' Thank you for contacting me regarding S.1822 The Communications
Act of 1994. I appreciate having the benefit of your views on
this important matter.
As you may know, this legislation seeks to further the
development of the nation's telecommunications infrastructure
' while protecting the public interest.
S.1822 is sponsored by Senators Hollings (D -SC) and Danforth
(R -MO). Its purpose is to (1) promote competition among the
telephone, broadcast, and cable TV industries; (2) ensure equal
access to new technologies for all Americans from the rural
communities of North Dakota to New York City; and (3) reassert
' the authority of Congress and the FCC over communications policy.
If passed, this measure will make substantial changes in our
existing telecommunications policy. First, it will require all
telecommunications carriers to contribute to universal service,
either through cash payments or services. Second, it will ensure
that new technologies will be available to all Americans,
including those who live in rural areas and inner cities.
The legislation will also require all telephone service providers
to interconnect their networks so as to ensure that a nationwide,
seamless telephone network is preserved. The seven regional Bell
companies would be allowed to enter the burglar alarm and
electronic publishing industries, with certain restrictions. The
' Bells would also be allowed to provide long- distance service if
they can demonstrate to the FCC in many specific ways that there
is "no substantial possibility" that they will use their market
power to impede competition in the market they seek to enter.
Finally, 5.1822 seeks to address the cable /telephone cross
ownership issue by allowing Bell companies to provide some

cellular and cable television services across local boundaries '
under certain conditions.
I have heard from many Minnesota constituents who are '
understandably concerned about the potential impact this
legislation could have on their businesses and their lives.
While I am not a member of the Senate Commerce Committee, which
has jurisdiction over S.1822, I want you to know that I am
carefully evaluating this bill as it moves through the Committee.
Specifically, I will not be able to support legislation that
compromises universal service or ignores the needs of working '
people or consumers, both urban and rural: If I am satisfied
that this legislation, when it reaches the Senate floor,
addresses these issues in a responsible way, then I will be happy
to support the bill.
When the Senate considers this S.1822, it will be establishing
the scope of our nation's telecommunications infrastructure for
the next century. While I am excited by the potential of
telecommunications technology, it will be my responsibility as a
legislator to make sure that any policy changes on this subject '
are done with caution and fairness.

' This letter is to follow up on our communications regarding traffic safety concerns along Lake
Lucy Road in the area of Charing Bend. As promised, I have requested increased enforcement
in the area while I conducted another radar speed survey, as well as asking the City Engineer's
' Office to review your concerns.
Regarding enforcement, I have requested that the Carver County Sheriff's Department, as well
' as Chanhassen Public Safety, provide additional traffic enforcement efforts in the area. I have
also assigned supplemental traffic enforcement units in the area.
The results of the twenty radar surveys I had conducted over the past month in this 35 m.p.h.
zone resulted in an average speed of 34.5 miles per hour. This should be compared with the
average speed of 37.3 miles per hour that was recorded last fall in response to your September,
1993 letter; and, an average speed of 36.2 miles per hour obtained by the Carver County Sheriff's
Department during that same time.
The conclusions I draw from these radar surveys are that, while speeding does occur; the average
speeds are close to the posted speed limit, and that traffic enforcement does bring speeds closer
' to the posted limit. Therefore, coniinuing traffic enforcement in this area is appropriate law
enforcement response to your concerns.
The City Engineer advises that this segment of Lake Lucy Road was designed and constructed
as a Class II' Urban Collector roadway consistent with its classification in the City's
Comprehensive Plan. Collector roads are intended to serve intra- community trips and as such
will typically carry higher volumes of traffic, including trucks, and have slightly higher posted
speed limits than that associated with 30 mph local residential streets. Based on annual traffic
counts and performance monitoring, this road is functioning as it was intended. Public hearings

Recently we became aware of the effort being made by the Chanhassen Snowmobile Club to gain '
access to the abandoned railroad property in the southern portion of Chanhassen to add to their
existing trail system. The club presently has the County Board's permission to pass through
Lake Minnewashta Regional Park on one route, from T.H. #41 to the lake. Over the years since this
permission was granted, the club has done an excellent job of posting applicable trail signs along the
route, as well as respecting our rights as a property owner by staying on the trail and out of other
sensitive areas of the park. They are a responsible group which I believe would work well with the City
on snowmobile issues.

