Colleen Dockendorf, Councilmember Mark Senn, Councilmember DWA (6- 21 -94) RE: Bluff Creek Assessments Lot 1, Block 1, CHANHASSEN BUSINESS CENTER Dear Mayor and Councilmembers: At the last City Council meeting I was asked to review the assessments for the Bluff Creek project on Lot 1, Block 1, CHANHASSEN BUSINESS CENTER owned by the Congregation of Jehovah's Witnesses. By letter dated May 21, 1993, and earlier verbally, the church was told that the anticipated assessments for the lot were $17,960. On July 9, 1993, the City and the then owner of the property, Audubon 92 Partnership, entered into a development agreement. The development agreement provided that no assessments be imposed on Lot 1, Block 2 and that the assessments that would otherwise be imposed against the lot be imposed against Lot 1, Block 1 in addition to the assessments that would otherwise have been assumed against the lot. The result was an assessment of $28,079.36 against the lot. It is unfortunate that the church has found itself in this position, but the City has in every respect ' acted properly. There is no legal basis for an adjustment to the assessments. The information the City had previously given the church about the assessments was accurate when given.
