The Chanhassen Village Council met on December 1, 1969, for the
purpose of conducting a public hearing on the proposed building
permit ordinance. The following members were present: Mayor
Coulter, Councilman Klingelhutz, Bennyhoff, and Hill. Councilman
Pearson was absent: The meeting began at 2 ;30 p.m.
The following residents were present: Mr. and Mrs. Vernon
Beckman and Anne Neils.
The Administrator read the official publication of notification
of this public hearing. The proposed ordinance was discussed.
No objections were made by anyone present. Public Hearing
adjourned at 8:00 p.m.
CHANHASSEN VILLAGE COUNCIL MEETING - December 1, 1969
The Chanhassen Village Council meeting on December 1, 1969, at
8:00 p.m. was opened with the Pledge to the Flag. The following
members were present: Mayor Coulter, Councilmen Klingelhutz,
Bennyhoff, and Hill. Councilman Pearson was absent.
COUNCIL MINUTES 'A motion was made by Councilman Hill and seconded
by Councilman Bennyhoff to approve the Council minutes of November
17, 1969. The following voted in favor thereof: Mayor Coulter,
Councilmen Bennyhoff, Klingelhutz, and Hill. No negative votes.
Motion carried.
PLANNING COMMISSION MINUTES A motion was made by Councilman
Klingelhutz and seconded by Councilman Bennyhoff that the
November 11, 18, and 25, 1969 Planning Commission minutes be
noted and read. The following voted in favor thereof: Mayor
Coulter, Councilmen Klingelhutz, Bennyhoff, and Hill. No negative
votes. Motion carried.
PARK AND- RECREATION COMMISSION MINUTES A motion was made by
Councilman Klingelhutz and seconded by Councilman Bennyhoff that
the November 18, and 25, 1969 Park and. Commission
minutes be noted and read. The following voted in favor thereof:
Mayor Coulter, Councilmen Klingelhutz, Bennyhoff, and Hill.
No negative votes. Motion carried.
STABLE_ APPLICATION .( FRANCO.LORIS) Mr. Dayton, Mrs. Elwood,
and Mr. Bernie were present as representatives from the Christmas
Lake Association, stating that the reason that they were present
and that one of the main purposes of their.Association was the
environment around Christmas Lake, and that their Association is
concerned with any possible causes of pollution of
Christmas Lake. Mrs. Elwood stated that a Mr. Jim Moore, an
Agricultural Engineer with the University of Minnesota, had:said
that -with cooperation in operating a stable by Mr. Loris with _ .
the community that the pollution problem could be controlled. Mr.
Bernie stated that this was one of the first actions taken by the
Association concerning pollution of Christmas Lake, but that.they
were also aware and concerned with erosion problems on Christmas
Lake. The members present from the Christmas Lake Association

stated.that they would not object to this stable being
granted a permit if an agreement was received concerning the manage-
ment and controlls be agreed upon. The Village Attorney stated
that he had not had time to read the application in detail
and therefore could not give an opinion at this time. A
question was asked of the.Village Attorney if a special use permit
could be granted for more than l year. The answer was yes.
A motion was made by Councilman Bennyhoff and seconded by
Councilman Klingelhutz that the Village Attorney, Mr. Loris,
and the Christmas Lake Association draw up a special use agreement
to be presented to the Council for their final approval within
2 weeks. The following voted in favor thereof: Mayor Coulter,
Councilmen Bennyhoff, Klingelhutz, and Hill. No negative votes.
Motion carried. Mayor Coulter stated that he was in favor of a
special use permit on a 1 year basis. Councilman Klingelhutz
stated that he felt that the special use permit should indicate
that if Mr. Loris complied with the restrictions that extensions
would normally be granted.
BECKMAN GARAGE: Mr. and Mrs. Keefer were present requesting that
the Council reconsider their action taken on November 17, 1969,
at the Council meeting, approving the Beckman request for a
garage permit. Attached to the minutes is a copy of a letter from
Mr. Keefer which was read before the Council at this time. A
motion was made by Councilman Klingelhutz that the Council rescind
its motion in approving the permit application for a 24x24
garage, 34 inches from the property line and approve a 22x26
garage, 4 feet, 10 inches, north of the property line. Motion
died from the lack of a second.

HILLIER_.PERMIT APPLICATION A motion was made by Councilman
klingelhutz and seconded by- Councilman Hill to approve a request
by _Mrs. Hillier for a 30x60 permanent structure farm building
.and a portable hog shed. The following voted in favor thereof:
Mayor Coulter, Eouncilmen Bennyhoff, Klingelhutz, and Hill. No
negative votes. Motion carried. Before permit will be granted,
plans and specifications and normal application must be complied
MINNEWASHTA HILLS A motion was made by Councilman Klingelhutz
and seconded by Councilman Hill granting Mr. Livingston time on
the Agenda. The following.voted in favor thereof: Mayor Coulter,
Councilmen Bennyhoff, Klingelhutz, and Hill. No negative votes.
Motion carried. Mr. Livingston was concerned that the road
being constructed by Mr. Loglin was not being placed in the proper
location. He felt that_the.,survey that Mr. Loglin had was not
accurate. Mr. Livingston was informed that the determinati6n'
of boundaries is a civil matter and must be resolved by the private
parties concerned, and at this time the Village was not involved
or responsible.
TRAFFIC PROBLEM .(Oriole Street) No action was taken at this
time as the Village has not received a recommendation from the
Sheriff's Office.

