The Special Chanhassen Village Council Meeting on October 13, 1969, at
Q;QQ p.m. was opened with the Pledge to the Flag. The following
nieinbers were present: Mayor Coulter, Councilmen Bennyhoff, Pearson,
and Hill. Councilman Klingelhutz was absent.
MINUTES A motion was made by Councilman-Hill and seconded by
Councilman Bennyhoff to approve the Council minutes of September
29, 1969, with one notation that Councilman.Pearson was absent. The
following voted_in favor thereof: Mayor Coulter, Councilmen Bennyhoff,
Pearson, and.Hill.. No negative votes. Motion carried.
Councilman Klingelhutz arrived at the meeting at 8:15 p.m.
A motion was made by Councilman Bennyhoff and seconded by Councilman
Hill that the Park and Recreation Commission minutes of September
23, 29, and 7, 1969, were read and noted. The following
voted in favor.thereof: Mayor Coulter, Councilmen Klingelhutz,
Bennyhoff, Pearson, and Hill. No negative votes. Motion carried.
POLICE A motion was made by Councilman Bennyhoff and seconded by
Councilman.Pearson that Resolution # 1013695 forwarded to all
County Commissioners. The following voted in favor thereof: Mayor
Coulter, Councilmen Bennyhoff, Klingelhutz, Pearson, and Hill. No
negative votes. Motion carried. Resolution # 1013695 pertains to
the police protection for Chanhassen, stating that the Village Council
feels that this is a total County function and County costs should
be on a County wide basis.. The Resolution further states that an
eight (8).Mill. charge be made.for all communities who desire a con-
tract with a County would -be a fa ,tv and equitable fee.

TAX STUDY GROUP :. - A,motion was made by Mayor Coulter and seconded by
Councilman Bennyhoff that a tax study group be appointed consisting
of nine (9) people with instructions to- report back to the Council by
July.I, 1970. The following voted -in favor thereof::. Mayor-Coulter,
Councilmen Bennyhoff; Pearson, and-Hill.. No negative votes.
Motion carried.
ELECTION A motion was made by Councilman Klingelhutz,.and seconded
by Councilman Bennyhoff to approve the following Judges and Counters

A motion was made by Councilman Hill and seconded by Councilman
Klingelhutz that all election judges and counters be paid $1.50
per hour. The following voted in favor thereof: Mayor Coulter,
Councilmen Klingelhutz, Bennyhoff, Pearson, and Hill. No negative
votes. Motion carried.
PARK AND RECREATION: A motion was made by Councilman Bennyhoff and
seconded by Councilman Klingelhutz to pay Dan Kerber $18.00 for mowing
on Lots 1, 21., 22, Block 2, Minnewashta Heights. The following voted
in favor thereof: - Mayor Coulter, Councilmen Klingelhutz, Bennyhoff,
Pearson, and .Hill. No negative votes. Motion carried.

ORDINANCE: -# 9: A motion was made by Councilman Hill and seconded by
Councilman Klingelhutz that Section 4, Subdivision 1, of Ordinance # 9
be changed to read that from age 14 -16 may discharge fire arms
if they have completed and received a- certificate from the Junior Fire
Arms Training. The following voted in favor thereof: Mayor Coulter,
Councilmen Bennyhoff, Klingelhutz, Pearson, and Hill. No negative votes.
Motion carried.
ELECTIONS A. was made by Councilman Hill and seconded by
Councilman.:Bennyhoff -to authorize the Village Attorney to draft an
4 rdinance to be to the Council setting - -up Village elections
$7i- annually. The following voted in favor thereoti: Mayor Coulter,
Councilmen Bennyhoff, Klingelhutz, Pearson, and Hill. No negat - ive
votes. Motion carried.

PARK AND RECREATION A decision on the signing of an option
for the Mat Welter Estate was discussed with the Committee
to report back at the next meeting. The Mayor appointed
Councilman Klingelhutz as Chairman of this Committee.
LAWCON APPLICATION: A motion was made by Councilman Klingelhutz
and seconded-by Councilman Bennyhoff to approve Resolution #
1013691, Assurance of Compliance. The following voted in favor
thereof: Mayor Coulter.; Councilmen Bennyhoff, Klingelhutz,
Pearson, and Hill. No negative votes. Motion carried.
A motion was made by Councilman Klingelhutz and seconded by
Councilman Bennyhoff approving Resolution # 1013692, authorizing
the Village Administrator to sign "Assurance of Compliance ",
(D.I. Form 1315) in connection with land and water connection
application. The following voted in favor.thereof: Mayor
Coulter, Councilmen Bennyhoff, Klingelhutz, Pearson, and Hill.
No negative votes. Motion carried.
A motion was made by Councilman Bennyhoff and seconded by Councilman
Pearson approving Resolution # 1013693, a policy statement
regarding power and utility construction. The following voted in
favor thereof: Mayor Coulter, Councilmen Klingelhutz, Bennyhoff,
Pearson, and Hill. No negative votes. Motion carried.

