One of the lots will be occupied by an existing home (Parcel B). The second parcel (Parcel A) will be available for future construction. The site is located south of Hwy. 7 and north of Orchard Lane. The site will be accessed via Orchard Lane. The proposed lots meet the minimum requirement of the Zoning Ordinance. The site generally slopes to the north. No grading plans were submitted with this proposal. We anticipate minimal grading to take place. Staff is recommending detailed drainage, grading, and erosion control plans be submitted prior to issuance of a building permit on the site. The Park and Recreation Commission is recommending that park and trail fees be paid in lieu of park land. Staff believes that this plat request is a reasonable one and consistent with guidelines established by the city Comprehensive Plan and Zoning Ordinance. We find it to be well designed. We are recommending that it be approved with conditions as outlined in the report. SUBDIVISION The applicant is proposing to subdivide a 1.66 acre site into 2 single family lots. The density of the proposed subdivision is 1.2 units per acre. Both lots meet or exceed the minimum, 15,000 square foot of area. A single - family residence currently occupies proposed Lot B. A cabin, located east of the residence, will be located on the proposed property line separating Parcels A and B. The Zoning Ordinance prohibits the location of buildings on property lines as well as the location of two residential structures on a single parcel. In this_ case, the subdivision of the parcel will intensify a nonconforming situation. Staff discussed this with the applicant, and informed him that the cabin must be removed prior to recording of the subdivision. The applicant explained that once the ground freezes, he will be able to put the cabin on skids and push it. We suggested that he escrows funds with the City to guarantee the removal of the structure no later than December 31, 1994. If he fails to remove the structure, the City would contract to have the structure removed. Staff notes that the proposal is consistent with the Comprehensive Plan and generally consistent with the Zoning Ordinance. Park and Recreation The Park and Recreation Commission recommended the City Council require full park and trail fees be paid as a condition of approval. There is a utilized pond near the northwest corner of Tract B that is incorporated into the City's Surface Water Management Plan and is discussed below. SURFACE WATER MANAGEMENT PLAN ' The City has adopted a Surface Water Management Plan (SWMP). The SWMP will serve as a tool to protect, preserve, and enhance the City's water resources. The plan identifies the stormwater quantity and quality improvements from a regional perspective necessary to allow ' future development to take place and minimize its impact to downstream water bodies. In general, the water quantity portion of the plan uses a 100 -year design storm interval for ponding and a 10 -year design storm interval for storm sewer piping. The water quality portion of the plan ' uses William Walker Jr.'s Pondnet model for predicting phosphorus concentrations in shallow water bodies. An ultimate conditions model has been developed at each drainage area based on projected future land use, and therefore, different sets of improvements under full development ' were analyzed to determine the optimum phosphorus reduction in priority water bodies. J Obed and Mildred Melom December 12, 1994 Page 4 A utilized pond exists on Trunk Highway 7 right -of -way and the SWMP shows that this ponding area should be increased in order to serve as the water quantity pond for 11.9 acres of drainage area. Based on the SWMP, this pond should be designed to have a normal water level of 961.7 and a high water level of 964.1. An existing 24 -inch discharge pipe is shown on the plan to carry the discharge from this pond north across Highway 7 to a pond in Shorewood. Since this site may be developing soon, staff suggests that the applicant dedicate additional easements for future construction of this pond at this time. The SWMP fees discussed below would be deducted based on the contribution of the developer to the project. Water Quality The SWMP has established an connection charge for water quality systems. The cash dedication will be equal to the cost of land and pond volume needed for treatment of the phosphorus load leaving the site. The requirement for cash in lieu of land and pond construction shall be based upon a schedule in accordance with the prescribed land use zoning. Values are calculated using the market values of land in the City of Chanhassen plus a value of $2.50 per cubic yard for excavation of the pond if the applicant constructs the pond or $4.00 per cubic yard for excavation of the pond if the City constructs the pond. The water quality charge has been calculated at $800 /acre for single - family residential property. The proposed development of Tract A (0.95 acre) would then be $760. This