WELL ORDINANCE The proposed Well Ordinance was discussed. The
Village Engineer will present his.final recommendations at the
December 15, 1969, meeting.
STbDOLA REZONING The minutes,should reflect that the Planning
Commission on their November 25, 1969, meeting tabled any action
on the Stodola rezoning request.
FRONTIER.TRAIL..WATER MAIN EXTENSION A motion was made by
Councilman Hill and.seconded by Councilman Bennyhoff to approve
the change order in.the amount of $1,766.50 for the extension .
of water on Frontier Trail. The following voted in favor thereof:
Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, and Hill. No
negative votes. Motion carried.
SNOWPLOW (WESTERN HILLS FIRST ADDITION): A motion was made by:
Councilman Hill and seconded by Councilman Bennyhoff to approve
the request by.Hansen.and Klingelhutz to plow the snow from the
road in.,Western Hills First Addition as per their request in.
a letter dated November 24, 1969. The following voted in favor
thereof: Mayor Coulter., Councilmen Bennyhoff, Klingelhutz,
and Hill. No negative votes. Motion carried.
CHASKA REZONING A motion was made by Councilman Hill
seconded by Councilman Bennyhoff to approve the following
Resolution:
WHEREAS, the Council of the Village of Chanhassen has been
informed that ;there.is pending before_.the.Planning.Commission
of the City of Chaska an application to rezone certain lands in
the Northwes.t of the Southeast-Quarter and the North
Half of the:Sotthwest Quarter of-Section-16, Township 116,
Range 23, Carver County, from a Single Family Residential District
to a Multiple Dwelling District to accommodate a mobile home court,
and
WHEREAS, said lands are situated on both sides.of Trunk
Highway 41 and lie on the common boundary between the City of Chaska
and -this Village,_and.hence,.the projected land use is of con-
siderable concern to this.Village, and
WHEREAS said lands lie..within Independent School District
No. 112 which serves the City of Chaska and the Village of_Chanhassen.
NOW, THEREFORE, BE IT RESOLVED,,That the Council.of the City
of Chaska be, and hereby is °, urged to deny said rezoning application
for the following reasons:
1. The development of a mobile home.--court on these lands would
create a..potential eyesore at one of the-entrances.to both communities.
2. The said lands lie within close proximity-to the University
of Minnesota Landscape Arboretum,.Haxeltine and Jonathan -and the
development of a mobile home park in the area would detract inccon-
siderable measure from the amenities created by these existing land
uses.
.3. The location of a mobile home park astraddle Trunk Highway
41 would be likely to create a serious traffic problem on said high-
way.

4. The potential concentration of children resulting
from a mobile home park bordering the,Landscape Arboretum.
would seriously increase the risk of damage to the arboretum
from the destruction of plantings.
5. There is substantial risk that mobile homers -- ;courts
do not provide tax revenues in proportion to the demand-they
create for educational services.
TWIN CITY,NAVAL AIR.STATION Mayor Stenvig.is requesting_._
that..the Metropolitan area show a unit effort :against the
Federal._Government. considering the closing of the Twin cities
Naval Air Station. No action taken at this time.
GAS BIDS A motion was made by Councilman Klingelhutz and
seconded by Councilman Bennyhoff to accept the bid from Minnesota
Victoria Oil for regular ' gasoline in the amount of .216 cents
per.gal:lon and #2D diesel fuel in the amount of.132 .cents.per
gallon::for.the contract period to cover.from January 1, 1970,
to December 31, 1970.
PARK AND RECREATION A.motion.was made_by Mayor Coulter and
seconded by Councilman Bennyhoff to approve John North'to
work 16 Saturdays at $25.00 per Saturday, supervising the Winter
Recreation Program at Chanhassen Elementary School. The following
voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff,
Klingelhutz, and Hill. No negative votes. Motion carried.
PLANNING COMMISSION A motion was made.by Councilman Bennyhoff
and seconded by Councilman Klingelhutz to approve the resignation
of A1..Barnacle from the Planning Commission.: The following vited
in favor thereof:. Mayor Coulter, Councilmen Bennyhoff, Klingelhutz,
and Hill.. Mo negative votes . Motion carried.
BUILDING:PERMIT ORDINANCE A motion was made by Councilman Hill and
seconded by Councilman Klingelhutz to_approve Ordinance # 40, "An
Ordinance relating to the location, size, use and arrangement
of buildings, and the issuance of permits therefor,,on lots in the
Village of Chanhassen and for the purpose of promoting the public
health, safety, order, convenience, prosperity and general welfare
of.:.the said.Village ". _The following voted_in favor thereof:,
Mayor Coulter, Councilmen Klingelhutz, Bennyhoff, and Hill. No
negative votes. Motion carried..
PARK AND RECREATION: A motion was made by Councilman Hill and seconded
by Councilman.Klingelhutz to _approve the proposal for installing lights
at-he Hockey Rink in the amount of $1,.444.00 from the Company of
Magnuson and Morse.Electric Company. The following voted in favor
thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, and Hill .
-No negative votes. Motion carried. ;.
CANCELLED CHECK A motion was made by Councilman Klingelhutz and
seconded by Councilman Hill to approve the writing of a duplicate
check.from check # 30.7 in the amount of $8.50. Tla following voted
in favor thereof: Mayor Coulter, Councilmen Klingelhutz, Bennyhoff,
and Hill. No negative votes. Motion carried. A copy of the letter
is on file from Sally deLancy, explainng;in detail how this check hid
been lost.