Waste haulers in Chanhassen met on Wednesday, August 17, 1994 in response to the City of
Chanhassen request that the haulers prepare a unified response to the draft organized
collection contract. This meeting was unproductive Clue to the fact that the hauler's legal
counsel was in disagreement over their ability to meet as a group and discuss a contract,
levels of service, and pricing in violation of ,federal anti -trust regulations. While there are
provisions which permit state legislation to supersede federal regulations, their attorneys still
believe that there are "hooks" left in the antitrust regulations. The next meeting of the waste
haulers is tentatively scheduled for Tuesday, August 30, - ,1994.
I have contacted Dean Johnson of Resource Strategies Corporation and informed him of this
concern. He stated that he had discussed the issue with Roger Knutson whose opinion was
that the haulers would be exempted from the antitrust regulations based on the state
exemption built into the organized collection legislation. However, Dean also stated that the

haulers would have to listen to counsel in;this:matter since it would be them and
not the city that would be „summoned f y the Attvrne L�eneral. F

The waste haulers assured me that they wanted to proceed with the process, even though most
if not all would rather not be organized.Zthis issue ..cannot be -resolved in the near term, I
will request that the haulers mark up a waste .coll ection contract individually, and I will then
attempt to assimilate their contracts into one contract to be presented to the city.

On Tuesday, August 30, 1994, the waste haulers met to discuss the draft contract.. While '
there was no final agreement on contract language, it appears that the haulers are making

progress and should be able to present something to the city after two or three additional
meetings. The haulers have received an independent legal opinion that they are in fact able
to meet to discuss the draft contract and that they are exempted from antitrust regulations.

This letter is to follow up on my August 18 letter, in response to your August 2 letter regarding
your concerns about traffic control on Kerber Boulevard. As promised, I did forward a copy of
your letter to the City Engineer, who returne "e attached response to me. In fact, the
Minnesota Department of Transportation (MNI�bTundertook the speed study for reasons that
included our insistence that Kerber Boulevard considered for a lowered speed limit (MNDOT
has the final say on speed limit changes). A paren v they do not recommend or support any
change in speed limits on Kerber Boulevard'
Regarding your statement that people speed on Kerber, his is a fact that I agree with. Actually,
speeding is the biggest complaint that receive on roa s throughout the City. In response to
this, we sought and received a donattn for a digital rad nit that helps us educate the public
as to their speeds on roads they `uently travel (since o " experience shows that it is mostly
local people that abuse speed JAIts, because they take dri g stretches of roadway near their
homes for granted), brought -4 of concern to the attention the law enforcement patrol units,
and were able to get, forthe first time this year, funding from e City Council to operate traffic
enforcement units seirily c1 flr"" a a rt eas of particular concern.
Finally, regarding tiitr omments on crosswalks and other traffic controlke along Kerber,
we are working with the scliaolis�trtct to consider additional school , .., nd other means to
provide a safe area for students utihzirig'iegadwa k,. a , ou terested in the fact that we
have received nothing short of an incredib n _g r of complaints from people who have
received citations in the area of the one schl 'ne that we recently installed, and so we are
trying to balance the benefits of additional tic control methods with the fact that we have
found that apparently many other people do not appreciate such traffic control areas.
In conclusion, traffic control is a balance of many issues. The most important one being
voluntary compliance by our citizens. After many attempts over many years, we believe that if
an area is properly engineered and signed, the most effective way to help people utilizing the

roadway remember that, in the end, it is their responsibility to comply with traffic laws is by
seeing the occasional squad car. This area will remain on our priority list.

