A. Resolution Establishing Commission Appointment Procedures: The attached
resolution has been modified to reflect the general guidance provided to staff during
the work session of February 6 I "forgot to ask�tfie question, "Does the council wish
to have commissions intereview�ncumbents ?" If,the answer is no, No. 3 should be
changed to add the wordage 'new. Should wordage similar to No. 5 from the 1990
resolution be added? Approval as attached or as revised is recommended.

time. The number` of options open to the city council are limitless, i.e. informally

C. Southwest Metro Transit Board: The Southwest Metro Transit Board has requested
that the city appoint another member to the Transit Board. Councilwoman Dockendorf
currently sits on this board and they have requested that one additional council
member be appointed to serve.

A RESOLUTION ESTABLISHING PROCEDURES FOR FILLING
COMMISSION APPOINTMENTS
WHEREAS, City Commission members serve to research; conduct public
hearings, including sending notices of the hearings to effected parties and
listening /recording public comments from said hearings; and to review or visit similar
proposals /products/regulations in other cities/locations, etc, and
WHEREAS, it is important that each council member and council member- elect
has the opportunity to participate in the selection of commission members who are
citizens of the community serving in their commission capacity to provide advice to the
City Council as described above.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Chanhassen as follows:
1. That an advertisement announcing the Commission vacancies be placed
in the official newspaper twice after the first of the year. To ensure that
as many applications as possible are received, the ad shall make no
notation as to the number of encumbents seeking reappointment.
2. The terms for the Commissions will become effective April 1st.
3. Commissions shall interview all applicants for vacancies. Following the
interview process, the commission shall submit its recommendation to
the city council along with two additional candidates from which the
council may choose.

A RESOLUTION ESTABLISHING PROCEDURES FOR FILLING
COMMISSION VACANCIES
WHEREAS, it is important that Commissions never risk the
lack of a quorum; and
WHEREAS, it is important that incumbents know if they
are reappointed prior to the expiration of their term on December
31st; and
WHEREAS, it would be helpful for new appointees to have time
1 to become acquainted with their responsibilities prior to taking
office on January 1st.
1 NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Chanhassen as follows:
1. That an advertisement announcing the Commission vacancies
1 be placed in the official newspaper during the first week
in October and shall be published for three consecutive
weeks.
1 2. That after the third publication, applications shall
P9 remain open for another two week period.
1 3. Commission members interview applicants at their regu-
larly scheduled meeting just prior to Thanksgiving.
4. That the Council interview applicants at their first

regularly scheduled meeting in December. The Council may
interview all applicants or just those referred to it by

the Commission.
5. Incumbents who are reapplying for their position do not

need to be interviewed by the Commission members and

should not be involved in the interviews and selection of
their competitors. They do need to be interviewed by the
City Council.

a part of the Public Safety Commission, I can utilize my experience and knowledge
to its capacity. I do not have any hidden adgendas, and feel that the current

' Hennepin County Sheriff's Office Explorer Post #744 Advisor.. Lead advisior for
a volunteer explorer post affiliated with the Boy Scouts of America. Our post
consists of 24 teenagers from throughout Hennepin County. We are recognized
' as one of the top Minnesota posts at the annual explorer competition in April.
The post was nominated for the post of the year in 1994 and two of my members
have been named Explorer of the Year in 1992 and 1994. 1 was named Explorer
Advisor of the year in 1992. 1 also received the Boy Scouts of America Award
of Merit in 1993.
' In 1993, 1 attended the National Highway Traffic Safety Administration and IACP's
Drug Evaluation and Classification Training and became the first IACP certified