includes a land cost estimate of $18,000 per acre and excavation fees at $2.50 per cubic yard. Should the City be petitioned to construct the ponds the excavation fees will be $4.00 per cubic yard. Fees are reduced based on the costs of the developers contribution to the SWMP design parameters. Water Ouantity The SWMP has established a connection charge for different land uses based on an average, city- wide rate for the installation of water quantity systems. This cost includes all proposed SWMP trunk systems, culverts, and open channels and stormwater ponding areas for temporary runoff storage. The connection charge is based on the type of land use for the area. Fees will be based on the total developable land. Undevelopable -area (wetlands), public parks, and existing development is exempt from the fees. The fees are negotiable based on the developers contribution to the SWMP design parameters. Low density developments will have a connection charge of $1,980 per developable acre. The proposed development of 0.95 acre low density would then be responsible for a water quantity connection charge of $1,881. In lieu of the water quality and quantity fees, the applicant could dedicate a drainage and utility easement over the northerly 25 feet of both tracts. This area would then accommodate the future stormwater quality /quantity pond. The City is entitled to a 10 -foot wide easement as a part of subdividing process. Obed and Mildred Melom December 12, 1994 Page 5 DRAINAGE 0 0 n The property drains to the north toward Trunk Highway 7. A proposed regional stormwater pond is shown in the SWMP to be sized to take runoff from approximately 11.9 acres of land. (See SWMP discussion above.) No additional storm drainage improvements are required as a result of this subdivision. GRADING The lots slope northerly toward Trunk Highway 7. No grading plan was submitted at the time this report was prepared. Staff does not anticipate much, if any, grading for preparing the site for a building. Staff is comfortable in requiring a detailed drainage, grading, and erosion control plan be submitted to the city engineer for review and approval prior to issuance of a building permit on the site. STREETS Orchard Lane is not currently constructed to full city urban standards. The street is paved with a bituminous mat approximately 24 feet wide with minimal storm drainage improvements. Staff believes the current street system is adequate to support this development. UTILITIES The existing house on Tract B is connected to municipal sewer and water. The parcel was assessed for one sewer service and two water services. Tract A does not currently have sewer service available. The existing sewer line ends at the west line of Tract B. Therefore, it is necessary for the applicant to extend the city's sanitary sewer line along Orchard Lane approximately 100 feet to the east in order to provide service to Tract A. The sewer line shall be constructed in accordance to the City's latest edition of Standard Specifications and Detail Plates. Detailed construction plans and specifications will be required for staff review and City Council approval. No additional sewer assessment would be charged other than building permit fees if the applicant pays for the sewer line extension. RECOMMENDED CONDITIONS OF APPROVAL Staff recommends the City Council adopt the following motion: "The City Council approves Subdivision #94 -19 as shown on the plans dated October 16, 1994, subject to the following conditions: 1. Prior to issuance of a building permit for Tract A, a detailed grading, drainage and erosion control plan shall be submitted to the city engineer for review and approval. In lieu of the City's Surface Water Management fees, the applicant shall dedicate a drainage and utility easement over the northerly 25 feet of Tracts A and B. I 3. The applicant shall be responsible for extending sanitary sewer service to Tract A. Detailed construction plans and specifications in accordance with the City's latest edition of Standard Specifications and Detail Plates shall be submitted to the city engineer for review and City Council approval. The applicant shall also enter into a development contract with the City and provide the City with a financial escrow to guarantee installation of the sewer line and street restoration. 4. The standard 5 -foot side, 10 -foot front and rear lot line drainage and utility easements shall be dedicated to the City around both Tracts A and B. 5. Access to the lot shall be limited to Orchard Lane. 6. The applicant shall apply for and obtain permits from the MWCC, Health Department, and PCA for extension of the sanitary sewer line. 7. Full park and trail fees be paid at the time of building permit approval in the amount of the park fee in force at the time of building permit application. 8. The existing garage shall be removed no later than December 31, 1994. Financial guarantees shall be posted with the city to ensure compliance with this condition." ATTACHMENTS 1.
