This is the assessment for the West 78th Street and Downtown Improvement Project No. 92 -3. This improvement
project was a culmination of roadway and utility improvements for the downtown area which began some eight years
ago. The primary elements of this project included the reconstruction of West 78th Street from Kerber Boulevard
west to County Road 17 (Powers Boulevard) and County Road 17 from Trunk Highway 5 north to Santa Vera to
a four -lane divided urban roadway with concrete curb and gutter and storm sewer, traffic signals, trails, landscaping,
street lighting, and strategic road widening at specific locations: along West 78th Street east of Kerber Boulevard.
The timing of these road improvements was critical in order to provide adequate transportation facilities given the
development of major retailers such as Target, Byeriys, and associated retail service - oriented facilities in the
immediate area. The roadway has been designed and constructed to provide an adequate level of service for these
intense types of uses. The prepared assessment schedule is consistent with the methodologies implemented with
the approved feasibility report and associated amendments.
Notice of this assessment hearing has been published as required in the local newspaper and individual notices have
' been mailed to each affected property owners. To date, only one written objection to this assessment roll has been
received (Burdick). Mr. Burdick contends that he has already paid assessments on his property, however, the records
indicate previous assessments were :for utilities and drainage, not for the improved road as is the case now. In
addition, the proposed assessment to Mr. Burdick is nearly the same as at the feasibility stage and no objections
were heard.
At the close of the yassessment hearing f-there are , further questions ; or issues which would require further
.investigation, it would be recommended that the City Council adopt the assessment roll for the West 78th Street and
Downtown Improvement Project No. 92 -3 dated August 22, 1994.

NOTICE IF HEREBY GIVEN that the Chanhassen City Council will meet at 7:30 p.m.
on Monday, September 12, 1994 at the City Hall Council Chambers to pass upon the proposed
assessment for the West 78th Street and Downtown Improvement Project No. 92 -3. Abutting
properties and those properties deriving benefit from this project are proposed to be assessed.

' The proposed assessment is on file for public inspection in the office of the City Engineer.
The total project cost to be assessed is $ 1.004.807.47 . Written and oral objections will be
considered at the meeting, but the Council may consider any objections to the amount of a
' proposed individual assessment at an adjourned meeting upon such further notice to the affected
property owners as it deems advisable.
An owner may appeal an assessment to the District Court pursuant to Minnesota Statute
Section 429.081 by serving notice of the appeal upon the Mayor or City Clerk of the City of
Chanhassen within thirty (30) days after. the adoption of the assessment and filing such notice
' with the District Court within ten (10) days after service upon the Mayor or City Clerk. No
appeal may be taken as to the amount of any assessment adopted unless a WRITTEN NOTICE
signed by the affected property owner is filed with the City Clerk prior to the assessment hearing
' or presented to the presiding officer at the hearing.
Residents who are 65 year of age or older, or retired by reason of permanent and total
disability may apply to have payment of the assessment deferred. The application shall be made
to the City Clerk within thirty (30) days after the adoption of the assessment roll by the City
Council.

Gentlemen:
In reference to Lot 1, Block 3, Burdick Park Addition. I have received a notice, copy attached,
and observe that we are not being charged for the sanitary sewer, water main, or the storm sewer,
which is quite logical inasmuch as I paid for and had a storm sewer, a water main and sanitary
sewer installed to serve this property approximately 10 years ago.
I also note that I am not being charged for the traffic signal improvements. Quite frankly, I think
that the traffic signals improvement is of great benefit and it most certainly benefits my lot.
However, if I am told "No charge" I will just accept the decision.
Now for the improvements. On this particular lot I have been charged time after time for
improvements, plus a great deal of interest.
Another $53,833.87 seems completely unreasonable. And I strongly protest.
It is my understanding that an assessment levied against a piece of property must increase the
value of the property by more than the assessment. I do not believe that this is true in this
particular instance. Therefore, I want to have this assessment completely eliminated or greatly
reduced based on two contentions. Reason one; in view of the many past assessments paid, it is
completely unreasonable. Reason two; this property has not been increased in value by
$54,000.00 due solely to the recent street improvements.
