However, it has been recently discovered that this ordinance amendment was never officially recorded nor is it known whether it was ever published in the local paper. The following year in 1989 the City Council passed a resolution restricting the sprinkling of water to an odd/even schedule. The primary reasons for this restriction was the drought conditions experienced during previous years, difficulties in water supply meeting demands and the general need to encourage good water conservation practices. Based on the interpretation of Resolution No. 89 -60, City staff has been enforcing this odd /even sprinkling restriction each summer. In most violation instances, the property owner has indicated that they were not aware of the restriction; however, they were willing to cooperate accordingly. In general, it appears that most people are concerned about protecting the environment, particularly as it relates to water resources and conservation. The past few summers have been ,unseasonably cooler and wetter than normal; however, if this spring is any indication, this summer is likely to be much hotter in daytime temperatures. This, combined with the extensive population and industrial growth within the City is of concern in terms of meeting the water supply demands and fire protection requirements. The City's Utility Superintendent (see attached memo) has indicated that over the past couple of weeks there have been times when all five of the City's wells have needed to be pumping all at the same time yet the demand for water was in excess, thus reducing the level of storage in the City's towers. Many of the members on the City Council who remember the time during the summer of 1989 when the City was out of water due to draining storage capacity in the towers, can understand the Utility Superintendent's apprehensiveness and concern regarding the potential for this to occur again. This water demand is a clear indication of the need to install Well No. 7 which is scheduled to begin construction later this summer. J Don Ashworth June 8, 1994 Page 2 As a matter of housekeeping, staff believes it is important that the previously approved, but not ' recorded, ordinance amendment to the City Code Section 19 -28, and Resolution No. 89 -60 be combined into one ordinance amendment that is consistent with the practices that have been implemented over the past 6 years. It is therefore recommended that Section 19 -28 of the City Code be amended to read: ' SECTION 19 -28 WATER USE RESTRICTION. Use of the City water supply system for lawn and garden sprinkling, irrigation, car washing or ' other non - potable uses shall be limited to an odd /even schedule corresponding to property address effective each year from May 1 to September 30. Whenever the City Council or, on a temporary basis, the Public Works Director and/or the Public Safety Director, shall determine that a shortage ' of the water supply threatens the City, they may, by resolution, limit the use, times and hours during which water may be used from the City water supply system. To the best of my knowledge, we have received virtually no ' complaints in regards to this restriction. In instances where citizens have'shown concern over the restriction as it would apply to their new sod, their new whatever, staff has worked with that citizen to ensure that we met their needs while not jeopardizing the overall intent of the ' ordinance. Approval is recommended. But as of this year so far with the approximate addition of 500 -600 new houses within the last couple of years and no change in the water system, the warm days with no rain are beginning to take its toll. There have been times over the past week where all of the ' City's 5 wells have been running and the water level in the towers continue to drop. This is due mostly to the sprinkling of the new homes with sod, washing cars and various things people do ' when it is warm outside. The City has at times in the past implemented temporary sprinkling bans and I believe that this ' is something we should be doing as soon as possible because without any rain if the year gets drier we are going to be in trouble later on. There is also tie possibility of problems with the wells that we would not be able to use one or more which would cut are pumping capacity by ' that much less. Summer storms creating power outages or lightning strikes to the well control panels can also be a major factor which could drastically cut down our pumping capacity. ' My suggestion would be to implement an odd/even sprinkling ban every day; 7 "days a week. If we find we have to go through a week or two with no rain and it looks like we are having a problem, then I would suggest we limit the hours of sprinkling,.e: no sprinkling allowed between the hours of 5:00 a.m. to 9:00 a.m. or 6:00 p.m. to 10 :00 p.m. or both, depending upon the severity of the situation. This would then.`give the system some recovery time to fill our towers each day. I feel this ban is absolutely necessary to minimize the possibility of repairs that ' would have to be done to pumps, wells, water levels, etc. and to provide proper fire and health protection to the citizens of Chanhassen. The Commission feels restrictions are necessary because of the drought conditions created in the summer of 1988 and the general need to conserve water. NOW, THEREFORE, BE IT RESOLVED BY THE CHANHASSEN CITY COUNCIL that effective May 1, 1939 sprinkling will be allowed on an odd / even schedule. There will be no hourly restrictions at this time. The final reading to the ordinance amendment should read: 0 u Section 19 -28. Water Use Restricted. Whenever the City Council or on a temporary emergency basis, the City Manager and the Fire Chief, shall determine that a shortage of water supply threatens the City, they may, by resolution, limit the use, times and hours during which water may be used from the City water supply system. With the amendment to the ordinance, as indicated, the City of Chanhassen's Public Safety Department will be able to take imme- diate enforcement action. In addition, City Staff may institute graduated water use restrictions as may be dictated by the cir- cumstances. The following graduated step system for sprinkling/ water usage restrictions will be established by policy directive: 1. Odd /even watering restrictions; 2. All voted in favor and the motion carried. The public hearing was ' closed. ' Councilman Horn: Can you give us a brief update of where we are? Mayor Hamilton: Yes, Gary can you tell us how the water situation is holding up? Gary warren: :dith the current sprinkling ban that we have in place, even and odd from 5:00 in the morning to 11:00 basically, our pumps are able to regain 13 ' City Council "]eeti.ng - July 25, 1988 whatever was loss we see a significant drawdown on our new reservoir. By basically late afternoon, typically in the week, we are almost to a fill condition and the pumps are able to rest and relax over the evening hours until we get the morning rush so I'd say right now we're where we want to be as far as ' the pumps are getting time to rest. The reservoir is able to handle the demand when we do all the sprinkling and everybody seems to be cooperating very well with the sprinkling. Councilman ' what we're established? Any possibility of relaxing Gary Warren: I would say only if, we're still running a deficit of about 12 to 13 inches of percipt this year and if we can get Mother Nature to knock out some of that deficit, I think that's what we need to see first.