man Klingelhutz approving Resolution # 1013694, authorizing the
Village Administrator to sign policy statement, regarding power
' and utility construction in- connection with land and.water connection
application—The following_voted.in favor thereof: Mayor Coulter, .
Councilmen Bennyhoff,- Klingelhutz, Pearson, and Hill. No negative
votes. Motion carried.
SSSD A motion was made by Councilman Pearson and seconded by
Councilman-Hill approving Resolution �# 1013696, Southwest Sanitary
Sewer:District Board Resolution and levying a.tax in the amount
required for the 1970 district budget be approved. The following
voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff,
Klingelhutz, Pearson, and Hill. No negative votes. Motion carried.
. ASSESSOR : -A motion was made by Councilman Bennyhoff and seconded
by Councilman. Pearson authorizing the Village Attorney to request
an Attorney General's opinion on the Village of Chanhassen contracting
with Carver County for assessing. The following voted in favor
thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Pearson,
and Hill._ No negative votes. Motion carried.
69 =2. SEWER AND WATER'EXTENEION A motion was made by Councilman
Bennyhoff and seconded by Councilman Klingelhutz to approve the plans
and specifications authorizing the advertising for bide to be
opening on October 27, 1969 at 2:00 p.m. The following voted in
favor thereof: Mayor Coulter, Councilmen Klingelhutz, Bennyhoff,
Pearson, and Hill. No negative votes. Motion carried.

DELINQUENT SEWER SERVICE CHARGES A motion was made by Councilman
Klingelhutz and seconded by Councilman Bennyhoff that all
delinquent sewer service charges be certified to the County
Auditor to be levied against the premises served as per Ordinance
# 5, Section 5.04. The following voted in favor thereof:
Mayor Coulter, Councilmen Klingelhutz, Bennyhoff, Pearson, and
Hill. No negative votes. Motion carried.
WATER LATERALS A motion was made by Councilman Pearson and
seconded by Councilman Klingelhutz that.$120.00 per lot be
certified to 'the County Auditor for the installation of water
laterals on Lots 5, 6, and 7, Block 3, Scholer's Second Addition.
The following voted in favor thereof: Mayor Coulter, Councilmen
Klingelhutz, Bennyhoff, Pearson, and Hill. No negative votes.
Motion carried.
UNIT CHARGES A motion was made by Councilman Pearson and seconded
by Councilman Bennyhoff to certify the sewer unit charge in the
amount of $3,750.00, and.the water unit charge in the amount of
$3,750.00 to the County Auditor to be levied against property
described as the following: The North 500 Feet of the East 220
feet of the NW4 of the.NW4 of Section 11, Township 116, Range
23,.Garver County: (The. Village Bath Products Building) This is
to bed assessed on a five (5) year term at the rate of 6% annum.
The following voted in favor thereof: Mayor Coulter, Councilmen
Bennyhoff, Klingelhutz, Pearson, and Hill. No negative votes.
Motion carried.
A motion was made by Councilman.P.earson and seconded by Councilman
Bennyhoff to certify the sewer unit charge in the amount of $5,000.00
and the water unit charge in the amount of $5,000.00 to the County
Auditor to be levied against property described as the following:
The part of the NE4 of the NW4 of Section 13, Township 116, Range
23, Carver County. (The Chanhassen Dinner Theater Building) This
is to be assessed on a five (5), year term:. .at the rate of 6% annum.
The following voted in favor thereof: Mayor Coulter, Councilmen
Bennyhoff, Klingelhutz, Pearson and Hill. No negative votes.
Motion carried.
BONDS A motion was made by Councilman Bennyhoff and seconded by
Councilman Klingelhutz approving Resolution # 1013697, determining
necessity of'issuing bonds and providing for an election thereon.
The following voted in favor thereof: Mayor Coulter, Councilmen
Bennyhoff, Klingelhutz, Pearson, and Hill. No negative votes.
Motion carried..
PARK AND RECREATION The Village Administrator is to have a break
down of costs for installation of water line to serve the proposed
Hockey Rink west of the Village Hall.
RIDING ARENA Administrator to report to the Council at the next
meeting concerning the Riding Arena to be constructed on Twin Hills
Farm.
A motion was made by Councilman Bennyhoff and seconded by Councilman
Pearson to adjourn. Meeting adjourned:
