The Metropolitan Council has established a revolving loan fund to assist local governments in
purchasing right -of -ways within the state trunk, , highway system in advance of the actual
construction of these highways. These loans .bear no interest and are repaid at the time that
the state highway department purchases the property from the local government. - The
repurchase price is the same price established at the time of the purchase of the property by
the local government.
The approval of the resolution merely ,permits staff to initiate the process for applying for an
advanced RALF loan. After applying, the Metropolitan Council gives preliminary approval
for the use of the RALF program. ;;'If preliminary approval is granted, the application is
forwarded to the Minnesota Department of Transportation or review. After receiving
preliminary approval, the City must obtain and submit to the Minnesota Department of
Transportation an appraisal of the property for certification. After certification of the
appraisal, the City may initiate negotiations for the purchase of the property with the property
owner. The City then makes final application for the loan.-, The Metropolitan Council has to
give final approval to use the loan for the purchase of the right-of-way.

The City of Chanhassen will have to front some funds as part of the process including
appraisal costs ranging from $5,000 to $10,000, title search costs, tax payments, etc.
However, these monies are then recoverable as part of the loan amount that is eventually
repaid when the state purchases the property fito ri the City.
The property included for acquisition as part of this resolution is located on the south side of
Rice Marsh Lake approximately 642 feet west of the eastern city limits of Chanhassen and
Eden Prairie. The total area to be acquired consists of approximately thirty (30) acres of
which about half is developable and half is marsh land. The property includes the actual

right -of -way for Highway 212 (consisting of 6.167 acres) and a piece of property north of the
highway that staff believes will be severed by the highway and thus lose its economic value
(consisting of approximately 9 acres of developable land and 14 acres of wetland). This
additional property is designated as parks and open space in the City's 2000 Land Use Plan.
The estimated loan amount is about $350,000. We believe that this request can serve two
purposes. The first is the protection of the Highway 212 right -of -way and at the same time
responding to the financial problems the corridor designation has created for a land owner.
The second is reserving a unique natural resource for future use by the City.
The City of Chaska has quite successfully used RALF funds to purchase large portions of the
Highway 212 corridor in their jurisdiction, even though that segment of Highway 212 is
planned for after the section in Chanhassen. In this same vein, staff anticipates that this
property will be the first of many that the City attempts to purchase with RALF funds.
Contingent on the City Council's approval, staff will review the entire Highway 212 corridor
in the City and put together a list of property owners to be contacted to see if their properties
could be purchased through this program.

Monies to Acquire a Portion of Highway 212 Right -of -Way and Excess Property
In November 1993, Mr. Ernie Peacock, representing the subject property, contacted the city
informing us that his clients were interested m . selling this property. Mr. Peacock is a
commercial/industrial realtor with Edina Realty. The city's role in this proposed real estate
transaction is born from the fact that the parcel is severed by the Highway 212 right -of -way and
the land north of the right -of -way is identified for preservation as park/open space. It is Mr.
Peacock's desire to sell the southerly 22.4 acres to a private developer and market the rest to the
appropriate buyers.
The Planning staff, Bob Generous in particular, and I have been communicating with Mr.
Peacock in this regard. In concept,` the use of RALF funds to acquire the right -of -way and the
excess property to its north is fine. One unknown at present, however, is whether or not MnDOT
will in fact classify the severed parcel north of the right -of -way as excess and include it in their
acquisition. The authorization to proceed with a RALF application is needed to keep on track;
however, if MnDOT determined the "north" property to be serviceable, the city will have to re-
evaluate our position.

WHEREAS, Highway 212 has been designated by the Metropolitan
Council as part of the Metropolitan Highway System Plan; and
WHEREAS, the City Council has officially mapped the right -of-
way for Highway 212; and
WHEREAS, if the City does not acquire the right -of -way at this
time the property will increase in value before highway
construction and advance acquisition is also necessary to avert the
imminent conversion of the property which would jeopardize its
availability for highway construction.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Chanhassen:
1. City staff is authorized and directed to submit a loan
application to the Metropolitan Council to fund the
right -of -way acquisition for Highway 212. -
2. City staff and the City Attorney are directed to enter
into negotiations with landowners to acquire the right -
of -way for Highway 212.

As you are aware, I represent a 52 acre parcel of land in your city.
There is currently an offer for 22.4 acres of land, which represents all of
the land to the South of a proposed taking for Highway 212.
My suggestion would be to have the Highway Department or some other
entity acquire all of the remaining land to the North. The offer I currently
have in hand calls for a per acre purchase price of approximately $23,000
per acre. The prospective buyer has indicated that they would acquire the
entire 52 acre parcel if not for the proposed highway taking.
I would like the Highway Department or some other entity to acquire all
of the land to the North of the South line of taking. I have discussed this
matter with Mr. Adeel Lair, Right of Way Engineer for the Department of
Transportation. Mr.Lair has reviewed my request and has given his support
to the acquisition. It would, therefore, seem appropriate to move forward
with negotiations dealing with the acquisition of this land. The buyer for
the South 22.4 acres would like an answer to his offer as quickly as possible
but we would not.be in a position to respond to his offer until we know the
disposition of the land to the North. Could you meet with the appropriate
agencies and advise me of the result of such meetings. Time is of the essence
in this matter so I hope we could have some in -put within the next 10 days.

