SUBJ: Consider Request to Vacate a Portion of Drainage and Utility Easements on Lots
1, 2, 3, and 4, Block 1 and Lot 1, Block 2, West Village Heights 2nd Addition -
Byerlys Site Development - 92 -6 Vacation
On June 14, 1993, the City Council adopted a resolution vacating a portion of West 78th Street
(old West 78th Street) through the plat of West Village Heights 2nd Addition. During the
closing of the Byerlys site, the closing process disclosed that the City did vacate the old West
78th Street right -of -way. In moving such to the south; the City did not vacate the existing 10-
foot wide drainage and utility easements which parallel old West 78th Street right -of -way (see
attached map which represent the drainage and utility easements proposed to be vacated). These
easements are not needed with the new alignment of West 78th Street and may be vacated.

I Proposed vacation of drainage and utility easement on the following described properties:
The southerly 10 feet of Lot 1, Block 1, West Village Heights 2nd Addition, except for
the westerly 25 feet of said lot.
' The southwesterly 10 feet of Lot 2, Block 1, West Village Heights 2nd Addition.
The southwesterly 10 feet of Lot 3, Block 1, West Village Heights 2nd Addition.
The southwesterly 10 feet of Lot 4, Block 1, West Village Heights 2nd Addition lying
northeasterly of the following described line: Commencing at the southwest comer of Lot
' 4, Block 1, West Village Heights 2nd Addition; thence south 46 degrees 11 minutes 43
seconds east a distance of 81.82 feet; thence on a tangential curve with a radius of 330.00
feet and a arc angle of 14 degrees 52 minutes 14 seconds and length of 85.65 feet and
there terminating.
All that part of the 10 -foot wide drainage and utility easement which lies southerly of
a line running parallel with at a distance 10 feet southerly from the following described
line: Commencing at the northwest corner of Lot 1, Block 2, West Village Heights 2nd
Addition; thence south 87 degrees 41 minutes 43 seconds east a distance of 217.89 feet;
thence on a tangential curve concave to the southwest with a radius of 330.00 feet and
an arc of 41 degrees 30 minutes 00 seconds and length of 239.02 feet; thence continuing
on a tangent line south 46 degrees 11 minutes 43 seconds east a distance of 201.17 feet

Proposal: Vacate Portion of Utility
& Drainage Easements
Applicant: Charlie James
Location: West 78th Street between
Powers Blvd. (County Road 17)
and Kerber Blvd.
Notice: You are invited to attend a public hearing about a development proposed in
your area. The applicant is proposing to vacate a portion of utility and drainage easements
located on Lots 1, 2, 3 and 4, Block 1 and Lot 1, Block 2, West Village Heights
Addition due to the realignment of West 78th Street. 2nd
What Happens at the Meeting: The purpose of this public hearing is to inform
you about the applicant's request and to obtain input from the neighborhood about this project.
During the meeting, the Mayor will lead the public hearing through the following steps:
1. Staff will give an over view of the proposed project.
2. The Developer /Applicant will present plans on the project.
3. Comments are received from the public.
4. Public hearing is closed and the City Council discusses project. The City
Council will then take action on the proposal.
Questions or Comments: If you want to see the plans before the meeting,
please
stop by City Hall during office hours, 8:00 am. to 4:30 p.m., Monday through Friday. If you
wish to talk to someone about this project, please contact Dave at 937 -1900, ext. 123. If you
choose to submit written comments, it is helpful to have one copy to the planning Department
in advance of the meeting. Staff will provide copies to the Commission/Council.
