Approve Change Order No. 3 for Lilac Lane, Project No. 91 -4
' You may recall that this improvement projects accomplished under a cooperative effort with
Hilloway Corporation, the developer of Ithilien who in turn agreed to reconstruct Teton Lane
from Lilac Lane south to Ashton Court and be"assessed for 20% of the City's improvement cost
' to Lilac Lane. The City's Lilac Lane improv"eement project was substantially completed by fall
of 1993 and the assessment hearing was held that October.
' The City's contractor has completed the Temaining punch list items on the project and it is now
the appropriate time to final out the prpject. As a part o -:,the project finaling process, there are
a number of housekeeping items relafed to additional vvArk tasks which need to be formally
' addressed. The project engineer,ha' provided a detailed description for each of the additional
work items, the associated cost.tind corresponding justifica,. n for the additional work. Of the
10 additional work items associated with Change Order No 3, three of the items were required
' by outside agencies having permit approval of the project, i.e °iennepin County, Carver County
and the City of Shorewoodlos.`, 4'- ad),.. lre= c+fl °i #+'ms (Nos. 5, 7 and 8) were items
' requested by residents'during Ihhe public hearir ;;process and - consensually approved by the City
Council. The remaining items (Nos. 1, 9 and 10) were the result , o tie extremely wet conditions
and weather experienced during .the spring and summer of 1993. �
' In all, Change Order No. 3 results in ' a "
net cohtrac amendment increase amount of $31,279.67.
While this may be a large increase to the ohgfiial contract, it is not that unusual for small
�
' reconstruction projects where satisfying proper, %wner and permitting agency requirements have
to be met. It should also be remembered that as a part of the City/Development improvement
agreement, the developer ( Hilloway Corporation) totally reconstructed Teton Lane from Lilac
' Lane to Ashton Court at his expense. This was a significant cost savings to the City. In any
case, the costs for these additional work items to Lilac Lane were forecasted by the project
engineer during the assessment process held last fall.

In conclusion, while the percentage of this change order appears significant, all the work task
items were required and justified in order to properly complete the project to meet agency permit
requirements and adjacent property owner desires. It is therefore recommended that the City
Council approve Change Order No. 3 to the Lilac Lane Improvement Project No. 91 -4 in the
amount of $31,278.67 yielding a revised and completed contract amount of $94,460.52.
