The development contract allows for the issuance of such certificates when the project is completed. Staff has reviewed the files and finds the project complete and in compliance with the development contract. A ~reat o/ace to live. work. a,d olay. - CERTIFICATE OF COMPLIANCE CERTIFICATE OF COMPLIANCE granted March 12, 2001 by the CITY OF CHANHASSEN, a Minnesota municipal corporation ("City"). WHEREAS, the City entered into that certain Development Contract dated June 22, 1998, between the City and BLUFF CREEK PARTNERSHIP filed October 8, 1998, as Abstract Document No. 236214 in the office of the County Recorder, Carver County, Minnesota (the "Development Contract"). WHEREAS, the City has been requested to issue a Certificate of Compliance pursuant to that certain Development Contract concerning Bluff Creek Corporate Center, Carver County, Minnesota (hereinafter "subject property"); and WHEREAS, the development work has been completed and the City has determined that it is appropriate to issue such a certificate. NOW, THEREFORE, BE IT RESOLVED BY THE CHANHASSEN CITY COUNCIL: 1. Except as set forth in Section 3 of the Certificate, the subject property described above is in compliance with the requirements of said Development Contract. 2. The subject property is hereby released from the financial obligations created by the aforementioned Development Contract with the exception of unpaid park charges and o special assessments that have been levied or are pending against the subject property, if any. Barring any further documentation requirements from the Federal Emergency management Agency (FEMA), the following condition appears to have been met: The developer shall notify the Federal Emergency Management Agency (FEMA) regarding amendment to the existing flood plain boundary. The developer will be responsible for providing FEMA the necessary documentation to have the Federal Flood Plain maps changed to reflect developed conditions. CITY OF CHANHASSEN BY: Linda C.
