1969 10 27CHANHASSEN VILLAGE COUNCIL MEETING - October 27, 1969
The Chanhassen Village Council meeting on October 27, 1969, at
8:00 p.m. was opened with the Pledge to the Flag. The following
members were present: Mayor Coulter, Councilmen Klingelhutz,
Bennyhoff, Pearson, and Hill.
MINUTES A motion was made by Councilman Pearson and seconded by
Councilman Klingelhutz to approve the Council Minutes of October
20, 1969. The following voted in favor thereof: Mayor Coulter,
Councilmen Klingelhutz, Bennyhoff, Pearson, and Hill. No negative
votes. Motion carried.
A motion was made by Councilman Pearson and seconded by Councilman
Klingelhutz that the Park and Recreation minutes of October 7,
14, and 21, 1969 were read and noted. The following voted in
favor thereof: Mayor Coulter, Councilmen Klingelhutz, Bennyhoff,
Pearson, and Hill. No negative votes. Motion carried.
A motion was made by Councilman Klingelhutz and seconded by
Councilman Pearson that the Planning Commission minutes of
October 14, 1969 were read and noted. The following voted in
favor thereof: Mayor Coulter, Councilmen Klingelhutz, Bennyhoff,
Pearson, and Hill. No negative votes. Motion carried.
69 -2 SEWER AND WATER EXTENSION A motion was made by Councilman
Bennyhoff and seconded by Councilman Pearson to accept the low
bid from Midwest Mechanical Services, Inc., using the alternate
pipe materials.. The total amount $7,769.40. Acceptance subject
to typographical errors approved by contractor. If not approved
by the contractor within 5 days, the next low bidder, Widmer
Brothers, in the amount of $7,937.10 will be awarded the bid. The
following voted in favor thereof: Councilmen Bennyhoff, Klingelhutz,
Pearson, and Hill. No negative votes. Motion carried. The
minutes .should reflect that Mayor Coulter did not vote-because
he felt it may be a conflict of interest as the low bidder purchases
material from his company.
PELLER A.letter was read by the Administrator from Mr. Peller
requesting the Village to condemn a one (1) foot strip of property
so that he may have access to a Village Street both for sewer and
water; also access to the road. The Village Attorney explained
what had been done to date both.as a proposal made by Mr. Scholer
and that - this- letter was the first reaction since the Village
Attorney has met with Mr. Peller and explained Mr. Scholer's
proposal. The Village Attorney stated that he did not recommend
condemnation at this time. A motion was made by Councilman Pearson
and seconded-by Councilman Hill that the Village does not proceed
with condemnation as requested -in Mr. Peller's letter, dated
October 21, 1969. The following voted in favor thereof: Mayor
Coulter, Councilmen Klingelhutz, Bennyhoff, Pearson, and Hill.
No negative votes. Motion carried. The Village Attorney will
notify Mr. Peller of this action.
Council Minutes - October 27, 1969
HANSEN &_KLINGELHUTZ SEWER & WATER EXTENSION REQUEST The
Village Engineer ,explained -bri &.fly what this request would
entail. A motion was made by Councilman Hill and seconded
by Councilman Pearson that this matter be tabled until the
next meeting, at which time Mr. Scholer can explain which.
way that his property can be served. Also, the Village
Engineer can present his recommendations and his estimated
cost. The following voted in favor thereof: Councilmen
Hill, Bennyhoff, and Pearson. Councilman Klingelhutz voted
no. Motion carried.
CHASKA REZONING The proposed rezoning of land adjacent to
Chanhassen that are being proposed for rezoning to be used
as a mobile home park was discussed at length. A motion was
made Councilman Hill and seconded by Councilman Bennyhoff
that the Village of Chanhassen oppose this rezoning authorizing
the Village Attorney to attend the hearings voicing the
Villages objection to this rezoning. The following voted in
favor thereof, Mayor Coulter, Councilmen Bennyhoff, Klingelhutz,
Pearson, and Hill. No negative votes. Motion carried.
ELECTION CANVASS The Village will hold the election canvass
meeting at 5:OO p.m. on November 6, 1969.
CARVER BEACH PROPERTY The .Village Attorney reported the status
of this property at this time. A_.moti do was made. _by' Councilman
Klingelhutz and seconded by Councilman Pearson to table any action
on this until further study. The following voted in favor
thereof: Mayor Coulter, Councilmen Klingelhutz, Bennyhoff,
Pearson, and Hill. No negative votes.Motion carried.
GAS BIDS A motion was made by Councilman Pearson and seconded
by Councilman Klingelhutz that the Administrator be authorized
to advertise for gas and diesel fuel bids to open them 2:00 p.m.
on December 1, 1969. The following voted in favor thereof:
Mayor Coulter, Councilmen Klingelhutz, Bennyhoff, Pearson, and
Hill. No negative votes. Motion carried.
FIRE DEPARTMENT Councilman Hill moved the adoption of the following
RESOLUTION: BE IT RESOLVED that the following bill be paid by
a warrent.
Alphonse Herman in the amount of $750.00 Check # 695
(Fire -- Compressor)
Resolution seconded by Councilman Bennyhoff. The following voted
in favor thereof. Mayor Coulter, Councilman Klingelhutz, Pearson,
Hill, and Bennyhoff. No negative votes. Motion carried.

SSSD A motion was made by Councilman Pearson and seconded
by Councilman Klingelhutz that Resolution # 2710691 approving
the letting of a contract from the construction of sewer
interceptors by SSSD Board be approved. The following voted
in favor thereof: Mayor Coulter, Councilmen Bennyhoff,
Klingelhutz_, Pearson, and Hill. No negative votes. Motion
carried. A motion was made by Councilman Hill and seconded
by Councilman Bennyhoff that Resolution # 2710692 accepting
the low bid for the river crossing siphon and approving of
the letting of the contract by the SSSD Board. The following
voted in favor thereof: MayoriCoulter, Councilmen Klingelhutz,
Bennyhoff, Pearson, and Hill...- No negative votes. Motion carried.
AUCTION A motion was made by Councilman Hill and seconded
by Councilman Pearson that the Village Attorney be authorized
to draw an agreement listing the items agreed upon in the
October 20, 1969 meeting. Upon receiving a check for all fees,
certificate of--insurance in the amount of $5000.00', and
a.cash bond-in the amount of $2,000.00, the Clerk is authorized
to sign said agreement. The following voted in favor thereof:
Mayor Coulter, Councilmen Klingelhutz, Pearson, Bennyhoff,
and Hill. No negative votes. Motion carried.
FEDERAL APPLICATION A motion was made by Councilman Hill
and seconded 'Councilman Bennyhoff that the Administrator
be.authorized to go to Chicago to meet with Hud to see what
could be done to have this application approved. The following
voted in-favor thereof: Mayor Coulter, Councilmen Klingelhutz,
Bennyhoff,..Pearson, and Hill. No negative votes. Motion carried.
IDA JOHNSON The Village Administrator read a letter written
by Mrs. Johnson-concerning her fence. The Mayor stated that the
Council should inspect the -site 'and discuss it at the
meeting.
A motion was made by Councilman Pearson and seconded by
Councilman Hill to adjourn. Meeting adjourned.
