Mr. Petersen operates Guy's Grill in the Mark Shopping Center and has done so for
the past 2 years. Mr. Petersen currently holds "an on_ ale beer and wine license.

Guy's Grill occupies approximately 2,300 square feet , nd seats 96 people. Mr. Petersen has
no intention of expanding or remodeling hip' restaurant to include a bar area. He simply
wants to be able to offer customers a mixed drink with their meal. As can be seen on the

Issuance of a liquor license is at the sole discretion of the city council. The council may
approve or deny requests for on -sale licenses without stating their reason. If the council
chooses to issue the license, staff will ensure that we receive the liquor liability insurance
certificate, $5,000 bond, and that the license fee of $6,115 is collected.

To Whom it May Concern,
This is a request to upgrade our "on sale" beer and wine license to an "on sale'
intoxicating liquor license. The need of this is due to the sudden outbreak of resTaurants
entering the area (especially Wendy's, in my parking lot, with a drive -thru window).
Local businesses cannot compete head -on with the national chains' constant TV
advertising.
Our intention is to try to do something that sets us apart from the others. This is an
effort to try to survive and keep our doors o..pen after 25 years in this town. The plan is
to add only a service bar in hopes of increasing our dinner business. Promoting more of
our Mexican items along with margaritas, is the general idea.
We do not intend to turn it into a "bar -bar" and our hours will remain regular food service
hours only.
Does the city realize all the restasurants they are allowing in Chanhassen? It seems to
me, all other types of businesses are controlled, e.g.: liquor stores, gas stations, car
washes, etc. The number of restaurants should be also.
Page two contains the eating establishments that are now or will be available to a mere
population of about 14,000 people.
The liquor license application is enclosed with this letter as is the $250.00 fee for the
completion of a background investigation.

NOTICE IS HEREBY GIVEN that the Chanhassen City Council will hold a public
hearing on Monday, March 13, 1995 at 7:30 p.m. in the Council Chambers at 690 Coulter
Drive, to consider an application from Guy's Grill for an on -sale intoxicating liquor license.
Guy's Grill restaurant is located at 7874 Market Boulevard in the Market Square Shopping
Center.
All interested persons may appear and express their opinions regarding this application

Dear Guy:
We understand that you have made application to the City of
'
Chanhassen for an On Sale Intoxicating Liquor License.
Unlike your plans last year, when we had conversations on
this topic, we understand that you do not plan to expand the
size of your restaurant.
'
That being the case and in the interest of alleviating our
concerns and the concerns of some of the tenants which have
been expressed to us, we want to pass on to you our
observations.
1. We understand your reasons for wanting the ability to
'
serve drinks to your customers in order to increase your
food sales. If you are successful in obtaining the license
we sincerely hope that the effect will be just that. We
also laud your apparent decision to return to placing
'
emphasis on your Mexican menu, where you have a proven
reputation.
' 2. The issuance of this license would be setting a
precedent for Chanhassen. There are no other On Sale
Intoxicating Liquor Licenses issued to occupants of a
' shopping center. The effect of this licensing cannot be
taken lightly. In a shopping center setting the activities
of one tenant have a direct impact on the well -being of
' adjacent tenants. For that reason, permitted use of leased
space by tenants is carefully spelled out in lease documents.
Your lease does not specifically preclude operating clith a
' full -scale liquor license, but you are limited to using your
space as a "Restaurant or any lawful use which does not
conflict with other tenants in the Center." Other tenants
' of the Center have expressed concern over potential parking
problems, potential rowdiness and potential additional
litter. The occurrence of any of the events which have been
' brought to our attention would constitute a use which would
be in conflict with the use of the Center by other tenants.

If your hours are to stay the same as the are now, as you
stated in your letter to the City, and if, as you also stated,
you will be serving liquor only along with your food service,
it may be that none of the potential problems will occur. We
therefore assume that you do not plan to advertise "Happy Hours ",
or to otherwise exclusively promote the sale of alcoholic
beverages.
Further as to use, we need to remind you that your lease
provides that use of the premises in such a manner that the
landlord is required to pay any additional insurance premiums
constitutes a default in your lease agreement.
3. While we note that you do not intend to turn your
establishment into a "bar- bar ", your letter to the City
states that you intend to add a service bar. This is to
remind you of the condition in your lease which states that
you may not make any "alterations to the Premises or any part
thereof without first obtaining the written consent of
Landlord." In that connection, we will not approve any
alterations which would designate a bar area other than that
which might be a space from which your personnel can mix and
pick up drinks for service to customers - -in other, words, no
customers' bar would be approved.
Guy, Chanhassen is a community comprised of young families
with young children and Market Square must be user - friendly
to those folks. They are the customer base of the Shopping
Center. The merchants there have worked hard to promote that
image and to promote their individual stores to those
customers. It is our hope that you and each and every one of
the rest of the tenants (several of whom are today succeeding
far beyond projections) can continue successfully. We hope
that you fully appreciate the added burden of responsibility
the receipt of the On Sale Intoxicating Liquor License will
place on your shoulders.

SUBJ: On -Sale Intoxicating Liquor License Request, Guy's Grill
In regard to the request from Guy Petersen for an on -sale intoxicating liquor license, this
office has no problem with issuing the license under the guidelines suggested in Mr.
Petersen's letter of February 8, 1995. However, I would be concerned if this establishment
was converted into a traditional bar. I believe that the ; city would be faced with noise, traffic
and litter problems if such a conversion took place.
It is my recommendation that the issue be carefully reviewed and that if the council chooses
to grant the license, that conditions of approval include a statement that prohibits the space
from being converted into a traditional bar.

' I am concerned about the request you have received that an intoxicating liquor license be
granted for Market Square Shopping Center. While rm not opposed to another such
license for the city, I am to this particular location.
' There are already liquor five on sale establishments

' within walking distance from Market Square. I don't think adding one more to this
location will benefit the shopping center as a whole. This would also be the first one
placed in the middle of a retail center. All the others are free standing buildings except
' the Dinner Theater's.
While the applicant says he does not intend to turn Guy's into a "bar- bar ", what will keep
' that from happening if this new direction does not make them successful? Will he no t

Like Guy's, we at Festival Foods and the other businesses of Market Square have been
faced with competition. I think we have all met the challenges very well.
