A public hearing was held at the City Council's regular meeting on April 12, 1993 concerning
' the feasibility study for the extension of Lake Lucy Road between Trunk Highway 41 and Galpin
Boulevard. This project was initially petitioned by two property owners, the Westside Baptist
Church and property owned by Gestach/Paulson/Klingelhutz, amassing nearly 36 acres
' immediately east of Trunk Highway 41. The long -term function of this proposed roadway
segment was and still is to provide continuity for the existing Lake Lucy Road collector roadway
by extending west from its current terminus at Galpin Boulevard to Trunk Highway 41. Since
' only the westerly half of the affected properties between Galpin Boulevard and Trunk Highway
41 petitioned for this project, the improvements were proposed to be staged. Stage I would only
be constructed from Trunk Highway 41 and extended east through the petitioning properties. It
' was anticipated that the remaining extension of this roadway (Stage H) east to Galpin Boulevard
would not occur unless the affected property owner /owners petitioned for the improvement or
' significant future development in this area would deem this connection as necessary for the
community and/or for health and safety reasons.
' During the process of preparing the feasibility, it became apparent that the Westside Baptist
Church no longer had an interest in this project and had subsequently rescinded their project
petition. Since the road needed to cross through the church property in order to serve the
' Gestach/Paulson/Klingelhutz property, the church's lack of participation for all intents and
purposes had temporarily stalled the project. As such, the public hearing was tabled indefinitely.
Staff has recently been contacted by the Gestach/Paulson/Klingelhutz partnership again regarding
Jerome Carlson's purchase of the property previously owned by Westside Baptist Church and a
renewed commitment by all parties to proceed with this improvement project. Staff has had a

meeting with these land owners (Gestach/Paulson/Klingelhutz and Carlson) including the Ryans
' who own property immediately west of Galpin Boulevard, and the project engineer to discuss
presenting a supplemental report to the City Council and calling for a formal public hearing.
Notice of this public hearing has been sent to the appropriate property owners and published in
' the newspaper.
It is therefore recommended that the City Council formally call a new public hearing on the Lake
' Lucy Road Extension between Trunk Highway 41 and Galpin Boulevard, Project No. 92 -12 to
be held at their regular meeting on Monday, June 13, 1994.

Acting Mayor Wing called the meeting to order at 7:30 p.m.
COUNCIL MEMBERS PRESENT: Councilman Wing, Councilman Mason, Councilman Senn,
Councilwoman Dockendorf and Mayor Chmiel arrived during discussion on item 5.

APPROVAL OF AGENDA: Councilman Mason moved, Councilwoman Dockendorf seconded to
approve the agenda with the following addition by Councilman Wing: At the end
of the regular meeting the Council will be meeting with the City Attorney in a
closed session to discuss some proposed litigation. All voted in favor of the
agenda as amended and the motion carried.

Acting Mayor Wing: Item number 2 is a public hearing regarding Lake Lucy Road
extension. However, to take any action on this we're going to need 415 vote of
Council. And because we only have 4, I'm recommending that we alter the agenda
accordingly and table this until later in the meeting when we have a full
Council that we can take action on it.

If that's, as he's suggesting, if you agree with his action of tabling it, you

Roger Knutson: Sure. You can open the public hearing and then just
automatically table it for discussion.

Councilman Senn: I think we want to if it was noticed that way.
Charles Folch: Yeah, I'm not sure who's going to be here. Most of the people
have contacted me today and mentioned there was no need to attend but certainly
we could open it up to see if anyone's here to talk about it.
Acting Mayor Wing: Well let's then open the public hearing and Charles, if you
want to just give us a brief overview and then your recommendation for tabling,
and we'll go from there.
Charles Folch: Basically there really isn't a whole lot of new news to report
since we last held the public hearing on March 8th. A lot of the issues that
were still open ended last time that we've talked about really haven't been
resolved as we hoped they would in this last month. The one piece of question
that we are able to answer to you tonight was in regards to the 60 foot roadway
easement that was granted through the Westside Baptist Church property in favor
of the Gestac - Paulson - Klingelhutz property. We were able to obtain a copy of
the easement document from the property owners. We had Roger take a look at it
and basically it's Roger's opinion that this easement, road easement is not
specifically stated for public purposes and really it appears that all that can
be drawn from it is the intention was to give a road access specifically to the
Klingelhutz property but that was it. That it was not intended to be a future
road or public road access from those types of rights standpoint. Based on
that, staff's had contact almost daily over the last few weeks with these
property owners trying to get this issue resolved and it doesn't appear that
things are coming together very quickly but at this point it's staff's
recommendation that we either table this public hearing indefinitely until we
can resolve some of these issues and come to the table with more of a complete
package at that time.
Acting Mayor Wing: Even with the recommendation for tabling, this is a public
hearing. Is there anybody here tonight to address this issue specifically?

