SUBJ: Tax Forfeited Properties
' We have received notification from the county that various parcels are currently in a tax
forfeiture position within the City of Chanhassen. The listing is not atypical from previous
years with most of the parcels being remnant paztls. Under Minnesota statute, cities may
claim parcels in tax forfeiture prior to the time that they would be made available to the
general public via auction.
' City staff has reviewed the list of parcels whtuh currently could be claimed by the city (see
Diane Desotelle's memorandum of August : 1994):�� parcels recommended to be placed
into the name of the City of Chanhassen are Parcels Noy. 6, 12, 3, 15, 13, 16 and 2.

As noted earlier in this memorandum,,,, ahmost all of the parcels in the tax forfeited list are
parcels which cannot be built upon at"' are remnant parcel for which the current owners are
' paying taxes. Some of the parcels ;such as Parcel No 16,'�vould likely be purchased by the
property owner directly to the pa" t If, as noted by Mike VY.ggler, the property owner to the
' east would buy Parcel No .,,01 and use it solely as additional front yard for his property, the
best of all worlds would be achieved, i.e. the property would be maintained by that owner and
the city would benefit from pltgafic�nal:1~re��uhes onto that parcel.
Unfortunately, there is po . guararltee that the. prgpert�+. mil gay natural into the future,
especially recognizmgg,that potentially ten different owners will exist tiunng th . nurse of the
next 100 years. Any one : ihose owners could decide that an oversized garage would be
' perfect to accommodate that owners critique car collecon, or, storage associated with his
snow plowing business, car repair business, etc. If the city really wants to ensure that the lot
will be preserved in a natural condition and t6t,4e property does not become abused
' (outside storage, etc.) then the city should ph" into it's ownership. For practical purposes,
the property owner to the east would be accomplishing the same objective that he has
currently stated to Mr. Wegler with the exception that technically, he would not own the
property, but could use it similar to how each of us use the city's boulevard in our front
yards —albeit a much larger "front boulevard."
Approval of a resolution outlining the lots noted above as lots desired to be transferred into
the name of the City of Chanhassen is recommended.

forfeited to the State of Minnesota for non - payment of property
taxes.
As required under MS 282.01, we request that you approve the
non - conservation parcel(s) for public auction or auction to
adjacent owners or request a conveyance to your city /township for
public use.
We require a certified copy of the City Council /Township Board
Resolution authorizing any action taken. If you request that a
parcel be conveyed to your city /township, you must also complete
the form "Application by a Governmental Subdivision for Conveyance
of Tax - Forfeited Land" and mail it to this office. Also, please
return the original CERTIFICATE OF COUNTY BOARD OF FORFEITED LANDS
to my office after your city /township boards have signed the
documents.
Only new special assessments which were levied after the forfeiture
need be certified to this office. The remaining balance of any
assessments levied before the forfeiture will be picked up
automatically.
Please be advised that if the City Council /Township Board fails to
respond within ninety (90) days of the date of this letter, the
sale will be deemed to be approved.
