The Chanhassen Village Council meeting on December 8, 1969,
at 8:00 p.m. was opened with the Pledge to the Flag. The_
following members were present: Mayor Coulter, Councilmen
Bennyhoff, Klingelhutz, Pearson, and Hill.
COUNCIL MINUTES: A motion was made by Councilman Hill
and seconded by Councilman Klingelhutz to approve the
Council minutes of December 1, 1969. The following voted
in favor thereof: Mayor Coulter, Councilmen Bennyhoff,
Klingelhutz, Pearson, and Hill. No negative votes. Motion
carried.
WESTERN HILLS A motion was made by Councilman Pearson
and seconded by Councilman Hill that Hansen & Klingelhutz,
developers of Western Hills First Addition, submit a written
agreement that the Village will not be responsible for any
damage done with Western Hills First Addition by the snow
plows this winter prior to final acceptance when the street
has been completed. The following voted in favor thereof:
Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Pearson,
and Hill.. No negative votes. Motion carried.
VILLAGE_SEWAGE TREATMENT A report from the Village Engineer
dated December 5, 1969, was read covering the Village sewage
treatment plant explaining capacity that is used at this time
and the estimated amount of residential units it would take
before the sewer plant is at capacity. The Mayor stated that
he had been told by Mr. Frank Lamm and Berry Peterson of the
Metropolitan Council Staff, that there was very little chance
that the Riley Creek interceptor would be built at this time.
A map of the Southwest Sanitary Sewer District dated October,
1968, was reviewed explaining the location and exact cost of
the Riley Creek interceptor and a proposed temporary force
line interceptor along the Chicago, Milwaukee, Saint Paul,
and Pacific Railroad. After a considerable discussion, the
following resolution was moved by Councilman Hill and
by Councilman Bennyhoff:
RESOLUTION CONCERNING TREATMENT FACILITY RESOLUTION # 12869
WHEREAS the Village Council of the Village of Chanhassen is duty -
bound and obligated to protect the health and welfare of the residents
of the Village of Chanhassen, and
WHEREAS the Village Council, in order to protect the said health and
welfare of its citizens and to provide orderly development, has ini-
tiated and implemented the following:
1. Installation of the original sewage collection and treatment
facility in 1958, and expanded it several times, the most recent in
1969;
2. Municipal water supply and distribution system in 1961, and
expansion by drilling of a new 1,000 GPM well in 1969;
3. Community growth guide plan approved by the Metropolitan
Council and adopted by the Village Council 1969;
4'. Community park and open space plan approved by the Metropolitan
Council and adopted by the Village Council in 1969, and the first
bond issue for acquisition of land approved by the voters in 1969;
5. Adopted an orderly street numbering and renaming system in 1969,
tieing into the Minneapolis grid;
and

WHEREAS, the sewage treatment plant serving the Village of
Chanhassen has recently been improved by doubling its capacity
to 140,000 gallons per day, and
WHEREAS, present measured flows to the plant are about 78,000
gallons per day, and
WHEREAS, municipal sewers are laid in streets and can serve.approx-
imately 200 additional family units, both single family and multiple
units, which constructions will substantially use up.all of the
capacity of the expanded sewage treatment plant, and
WHEREAS, development and construction of at least 175 additional
familiy units in multiple residential buildings is imminent, and
WHEREAS, effluent from the Chanhassen treatment plant flows first
into Rice Marsh Lake and thence into Riley Lake, both lying in
Eden Prairie and Chanhassen, and
WHEREAS, Riley Lake has shown - signs of extreme algae pollution
during the past summer, and adjacent residents have supported
chemical treatment to temporarily alleviate the nuisance condition,
and
WHEREAS, orderly planning for present population requires that
"areas to be sewered immediately are those that pose threats to
public health or could pollute natural resources" (ref: Metropolitan
Council Newsletter, Volume II, Number 11, November 1969) and
WHEREAS, "sewer systems should .be extended into communities
only when residents are assured of governmental capability to provide
a full range of urban services and exercise adequate planning and
development control." (ibid)
NOW THEREFORE BE IT RESOLVED, THAT for said Council of the Village
of Chanhassen to provide for the continued protection of the health
and welfare of its residents and the orderly development of its
resources, it is necessary that sewage effluent be removed from the
watershed of Rice Marsh and Riley Lakes at the earliest possible
time by the construction of interceptor sewers leading into the
present Southwest Sanitary Sewer District system, eith along Riley
Creek or along some other alternate route, such as the force line
interceptor on preliminary plan, dated October, 1968.
BE IT FURTHER RESOLVED THAT THE VILLAGE COUNCIL OF THE VILLAGE OF
CHANHASSEN further emphasizes the need for some timely solution to
its sewage disposal problem by the attachment hereto of petitions
and resolutions from other interested municipal and citizen's groups.
The following voted in favor thereof: Mayor Coulter, Councilmen
Bennyhoff, Klingelhutz, Pearson, and Hill. No negative votes. Motion
carried.
PLANNING COMMISSION ORDINANCE Section 13 and 14 of the Planning
Commission Ordinance were discussed as per request from the
Planning Commission to clarify these sections. A motion was made
by Councilman Bennyhoff and seconded by Councilman Pearson that
Dean Scheff of the Planning Commission and one member from the Park
and Recreation Commission and one member of the Industrial Commission
meet with the Administrator to discuss this problem and submit back
to the Council a recommendation. The following voted in favor there-
of: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Pearsonand
Hill. No negative votes. Motion carried.

1 F IRE DEPARTMENT A motion was made by Councilman Bennyhoff and
seconded by Councilman Hill to approve the Board of Trustees
of the Chanhassen Fireman's Relief Association; Inc., to invest
$2,600.00 in saving certificates. The following voted in favor
thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz,'
Pearson, and Hill. No negative votes. Motion carried.
ADMINISTRATION A motion was made by Councilman Bennyhoff
and seconded by Councilman Hill to increase the salary of
Susan Jones to $370.00 per .month as of December 15, 1969.
The following voted in favor thereof: Mayor Coulter, Councilmen
Bennyhoff, Klingelhutz, Pearson, and Hill. No negative votes.
Motion carried.
POLICE- CONTRACT County Commissioner, Richard Lyman, was present
to explain the status of the Police contract and that the Village
would be receiving the contract amount within a short time.
EMPLOYEE MEDICAL INSURANCE A motion was made by Councilman
Hill and.seconded by Councilman Bennyhoff to approve the Mayor's
recommendation that the Village pay the entire employee cost
of a Blue, Shield M75 Basic Plan, plus major medical coverage for
all Village employees. Approximate cost $13.00 per month per
employee. The following voted in favor thereof: Mayor Coulter,
Councilmen Bennyhoff, Klingelhutz, Pearson, and Hill. No negative
votes. Motion carried.
A motion- was -made by Councilman Hill and seconded by Councilman
_Bennyhoff to adjourn. The following voted in favor thereof:
Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Pearson, and
Hill. No negative votes. Motion carried. Meeting adjourned.