as they once had petitioned for. But in talking to the church, we're really not
sure what their intentions are. Whether they intend to develop on the property.
Whether they intend to sell the property. At this point in time it's really now
known. They're not telling us a whole lot.
Councilman Senn: How does this affect any of the proposed development?
Charles Folch: Well at this point in time, it does create an obstacle for the
Gestach- Paulson - Klingelhutz property to fully develop their property into a
residential subdivision. If they so choose, they could exercise their right to
build a private driveway along that 60 foot easement and the ordinance would
allow them to build up to 4 homes and have that accessed via the 20 foot
driveway.
Councilman Senn: Their limitation is the 4 homes then?
Charles Folch: At this point in time, right. Unless a public street could be
constructed through the property.
Councilman Senn: And what was the proposed subdivision size?
Charles Folch: Pardon me?

Charles Folch: I think there was something like 17 or 18 lots subdivision.

AWARD OF BIDS: RAILROAD GRADING CROSSING TRUNK HIGHWAY 101 REALIGNMENT (NORTH
LEG). PROJECT 88- 22B -1:
Charles Folch: This morning at 11:00 a.m. the City received and opened bids for
the railroad grade crossing portion of the Trunk Highway 101 north leg
improvement project #88 -226. A total of two bids were received from the
project, both coming from local established contractors. Just to your note,
there is a very limited number of contractors nationally that are able to, that
are qualified to perform this kind of work and it appears that the brief bidding
time schedule that we had and the fact that it's a relatively a small scale type
project may have played a part in these national contractors from taking
' interest in this project. But as I mentioned we did receive two bids. The low
bid was received from George F. Cook Construction Company located in Minneapolis
with a bid of $326,245.00. I should point out that back in 1990 when the Soo
Line had owned the railroad track, we had entered into an agreement to have the
' Soo Line construct these crossings and their estimate or the contract amount
that we had entered into with the Soo Line was $328,000.00 roughly $200.00. So
the bid we did receive today was about $2,000.00 under that. We have made a
' reference check of this company this afternoon with the Burlington Railroad and
with the Twin Cities and Western Railroad. We received favorable responses on
both those reference checks and at this point in time staff would recommend that
' the City Council award the railroad grade crossing contract for the Trunk
Highway 101 north leg project to George F. Cook Construction Company in the
contract amount of $326,245.00.
' Acting Mayor Wing: Just in the process here, could you just real quickly
describe it. Are we talking arms and the whole works?
Charles Folch: Basically the work will involve constructing the rubberized
grade crossing. It will also involve constructing the crossing arm guards. The
controller for the crossing, which will be integrated with the signal system
that will be installed both at TH 5 and at the intersection of West 78th and
TH 101. And there will also be some early detection devices put up upstream or
uptrack, if you will on both ends of the crossing.
Councilman Senn: Now this is separate contract from the rest of the
intersection improvements?
' Charles Folch: That's correct. This is a separate contract. It's sort of a
specialized work. If things would have worked out differently with Twin Cities
and Western Railroad, we may have attempted to bid this under the original, the
' overall road improvement contract but unfortunately those two design phases
weren't tracking compatibly because we were still working out some details with
the Twin Cities and Western Railroad who had just taken over the tracks and we
were trying to get them up to speed as to what had been done with the Soo Line
t Railroad previously and such. So unfortunately they weren't bid all together
but I'm not sure in this case that it would have made any difference because, as
I said, there's about a dozen specialized firms that across the country that can

At their regular meeting on March 8, 1993, the City Council held a public hearing on the
feasibility report for the Lake Lucy Road Street and Utility Extension Project No. 92 -12.
You may recall that the City Council authorized the preparation of this feasibility study on
July 13, 1992 following the receipt of petitions for these improvements by the Westside
Baptist Church property located on Trunk Highway 41 and the property located immediately
to the east which is zoned for residential single - family and currently owned by
Gestach /Paulson / Klingelhutz. During the public hearing testimony was taken from a variety
of property owners located in the area including Jerome Carlson, Dave Gestach and Al
Klingelhutz. Staff had been contacted prior to the meeting by Mr. Brian Pike of the
Westside Baptist Church who indicated that they were withdrawing their formal petition for
this project. This greatly complicates the ability to do this improvement project since
cooperative efforts need to occur between City staff; the project engineer and affected
property owners to establish the most appropriate and feasible alignment for the roadway,
acquire necessary right -of -way and easements, and assign project special assessments.
Following the completion of the public discussions, the City Council acted to continue this
public hearing to their regular meeting on Monday, April 12, 1993 to allow time for staff,
the project engineer and the appropriate property owners, i.e. Westside Baptist Church,
Gestach /Paulson / Klingelhutz and Carlson, to work out outstanding key issues involving this
project. Unfortunately, during this interim period, no favorable progress concerning this
project has been made. All of the outstanding issues as addressed at the public hearing
remain as unknown as they were at the previous meeting. It is apparent that Westside
Baptist Church no longer wishes to cooperate with or support this project.

