Set 2001/02 Liquor ' '~ ~
In February of each year the council establishes liquor license fees for the
upcoming license renewal period. Chanhassen's licensing period runs front
May 1 through April 30th annually.
Prior to the adoption of our new liquor ordinance last summer, fees were based on
the square footage of the building (excluding kitchen area, restrooms, and
hallways) and whether the business was primarily a restaurant (at least 60% of
gross sales from food) or a bar (less than 60% of gross sales from food). The
current ordinance requires that all establishments (except exclusive liquor stores
established prior to May I, 2000) have at least 50% of their gross food and
beverage sales be from the sale of food. The onlysite having an exclusive liquor
store license prior to May 1, 2000 is the High Timber Lounge. [As a point of
clarification, an exclusive liquor store is a "bar," while an off-sale intoxicating
liquor store is a "bottle shop."]
Attached is a list of our license holders and their cu~em fees, as well as a license
fee survey from eleven communities. As can be seen from the survey,
Chanhassen's on-sale intoxicating liquor license fee remains on the high end. The
beer and wine license fee and on-sale non-intoxicating license fees may appear
low, but when considering the types of establishments that hold these licenses
(Na' s Thai Cafe, Guy's, Byerly's and Happy Garden, Bluff Creek Golf Course,
RSS Golf), the fees seem appropriate. State Statute establishes the license fees for
club licenses, Sunday Sales, and off-sale intoxicating licenses.
No increase was proposed as a part of the 2001 Budget. The last time that fees
were raised was in 1994 (4% increase). A notice has been sent to liquor license
holders advising them that the city council will be establishing fees on this date.
RECOMMENDATION
Staff recommends that license fees remain at the same level as last year, as
depicted in the attached resolution.