This memo is to provide the recommendations of the Public Safety Commission to the City
Council for appointments to the Public Safety Commission. Prior to our regularly scheduled
meeting on January 12, 1995, the Public Safety Commission did interview the three residents that
had submitted applications.
The Public Safety Commission has one existing vacancy because despite several ads being placed
in the paper, we received no applications to fill Commissioner Dave Johnson's position when he
resigned in 1994 because of a promotion at work that had him travelling more. Public Safety
Commissioners Bill Bernhjelm and Dave Dummer had terms that expired at the end of 1994.
I am pleased to report that after giving it a great deal of thought and consideration, both
Commissioner Bill Bernhjelm and Commissioner Dave Dummer have agreed to continue to serve
on the Commission. Dave Dummer has asked to complete Dave Johnson's term, which ends in
1996, and Commissioner Bernhjelm has agreed to continue on for another full three year term.
The Public Safety Commission strongly recommends that the City Council reappoint these two
Commissioners, as both have provided a very, great deal to the Commission, and to the City.
Both have not only become knowledgeable as to all aspects of the public safety service delivery
system in Chanhassen, but have taken advantage of opportunities to become personally
acquainted with the Public Safety staff, Carver County deputies, and representatives from the
other emergency response organizations that serve our City and therefore truly have a personal
knowledge of the system that they advise the Council on.

The three residents that submitted applications to the Commission all are excellent candidates.
The only differentiating factor between Mr. Labatt and the other two candidates is that Mr. Labatt
does have a background in emergency services and law enforcement, and is presently working
as a Deputy Sheriff for the Hennepin County Sheriff's Water Patrol Division. After the
interviews the Commission discussed at length the pros & cons of recommending either someone
with public safety experience or a resident with no background in this area. While we
acknowledged discussion at the Council level about the benefits of having an appointee that has
no background in these areas, we do not feel that we can discount the valuable input that Mr.
Labatt would bring, particularly considering his expertise in the area of water safety, snowmobile
safety, and other special knowledge (dealing with noise pollution, traffic safety, drugs, boating
instruction, emergency response, etc.). With the continuing concerns that we are hearing from
the public on snowmobiling and boating safety issues, Mr. Labatt's experience & expertise
simply cannot be ignored. Therefore, the Commission is unanimously recommending that Mr.
Labatt be appointed to the three year term position that is open.
The Public Safety Commission intends to continue to consider creating additional volunteer
positions to enhance the public safety system in Chanhassen, one of which is the development
of a volunteer emergency management group which we hope to implement this year. We think
that either of the other two applicants would be excellent additions to this group. Also, either
of these applicants would be excellent alternates should a position need to be filled on the
Commission.
RECOMMENDATION
It is the unanimous recommendation of the Public Safety Commission that Bill Bernhjelm be
reappointed for another three year term; that Dave Dummer be reappointed for the two years
remaining on Dave Johnson's term; and, that Steve Labatt be appointed for the remaining three
year term.

All vacancies on committees, commissions, and boards shall be advertised to seek appli-
cants. The city council may interview applicants before making appointment. With the
exception of the housing and redevelopment authority, all appointments shall be by majority
vote of the city council. Once appointed, an applicant shall serve until removed, with or
without cause, by a four - fifths vote of the city council, until the expiration of the term of

Sec. 2 -68. Members.
§ 2 -70
(a) The public safety commission shall consist of seven (7) voting members. One (1) of the
members shall be appointed by the city council from among its own members. The other
members shall be residents of the city who are neither city officials, employees of the city or
employees of the police agency.
(b) The term of the councilmember of the commission shall be three (3) years, or such
shorter period of time as may coincide with the councilmember's term of office as a member of
the city council.
(c) Commission members shall hold office until their successors have been appointed and
qualified. Each vacancy in an unexpired term shall be filled in the same manner in which the
original appointment was made.

Sec. 2.69. Organization meetings and finances.
(a) The public safety commission, shall elect a chair and acting chair from among its
members for a term of one (1) year. The chair shall preside at all meetings of the commission
and at each meeting, the chair shall submit such recommendations and information as the
chair may consider proper concerning the business, affairs and policies of the commission. The
city manager or the city manager's designee shall act as secretary to the commission, but shall
not be a member.
(b) The commission shall hold at least one (1) regular meeting each month. It shall adopt
rules for the transaction of business and shall keep a record of its resolutions, transactions and
findings, which record shall be a public record.

Sec. 2 -70. Functions.
The public safety commission shall assist the public safety director in preparing a work
program outlining activities it proposes to undertake. The program may include:
