilman Klingelhutz that the Planning Commisson minutes of September 16, 1969, were read and noted. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Pearson, Klingelhutz, and Hill. No negative votes. Motion carried. A motion was made by Councilman Hill and seconded by Councilman Pearson that the Park and Recreation minutes of September 16, 1969, were read and noted. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Pearson, Klingelhutz, and Hill. No negative votes. Motion carried. PARK AND RECREATION COMMISSION Steve Wolf, a member of the Park and Recreation Commission explained to the Council, what the infor- mation brochure would include. A motion was made by Councilman Pearson and seconded by Councilman Klingelhutz to adopt the following resolution: October 1,.196 - Citizens of Chanhassen The members of the Park and Recreation Commission were presented a comprehensive plan for park development in Chanhassen, and prepared this brochure to explain the plan and how it can be achieved. The Village Council has set November 4, 1969, as the date for the bond election to decide the future of the plan for parks. We urge you to study and consider the plan and the financing proposal as a basis for exercising your responsibility in shaping the future of the Village of Chanhassen. The.following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Pearson, and Hill. No negative votes. Motion carried. HANUS BUILDING The Village Attorney was instructed to draw up a recordable agreement for the requested variance on the Hanus Building. HUMAN RIGHTS The State Human Rights representative was not available as requested to explain to the Village Council the mescellaneous items that pertain to the proposed ofdinance. Mrs. Morrison Buell was present, urging the Council to adopt the proposed ordinance. A motion was made by Councilman Pearson and seconded by Councilman Klingelhutz to approve the preliminary draft of the Human Rights Ordinance. Council Minutes, September 22, 1969 Submit this draft to the Village Attorney for final draft. The. final draft to be submitted at the October 20, 1969, meeting for final approval. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Pearson, and Hill. No negative votes. Motion carried. GUIDE PLAN Robert Scholer, Chairman of the Planning Commission, presented the final draft of the generalized guide plan and ex- plained the minor changes that had been made since the first guide plan had been presented to the Council. Mr. Scholer re- quested that the Village Council hold a public hearing on this guide plan so that it could be adopted as the official guide plan for the Village of Chanhassen. A motion was made by Council- man Bennyhoff and seconded by Councilman Pearson to hold a public hearing and the generalized guide plan, October 13, 1969, at 7 :00 p.m. at the Village Hall. The following voted in favor there- of: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Pearson, and Hill. No negative votes. Motion carried. PLANNING COMMISSION A motion was made by Councilman Klingelhutz and seconded by Councilman Hill-to authorize the Mayor and the Clerk- Administrator to sign the agreement with Nason, Wehrman, Knight, and Chapman, Inc. for a transportation study, after the Village Attorney has approved the legality of the agreement. The following voted in favor thereof: Mayor Coulter; Councilman Bennyhoff, Klingelhutz, Pearson, and Hill. No negative votes. Motion carried. A motion was made by Councilman Bennyhoff and seconded by Councilman Pearson that a date be set for a public hearing to rezone Section 35 and 36 back to Resident District "A ", except the areas that have other specific uses at this time. The following voted in favor thereof: Councilman Bennyhoff and Councilman Pearson. Councilman Hill, Councilman Klingelhutz, and Mayor Coulter voted no. Motion did not carry. STREET NAMING AND NUMBERING A motion was made by Councilman Klingelhutz and seconded by Councilman Bennyhoff to hold a public informatonal meeting on September 29, 1969, at 7:00 p.m. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Pearson, and Hill. No negative votes. Motion carried. The Village Council stated to the Planning Commission that it did endorse the proposed final draft of the street naming and numbering map. Final approval will be given after the public informational meeting has been held. LAKE VIEW HILLS A motion was made by Councilman Bennyhoff and seconded by Councilman Pearson to grant a permit to construct a 34 -unit apartment at Lake View Hills. The following voted in favor thereof: Councilman Bennyhoff and Councilman Pearson. Mayor Coulter, Councilmen Klingelhutz, and Hill voted no. Motion not carried. A letter from the Village Engineer stated the capacity of the sewer plant is being requested to be available prior to the next meeting. The owners of Lake View Hills were instructed that this would be on the agenda next week. CHANHASSEN VILLAGE COUNCIL MEETING SEPTEMBER 22, 1969 -3- SOUTHWEST SANITARY - SEWER . DISTRICT: A motion was made by Councilman Pearson and seconded by Councilman Hill that the Mayor and the Village'Clerk Administrator be authorized to.sign Resolution # 92269, a resolution accepting the Village of Greenwood as a party to ajoin power agreements, dated 29 March, 1968. The following voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Pearson, and Hill. No negative votes. Motion carried. ST. ANDREWS STREET: A motion was made by Councilman Klingelhutz and seconded by Councilman Hill to approve St. Andrews Street as an accepted village street. The fo- llowing voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Pearson, and Hill. No negative votes. Motion carried. MAINTENANCE DEPARTMENT A motion was made by Councilman Pearson and seconded by Councilman Bennyhoff that Sylvester Chastek be approved as a permanent employee; salary as of October 1, 1969, $500.00 per month. The following voted in favor thereof: Mayor Coulter, Councilman Bennyhoff, Klingelhutz, Pearson, and Hill. No negative votes. Motion carried. 68 -1B - STORM SEWER Councilman Pearson moved the, : - -adoption of the following.resolution: -BE IT RESOLVED that a permanent easement for the Storm Sewer across the Forcier Land be acquired for the sum of $670.00 and to be authorized for payment by a warrent. Check # 594. With the cost to be charged against the pending Storm Sewer Project 1968 -1B. RESOLUTION seconded by Councilman Hill. The following voted in favor thereof: Mayor Coulter, Councilmen Klingelhutz- ,.Pearson and Hill. Councilman Bennyhoff voted no. Motion carried. - _ UTILITY_DEPARTMENT :. A motion was made by Councilman Bennyhoff and seconded by -Mayor Coulter that a 20% administrative charge be paid by the Utility Department to General Fund on all billings to be paid at the first of each quarter. The following voted in favor thereof Mayor Coulter, Councilmen Bennyhoff, Klingelhutz,- Pearson, and Hill. No negative votes. Motion carried.