Subd. 2. LOANS FOR ACQUISITION. The council may make loans to counties,
towns, and statutory and home rule charter cities within the metropolitan area for the
purchase of property within the right -of -way of a state trunk highway shown on an
official map adopted pursuant to section 394.361 or 462.359 or for the purchase of
property within the proposed right -of -way of a principal or intermediate arterial
highway designated by the council as a part of the metropolitan highway system plan
and approved by the Council pursuant to subdivision 1. The loans shall be made by
the Council, from the fund established pursuant to this subdivision, for purchases
approved by the Council. The loans shall bear no interest. The Council shall make
loans only: (1) to accelerate the acquisition of primarily undeveloped property when
there is a reasonable probability that the property will increase in value before highway
construction, and to update an expired environmental impact statement on a project
for which the right -of -way is being purchased; or (2) to avert the imminent conversion
or the granting of approvals which would allow the conversion of property to uses
which would jeopardize its availability for highway construction. The Council shall not
make loans for the purchase of properly at a price which exceeds the fair market
value of the property or which includes the costs of relocating or moving persons or
property. A private property owner may elect to receive the purchase price either in a
lump sum or in not more than four annual installments without interest on the deferred
installments. If the purchase agreement provides for installment payments, the
Council shall make the loan in installments corresponding to those in the purchase
agreement. The recipient of an acquisition loan shall convey the property for the
construction of the highway at the same price which the recipient paid for the
property. The price may include the costs of preparing environmental documents that
were required for the acquisition and that were paid for with money that the recipient
received from the loan fund. Upon notification by the Council that the plan to
construct the highway has been abandoned or the anticipated location of the highway
changed, the recipient shall sell the property at market value in accordance with the
procedures required for the disposition of the property. All rents and other money
received because of the recipient's ownership of the property and all proceeds from
the conveyance or sale of the property shall be paid to the Council. If a recipient is
not permitted to include in the conveyance price the cost of preparing environmental
documents that were required for the acquisition, then the recipient is not required to
repay the Council an amount equal to 40 percent of the money received from the loan
fund and spent in preparing the environmental documents. The proceeds of the tax
authorized by subdivision 3, all money paid to the Council by recipients of loans, and
all interest on the proceeds and payments shall be maintained as a separate fund.
For administration of the loan program the Council may expend from the fund each
year an amount no greater than three percent of the amount of the authorized levy for
that year.

It would appear that our best chances for getting T. H. 212 built in the reasonably near future
are going to be: .
1. Because either MNDOT or a joint powers agency ( "local authority ") decides to
build the project through toll financing; or
2. Because the 212 Project is "ready to go" and is advanced in priority because
higher priority projects are not "ready to go ". I believe the more right -of- -way
which has been acquired, the more "ready to go" the T.H. 212 project will be
considered to be.
We commend the City of Chaska for their aggressive efforts to acquire right -of -way. We hope
that to the extent that they have not previously done so, the Cities of Eden Prairie and
Chanhassen and Carver County will begin to aggressively pursue such acquisitions until all
necessary parcels have been acquired.

I appreciate this opportunity to respond to your inquiry concerning the Trunk Highway (TH) 212
project and the recent announcement of statewide transportation project deferrals affecting the '
work schedule of the project.
Your description of the highway's deficiencies and the needs facing the surrounding communities '
are accurate and on target. Improving safety, relieving congestion, meeting area population
growth and enhancing the region's overall economy were the principal reasons supporting
Mn /DOT's initial decision to pursue improvements on TH 212.
As you are aware, just last month, Mn/DOT announced its 1994 -96 State Transportation ,
Improvement Program (STIP). Although Mn /DOT plans to invest $1.7 billion over the next
three years for more than 1,500 state transportation projects, the new program level is still $234
million less than previous Mn /DOT estimates. The smaller program reflects the reality of no
state revenue increase and lower than anticipated yearly federal funding levels of the ISTL - -A.
Unfortunately, the result has been that 315 construction projects previously scheduled to begin
in 1994 -96 have been deferred. In short, the department simply lacks the resources necessary '
to address all of the projects we and the local communities would like to pursue. As I am sure
you can appreciate, we are faced with making some very difficult choices, and the path we are
taking is to focus our limited resources on the most critical priorities.

In working to determine the priorities for the State Transportation Improvement Program (STIP),
' Mn /DOT instituted a new process where transportation investments are prioritized through the
work of eight Area Transportation Partnerships (ATPs). Generally, as the work of the ATPs
played out, safety and the preservation of existing transportation facilities emerged as their
' highest regional priorities. Unfortunately, despite their significant merits, many expansion
projects including TH 212 had to be deferred to meet the more compelling safety and
preservation needs of the region. You can be assured however, that Mn/DOT will continue to
' carefully monitor the progress of projects in the current program and if the opportunity arises,
deferred projects will be moved forward as quickly as possible.
' On a more positive note, Mn /DOT fully intends to continue our commitment to the TH 212
project by encouraging the use of the Right of Way Acquisition Loan Fund (RALF) offered by
the Met Council to preserve right of way in the corridor. Additionally, two projects on
Technology Drive are scheduled for contract letting in 1994 and 1995 and the department will
continue to work closely with Southwest Metro Transit in developing the Eden Prairie Transit
Hub.
To its credit, the Southwest Transportation Coalition,
spo under the leadership of Bob Lmdall, is
exploring a variety of alternative financing approaches, including toll roads, local borrowing
through bond sales, state bond guarantees and other promising funding options. With the reality
of increasing needs, stagnant funding levels, and increasing competition for available funds,
Mn /DOT is supporting and encouraging exploration of alternative financing mechanisms as a
means of achieving long overdue projects like TH 212. To this end, I applaud and offer my full
support for the work the Coalition is undertaking.