The City Attorney has reviewed the easement documents executed along with the purchase
agreement between Gestach /Paulson / Klingelhutz and the Westside Baptist Church property
and has concluded that the road easement granted over the church property does not give
rights for public purposes but only rights for road access to the Gestach /Paulson / Klingelhutz
property. It is unlikely that the Westside Baptist Church would grant the City rights for
public purposes over the existing 60 -foot easement over the north side of the property;
however, staff also believes that this is a less desirable location for the extension of Lake
Lucy Road as compared to locating it along the southerly property line.
Given all things considered, it would be staff's recommendation to table action on this
project until such time that these key issues can be resolved.

This is the public hearing on the feasibility report for the Lake Lucy Road street and utility
extension Project No. 92 -12. The City Council authorized the preparation of this feasibility
study on July 13, 1992 following receipt of petitions for these improvements by the Westside
Baptist Church property located on Trunk Highway 41 and the property located immediately
to the east which is zoned for residential single family and currently owned by
Gestach /Paulson /Klingelhutz. The primary objective of the feasibility study was to identify
those public improvements which need to be constructed to allow for development of the
church and proposed residential property and define the official alignment for this Lake
Lucy Road extension between Trunk Highway 41 and Galpin Boulevard /County Road 117.
Based on the feasibility study, it has been determined that only the westerly half of the road
extension would need to be constructed in order to allow development of the petitioning
properties. The easterly half of this road segment is not proposed to be constructed at this
time. In the future, if the property owner to the east (Ryan) should petition for the road
improvement or if future development pressures in the area should warrant, construction
of this easterly section could be considered at that time.
On Wednesday, February 17, 1993, an informational neighborhood meeting was held with
affected property owners to discuss the elements of the proposed project, the associated
costs and potential special assessments. Although no representative of the Westside Baptist
Church was present at the neighborhood meeting, they did contact staff to formally withdraw
their original petition for this improvement project. At this time it is not known what the
Westside Baptist Church's intentions are for their property; however, staff is a aware that

inquiries have been made by other area property owners to potentially purchase this
' property.
The project consultant engineer, Mr. Bill Engelhardt of Engelhardt & Associates, will be
making a formal presentation of the feasibility report and its findings at the public hearing.
At this point it would seem prudent to conduct the public hearing to receive public
testimony on the proposed project and determine whether it is appropriate to proceed with
' the authorization to prepare the project plans and specifications, or otherwise identify any
remaining issues which need further investigation.

' At their regular meeting on July 13, 1992, the City Council authorized the preparation of
a feasibility study for extension of street and utilities for Lake Lucy Road between Trunk
Highway 41 and County Road 117 (Galpin Boulevard). I have attached a copy of the July
9, 1992 staff report which provides some background on the impetus and some of the issues
involved in this improvement project which has been previously identified as a future road
' element of the City's comprehensive guide plan amended in May of 1991. It is not staffs'
intent to recommend construction of this entire road segment at this time; however, the
proposed development on the west end of this general area forces the City into at least
defining an appropriate alignment for the entire collector road and constructing the public
improvements needed for the development. In this manner, the City is able to pro - actively
plan for this road improvement prior to development. This philosophy is also being
' implemented on other projects such as the Trunk Highway 5 north boulevard access road
and Trunk Highway 101 south.
The specific elements of this proposed improvement project are identified in the study along
with estimated project costs and associated special assessments to benefitting properties.
Staff and the project engineer have scheduled an informal neighborhood meeting to be held
' on Wednesday, February 17, 1993 at 7:00 PM in the Courtyard Conference Road to discuss
this proposed project.
' At the formal public hearing for this project, the project engineer will provide a presentation
of this feasibility report and its findings. The only action necessary for the Council tonight
would be to formally receive the feasibility study and call for a public hearing at their
' regular meeting on March 8, 1993.

Project No. 92 -12
The City has recently been contacted by two adjacent property owners located in the
southeast quarter of Section 4 and southwest quarter of Section 3 concerning development
proposals. Both properties are located on the east side of Trunk Highway 41 immediately
south of the Minnetonka Middle School property. The property immediately adjacent to
Trunk Highway 41 is approximately 10 acres in size and is the location for a new church
site. The adjacent property to the east is approximately 26 acres in size and is tentatively
proposed for residential single - family development. Road access is a key element for both
developments. The church property has a pre - existing driveway access on Trunk Highway
41. The single - family development may also have a cross- access easement over the church
property out to Trunk Highway 41. Both are believed to be inappropriate access facilities
to these sites given the proposed developments.
The City's comprehensive guide plan amended in May, 1991 identified the extension of Lake
Lucy Road from Galpin Boulevard (County Road 117) west to Trunk Highway 41 as a
needed future collector street improvement. The topography and environmental features
of this area make routing a roadway alignment very challenging, particularly on the west end
towards Trunk Highway 41. It is not staff's intent to recommend constructing this entire
road segment at this time; however, the two proposed developments on the west end which
lie within the general area of the Lake Lucy Road extension sort of force the City into, at
a minimum, defining the most appropriate alignment for this collector road through these
sites. In effect, the City needs to be in the position of proactively determining the
alignment.

The length of the future Lake Lucy Road between Galpin Boulevard and Trunk Highway
41 is a little over a half -mile. At this time it would be appropriate to define and officially ,
map the entire future collector road alignment and perform a feasibility study on only the
westerly quarter -mile of this road segment which will initially serve these two development
sites. I have contacted Bill Engelhardt of William R. Engelhardt & Associates, who has '
some familiarity from previous involvement associated with this road to provide a cost
estimate to perform this feasibility study and official mapping. Bill has estimated this work
to cost approximately $ 10,000. Being that this future roadway will ultimately serve as more '
of a community -wide roadway system and is in the City's long -range comprehensive
transportation guide plan, the cost to perform this study will have to be up- fronted by the
City; however, it will likely be recovered over a number of years as tracts of land abutting ,
this roadway develop and the corresponding construction projects take place and pay their
share of the roadway improvement costs.

of a feasibility study for the road improvement project of approximately the westerly '

RE: Lake Lucy Road Extension

We were invited to a neighborhood meeting concerning the proposed
alignment of the Lake Lucy road extension.
To our surprise the presentation proposed the continuation of Lake Lucy
Road mapped directly through the middle of our property. The only
discussion regarding the placement of the road was to where potentially the
road would be placed from Hwy 41.
We assumed the meeting was to discuss various alternatives as to where
the Lake Lucy Road may be mapped in the future as development occurs.
Our concerns as to this particular proposal include the following:
1. The proposed collector road at this time is not a proposal
supported by any of the petitioners for development of their
particular property. This is a proposal by the city to designate
this location as the collector area irrespective of the developer
or our concerns.
2. As explained to us at the meeting, there exists a financial
incentive to map the road. By mapping the road the city
collects additional revenues from the state to support the
road system. We feel this is an inappropriate reason to
designate the location of the road at this time.

3. We owned our property before the present Lake Lucy
Road was built. Because of our growing family we have '
considered the option of building a home on the hill directly
where the proposed extended Lake Lucy would pass. This
proposal would make it virtually impossible for us to even
consider such an option.
4. The designation of this extension in this particular location
,
dictates that our property would be split in two, and
because of this, any future use will always be required to
contemplate this proposed road. This would restrict the
use of our property now and into the future.
5. In our discussions, it was presented that there would be a
major collector road built to the south of us developed this year
to provide traffic connections between Galpin Boulevard and
'
Hwy 41. This collector road should serve adequately for traffic
movement now and into the future as a East -West connector.
,
6. If our neighbors to the north or south would choose to
develop at a future time, then at that time it would be
appropriate to consider the mapping of the Lake Lucy Road
'
extension. It is not absolutely required that the extension of
Lake Lucy Road begin on Galpin Boulevard directly across
from the existing Lake Lucy Road. With a major collector to
,
the south, a new collector, if needed in the future, could be
planned as development occurs.

As the city grows, we understand and appreciate the importance of a
measured and comprehensive planning process. This is why it is important '
that we share with you how very much opposed we are to this proposal
and that we need to plan now to reconsider the placement of the proposed
extension. ,

Dear Charles,
As a follow -up to the informational meeting held at City Hall
on February 17th and subsequent to further discussions between
Linda and me, we would like to go on record as follows:
The 14 acres which we own adjacent to the ten acres of church
property are not available for development at this time. We
know that some day, sooner or later, that 14 acres will be
developed, but we are reluctant to endorse any extension of
Lake Lucy Road which would result in significant assessments
against our property.
We do not, however, want to unreasonably withhold cooperating
on the installation of a road, provided the owners of the church
property stand behind their.earlier petition to the City for a
road through their property.
