It seems we have been getting an increasing n�rl" r of requests for providing officers at school
events to help with security issues, and I a appy to continue to provide this. If we have
people available who are on duty, I am happy to have them provide drive bys and walk throughs;
however, if you are interested in hiring an off -duty officer to be specifically assigned to an event
(dances, sporting events, etc.), please let me know as far ahead of time as possible so that we can
make these arrangements. For your information, the going rate for an off -duty police officer is
$25 per hour, and there may be additional costs this year for the cost of a squad car (we certainly
do not have to provide a squad car if this does not fall within the realm of your needs). There
may also be a change in the future on fees, but we'll let you know on that.

Because of the increased requests for crime prevention services, I am hoping to develop a formal
'
crime prevention program for 1995, which will include a full-time crime prevention specialist.
Of course, my challenge in developing this position is the same as your challenges: Budget!
Hopefully, the City Council will endorse this concept as we proceed through the budget process
'
for next year. There are some really exciting concepts I am working on as far as programming
for different grade levels, and I am very pleased that we have received a donation from the
Chanhassen Lions to purchase a vehicle that will be specifically assigned to crime prevention.
,
I will keep you apprised of this effort as it continues, as I would hope we could increase the
crime prevention efforts we have provided for you in the past.
,
The SOUTHWEST METRO DRUG TASK FORCE continues to be available as a resource to
you, if not on particular concerns, as a training resource for your faculty. If you are interested
in having a representative from the Task Force attend a staff meeting or training session, please
let me know and I will be happy to make these arrangements.
Finally, we do have SAFE ZONE Neighborhood Watch signs available for your school property
'
if you would like. I am going to attach a copy for you to see. I ordered these realizing that the
reference to drugs and weapons may be strong enough that a school may not want to give out
'
this sort of message; however, I also wanted them on hand if you would like to have them posted
in or around the school to advise people that there are increased penalties for violating these
laws. Of course, I will leave it up to you whether you wish to utilize this signage to make such
'
a statement, but if so I will be happy to have them provided to you and installed at no cost.
As always, I remain available to provide you, your staff and, most importantly, the children with ,
whatever resources we can provide. As the City of Chanhassen continues to grow, so do the
requests for services, which we sometimes find difficult to meet (but as always, if we can't
provide resources I will be honest about that with you), but our sincere desire remains present! ,

background to the Assertions presented in the August 2
petition for appeal by Twin Cities Trout Unlimited.
Assertion I.A. The Department of Natural Resources contends
' that the delineation conducted by the SWCD did not define the
limits of the DNR Protected Wetland (70 -245W) and the
Protected Watercourse (Eagle Creek) that are present on the
' site. The delineation showed the outer extent of the wetland
areas present on site and subject to the procedures contained
in the Wetland Conservation Act and promulgated rules. The
extent of DNR jurisdiction is defined as the Ordinary High
' Water mark and would lie within (waterward) of the wetland
line delineated by the SWCD. The map identified as preferred
Alternate 'A', dated 2/2/94, and contained in the Wetland
Conservation Act EQB Monitor Notice dated May 12, 1994,
-indicates that since no filling or draining is proposed in
the area identified as Wetland 2, that there is no need to
make any determination of whether DNR permit is
necessary. It appears that - avoidance has been achieved in
' this area of the proposed plat. The Department has informed
both the City of Shakopee and the developer of the need for a
Department permit for crossing Eagle Creek.
DNR Rules 6115.1030 and 6115.1070 are cited in regards to
this assertion. These rules have had no standing since 1979
with passage of Laws of 1979, Chapter 199 that amended the
procedures utilized by the Department to prepare the
Protected Water Inventory.
The M.S. 103E.011 reference cited in the assertion implies
' that a county or judicial drainage ditch authority has
jurisdiction over Eagle Creek. This is not true. Eagle
Creek is identified on the Protected Water Inventory Map and
List for Scott County due to its designation as a Trout
' Stream.
Assertion I.B. The SWCD identified several wetlands in
' and /or adjacent to DNR Protected Wetland 70 -245W but did not
represent that one or several of these wetlands represented
the Ordinary High Water Mark for 70 -245W. Again, since the
proposal being presented does not involve any filling or
draining of any of these noted areas, there is no need to
make a DNR jurisdiction call as avoidance has been achieved.
Assertion I.C. The September 8, 1993 report Peter J. Bekius
prepared for Klaas Van Zee specifically mentions that
Wetlands 2, 3 and 4 are found in the vicinity of a DNR
wetland and that Mr. Van Zee was informed as being
responsible for contacting the Department, the Army Corps of
' Engineers, the Minnesota Pollution Control Agency and
Shakopee for to see if the proposed activity falls under any
of these jurisdictions.
The Department was provided copies of the proposed
development dated 9/13/93, and provided comments to the City
of Shakopee on November 4, 1993, indicating that Wetland #2
is DNR regulated, that fill in a DNR protected wetland is
prohibited, and recommending that a comprehensive stormwater

