Minnesota Statutes Chapter 473H.04 Subdivision 2 states that "land shall cease to be eligible for designation as an agricultural preserve when the comprehensive plan and zoning for the land have been amended so that the land is no longer planned for long term agricultural use and is no longer zoned for long term agricultural use, evidenced by a maximum residential density permitting more than one unit per 40 acres." The property at 1551 Lyman Boulevard is located in the 2005 Metropolitan Urban Service Area, is zoned Agricultural Estate District, which permits a lot area of 2.5 acres, and is guided for Residential - Low Density (net density 1.2 - 4.0 units per acre) and Residential Medium Density (net density 4.0 - 8.0 units per acre). The property owners, Mr. George C. Dorsey, Jr. and Mr. Rick Dorsey, concur in the removal of the property from the Agricultural Preserve. Once the property is decertified as an Agriculture Preserve, the status will expire eight (8) years after the property owner is notified. Until the Agriculture Preserve expires, the property may not be connected to public sanitary sewer or water systems. Additionally, public sanitary sewer and water systems built in the vicinity of agricultural preserves are deemed of no benefit to the land and buildings in agricultural preserves. Notice of the hearing for the adoption of the resolution was published in the Chanhassen Villager on ~Iuly 24, 2003. RECOMMENDATION Staff recommends adoption of the following motion: 'The Chanhassen City Council approves the Resolution Certifying Certain Property in the City of Chanhassen as no longer being Eligible for Agricultural Preserve Status."
