completion in November /December

organized last spring resulted in "a lot" of garbage being picked up. The resulting letters to
the Chanhassen Villager expressing student's concerns over the amount of garbage being left
behind in the park demonstrated a commitment to thisroject.

AWARENESS.
SUGGESTED ACTIVITIES FOR SPRING. 1994:
1. Walk to Pond Park to foster awareness of both the beauty and the
problems of the park.
2. Have speakers from the city talk to the students (grade level ?)
explaining rules of the park, what the city does to maintain the
park, and what the students can do.
3. Sign up on the school calendar when a class visits the park.
4. Have the city supply bags which individual classes will take on any
"trips" to the park for collecting litter.
OTHER ACTIVITIES SUGGESTED:

1. Assign specific grade levels for cleaning up litter..
2. Writing letters to the editor to promote awareness and possible
solutions to the problem.

Dear Mr. Scott;
As a follow -up to our letter of October 27, 1994, we are writing to state our position
concerning the development of the property south of the Windmill Run subdivision.
The Chanhassen planners have developed 4 alternate plans for the site with 3 of the plans
including some or all single family homes. However the proposed developer's agent Brad
Johnson, will not consider any of those plans.
The city is in a position to negotiate the best plan using park, trail, road and storm water
fees, including any additional issues available to "juggle" so that single family homes are
incorporated into this plan_ We will quote Brad Johnson when we say "we don't care how
you have to juggle the numbers ".
Considering the city employees told us and many of our neighbors that single family
homes "lik -e our neighborhood" would be developed in this area and our willingness to
compromise, an alternate plan should be adopted. We find the developers derogatory
comments and attitudes toward the city, (elected officials and staff) offensive and question
how a quality development would proceed to fiuition. Knowing the developers plan to
maximize his profit margin as greatly as possible and our plan to have a continuation of
our neighborhood, we feel the optimum compromise would be detached single family
homes on smaller lots.
We believe the future of Chanhassen is to plan quality developments that benefit the city
' and its citizens. We should not allow this situation to degrade into litigation and waste our
tax dollars.

Dear Mr. Folch:
At the request of Barton - Aschman, a meeting was held on November 17, 1994 between the '
City of Chanhassen, Mn/DOT Metro Division, Mn/DOT Consultant Agreements Unit, and
Barton- Aschman to discuss the status of the referenced agreement. A history of the project
from inception to date was discussed and is shown in Attachment A. To allow both ,
community and project development to continue, a series of issues were discussed, including:
1. Mn/DOT must secure internal approval of the Arboretum Boulevard Environmental ,
Assessment (EA) and forward to FHWA.
2. A location public hearing must take place to select the preferred alignment of
Arboretum Boulevard. This hearing is planned for February 1995. '
3. Project letting for TH 5 has slipped to post -2000.
4. A metric exception has been requested. '
5. A pavement type determination has not been requested and has a 2 -year shelf life. '
6. Project has been programmed to include a segment from TH 41 to TH 25. These
project limits should be modified to include the CSAH 17 to TH 41 segment only.
7. The consultant was requested to continue with the drainage design and establish
final construction limits pending a selected alignment for Arboretum Boulevard. '
These tasks are a priority necessary to preserve the corridor.
8. Arboretum Boulevard will likely be constructed incrementally by the city prior to the
improvements to the TH 5 mainline.
In accordance with the subject agreement, Barton- Aschman Associates, Inc. hereby requests ,
an extension of time to complete the agreed upon work scope identified in Item? above.

Based on our discussions, it is agreed that an extension of time to June 30, 1995 would be an
appropriate request. Further review of project status will conducted at that time. A
supplemental agreement is not being requested at this time, however, this may become a
necessity should the consultant be requested to complete the contract documents in the

Dear Messrs. Gustafson and Thompson:
This letter is intended to bring attention to and solicit support regarding the ongoing safety
problems at the intersection of Trunk Highway-5 and County Road 19 (Galpin Boulevard) in
Chanhassen. I am confidant that a review of aeddent data for this intersection over the last five
years will show a steady increase in the number of occurrences with each passing year. This is
not surprising since residential development in the area is adding to the minor log volume counts,
the mainline volume on Trunk Highway 5 is increasing every day, and the sight lines at this
intersection are far less than adequate.
Earlier this spring, the City, in cooperation with the Chaska School District, began construction
on a new elementary school located in the +southeast quadrant of this intersection. Without
question, the concerns for safety at this intersection have magnified. As a result, the City made
application for ISTEA -STP funds to install a temporary traffic signal at this intersection given
that the schedule for the Trunk Highway 5 improvements between CSAH 17 and Trunk Highway
41, which would signalize this intersection, had been delayed until fall of 1998. Later this past
spring, despite being denied STP funds for the 94 -95 program, the City took a lead role position

and is now preparing plans to install the signalized improvements at this intersection as a part
of a local improvement project to reconstruct a portion of County Road 19 (Galpin Boulevard)
south of Trunk Highway 5 in 1995. In essence, the City will up -front the costs for this '
improvement with the understanding that the'96= 97 ISTEA -STP funding programs will reimburse
the City accordingly.
The anticipated local construction schedule forecasts that this temporary signal will be on line '
sometime in early August of 1995. Accidents continue to occur on a weekly basis at this
intersection. During the interim of nearly 9 months, it has been suggested that some advanced '
safety measures be taken such as a flashing beacon or additional signage, i.e. "accident
investigation site area" signage or some other measures be taken to make motorists aware of the
hazards at this intersection. '
Since this is an intersection of a county road and trunk highway, I am respectfully asking for
your help and request that both agencies investigate potential interim safety measures which can '
be implemented up until August of 1995 to improve safety at this intersection. Once you have
had time to review this matter, please contact me with your recommendation. I would also be
more than willing to sit down at a strategy meeting to discuss this matter in further detail. Your '
attention and cooperation to this matter is greatly appreciated.

Dear Mayor Chmiel:
I am writing you to express my continued frustration and distress concerning the
ongoing issue of Frank Beddor's personal attempts to redirect traffic on to Lake
Lucy Road. I am very tired of the continuous revisiting of same old issues and
arguments. Mr. Beddor's new access plans for Tower Heights is the same plan
rejected on very sound reasons in the past. The reasons include the steep grade
to Lake Lucy Road, and the limited access for the road between the existing
houses. Mr. Beddor even admits that the proposed road would require variances
for road width, and house setback requirements. This makes no sense
whatsoever.
The fact that Mr. Beddor's legal council would offer this proposal before the
upcoming hearing shows that he realizes he has no chance of winning in court.
He is bargaining from a very weak position, and he knows it.

I am outraged as a citizen of Chanhassen that Mr. Beddor would continue to
press his frivolous litigation in order to extort favors from the city. This is totally
outside of any ethical behavior that good citizens subscribe to. I realize that you
are vested with financial responsibility for the city. I also am a firm believer in
'
moral responsibility, as I am sure you are too. Giving in to this type of
irresponsible behavior only sanctions such practices now and in the future.

Please continue to exercise the good judgment that you have in the past.
Throughout this entire disgusting process my confidence in government has been
upheld in a positive manner by your actions. Thank you for continuing to do what
is right.