First of all, I would like to laud the efforts of those responsible for the continuous development and
improvement of the Chanhassen City Parks. A quality park system, well planned and expertly
implemented, is obviously a priority in a growing community like Chanhassen.
However, I would like to point out a significant defect in the park system. One that could be
' detrimental to the ezVoyment of 3 parks, and worse, is a serious potential safety hazard. This
defect is the 22" traUMj control in Ke® Bodl vard Allow me to elaborate on a few points:
1. The speed limit on Kerber is 40 mph all the way from W. 78th Street to Powers Boulevard.
This is certainly inappropriate considering all the adjacent property is either recreational
park land or residential developments. When Kerber was a two -lane county road cutting
through farm and pasture land, the speed limit of 40 mph was quite appropriate. But
Kerber now qualifies as a "parkway ", and speeds of 40 mph pose a definite hazard to the
users of the adjacent park land and walkways, and also at the entrys to several residential
developments.
2. Even with a speed limit of 40 mph, traffic at times travels much faster on Kerber, up to 55
mph. Kerber is not a "through highway" but rush -hour travelers use it as such Powers
' Boulevard, a quarter -mile to the west, and with a speed limit of 50 mph, should be used
when motorists wish to reach Highway 5 quickly. Even though Powers is a through road,
note that as you travel north on Powers, the speed limit is cut to 30 mph where it enters a
residential section of Excelsior. An improved traffic control method for Kerber, and hence
downtown Chanhassen, should include some specific steps to avoid routing high volumes of
high -speed traffic through what promises to be an excellent and attractive city center.
' 3. There are no stop signs or marked crosswalks (except at Chan Elementary) to allow
pedestrians, bikers, and others safe access between the parks and the residential
developments. This becomes especially dangerous when you watch the high -speed passing
of turning cars in the right (parking) lane.
As a citizen of Chanhassen, proud of efforts to make this an excellent community, but seriously
concerned for the safety of park users and pedestrians, I would like to propose the following:
A. The speed limit on the entire length of Kerber Boulevard be lowered to 30 mph
' B. Stop signs and crosswalks be installed at each intersection along Kerber Blvd., to control
the speed of traffic, and to allow safe passage of bikers and pedestrians to and from
sidewalks and parks.
' I believe these proposed items fit very well with the efforts already underway to make this city
corridor a peaceful, pleasant and safe improvement to our city parks system.
I encourage the members of the city council, and others involved in city planning, to recognize the
issues I have raised as serious, and to take the actions within their power to address those issues
before a tragic accident occurs.

We wanted to take this opportunity to provide`you with some general information regarding the
Animal Control Contract, as well as to invite,you to call either of us with any questions, concerns
or suggestions to help keep the program running smootfily.
PERSONNEL Community Service Officer Steve Winter s resigned, with his last date being
8/11/94, as he was recently married add is moving out of the area. We are very pleased to have
hired Kerri Nolden, who has been .o�rking as a security officer at St. Thomas College, as well
as having been very involved with the Edina Police Ex Program. Kerri is a law
enforcement student, and will -ake an excellent addition to our staff.

quite a bit of counseling by the Animal Cont Q51 O�cer to the caller, and they are not always
pleased about this, but it just doesn't make sense send an Animal Control Officer out at that
kind of cost for situations that can either wait nail an officer is on duty, or if there is simply
nothing they could practically do about it. Of course, if you have complaints regarding these
types of issues, please have the resident call us.

Overall, the first half of 1994 has been a positive one for the animal control program. As
previously stated, we are finding the number of calls we are getting from all six cities increasing
significantly. Combined with the tremendous growth of Chanhassen and associated work for our
CSO's, we continue to appreciate your patience and understanding as we strive to do our best
to serve all six cities.
One of our cities relayed to us the results of a survey hat their residents
y were asked to fill out,
and we were disappointed at the low scores that animal control received. However, in looking
' at the comments that were provided along with the numerical scores for satisfaction/lack of, many
of the native comments were directly stating that they need more animal control patrol. In fact,
we have been finding ourselves using up much of contract patrol time in just responding to calls
' rather than being able to patrol and providing that type of education & enforcement. This may
mean you could consider adding additional contract time; however, that would definitely require
us to hire more personnel, and I would need plenty of notice in order to work this into our 1995
budget.
