Approve Plans and Specifications for BC-7 and BC-8 Improvement Project;
Authorize Advertisement for Bids - Project No. 00-01
Plans and specifications for the above-referenced project have been completed and are on file in
the Engineer's Office. City Council is requested to approve plans and specifications and
authorize advertisement for bids for the project. In addition, Council is requested to authorize
easement and right of way negotiation and approve the attached resolution to authorizing
condemnation.
The City intends to negotiate for purchase of the easements, however, due to the tight time frame
and condemnation for Highway 5 right of way acquisition,. Staff is recommending that '
condenmation be authorized concurrent with authorization to negotiate.

This item would normally be considered under the consent agenda, however, action on the
Arboretum Village development has direct impacts on the trunk sanitary sewer assessment, which
is based on the number of units constructed. The lateral sewer assessment is based on footage and.
is not impacted by the number of units. - ·

The project includes the following elements:
· Extension of trunk sanitary sewer from Galpin Boulevard to west of Trunk Highway 41.
· Extension of trunk water from W. 78th Street to west of Trunk Highway 41.
· Bid alternate for extension of sanitary sewer forcemain to serve the Dogwood Road
mound system (the property owners contend the existing mound system is not failing.
The bid altemate allows the City flexibility at the time of bid award and allows the
project to continue to progress while the mound system is investigated.)
· Bid alternate for road improvements to Tanadoona Drive (Westwood Community Church
has requested an alternate alignment for the trunk utilities that impacts the road. If this
alternate is awarded, the cost will be assessed to Westwood Community Church.)

RESOLUTION AUTHORIZING CONDEMNATION
OF EASEMENTS FOR PUBLIC PURPOSES
WHEREAS, the City Council of the City of Chanhassen does hereby determine that it is
necessary and for a public use and purpose to acquire the easements described on the attached
Exhibit "A" for public sanitary sewer and temporary construction purposes in connection wit-h
Improvement Project No. 00-01, BC-7 Trunk Sanitary Sewer and BC-8 Trunk Sanitary Sewer
mad Lateral Watennain; and
WHEREAS, City staff and consultants have and will continue to work with the property
owners to acquire the easements; and
WHEREAS, the City Council finds that development and construction conditions related
to the area make it necessary to acquire title to, and possession of, the easements as soon as
possible in order for the project to proceed in an efficient, cost effective and expeditious manner;
NOW, THEREFORE, be it resolved by the City Council of the City of Chanhassen,
Mi~mesota:
1. That the City Attorney is authorized to commence eminent domain proceedings
pursuant to Minnesota Statute Chapter 117 to acquire sanitary sewer and temporary construction
easements described on the attached Exhibit "A".
2. That the City Attorney is authorized to acquire the necessary property interests
pursuant to the "quick take" provisions of Minnesota Statute § 117.042.
3. That the Mayor and the City Manager are authorized to execute all documents
necessary, in the opinion of the City Attorney, to effect the acquisition of the necessary property
interests.