management /drainage plan be considered because the Eagle '
Creek Bluff proposal is in a sensitive area which includes
the headwaters of a trout stream. A December 21, 1993 letter
to Mr. Klaas Van Zee acknowledges that the proposed Eagle
Creek Bluff Drive is just outside the limits of Wetland 12
(DNR Wetland 70 -245W) and recommending that if design
standards allow, that a greater separation between the toe of
the road to the wetland be maintained. The crossing of Eagle ,
Creek is also addressed in this letter by stating that a DNR
permit will be required and indicates that permit application
materials had already been forwarded. Copies of the above
referenced November 3, 1993, and December 21, 1993, letters '
are attached.
Assertion I.D. The Wetland Conservation Act identifies the
'
role Soil and Water Conservation Districts can assume in
'
administration of this Act. The City of Shakopee is the
identified Local Government Unit that has accepted,
responsibility for administration of the Act, and as such,
'
has responsibility for review of wetland delineations made
pursuant to development of wetland replacement plans.
Technical questions that arise regarding questions of public
values, location, size and type can be referred to the
Technical Evaluation Panel, one member of which is a
technical professional employee of the Soil and Water
'
Conservation District.

Since the proposal considered by the City of Shakopee not
involve any activity within the wetland area subject to DNR
'
permit jurisdiction, there was no need to involve the DNR and
the question of the City having the jurisdiction to approve

alterations within a DNR protected area is not relevant.

Assertion 2.8. The field notes are available for inspection.
The accompanying map does indicate that Mr. Beckius
delineated Wetland #6 and Wetland 02 as separate wetland
areas. The attached letters mentioned in Assertion I.C.

indicate that the Department considers Wetland #2 as DNR
Protected Wetland 70 -245W.
Assertion 2.C. The Department recognizes the competence of
Mr. Beckius in his delineation of the wetlands involved in
this proposal. The Department believes that Mr. Beckius
would of noted any outlets from Wetland #6 he would of

observed while delineating the wetlands found on this site. ,
The Department of Natural Resources emphatically states that
WCA definitions are not applicable for determining the
'
boundary of Protected Wetland 70 -245W. These boundaries are
determined using procedures developed by the Department using
the definition of "Ordinary High Water Mark" as noted in
M.S. 103G.005, Subd. 14.

The Department, in previously referenced correspondence, has
indicated to both the City of Shakopee and Mr. Van Zee that
Wetland #2 is the DNR Protected Wetland 70 -245W. The
proposed expansion of Wetland #6 is not viewed as an
' expansion of DNR Protected Wetland 70 -245W. The Department
currently does not regulate tributaries to designated trout
streams as Protected Waters. This matter is currently
subject to the lawsuit brought by Trout Unlimited against the
' Department. Resolution of this lawsuit has not yet taken
place.

This letter serves to follow up our phone conversation of December
20, 1993 relative to the proposed Eagle Creek Bluff development in
Shakopee, Minnesota. As you may recall, we discussed the contents
of my November 4, 1993 letter to Terris Sandbeck of the City of
Shakopee and the revised preliminary grading and utility plan I
received from you December 20, 1993.
The Department of Natural Resources (DNR) is not opposed to the
project as proposed. I'd like to discuss some of the comments I
made in my November 4 letter.
With respect to Eagle Creek Bluff Drive, I acknowledge the road
being just. outside the limits of Wetland 12 (DNR Wetland #70- 245W).
If design standards allow it, it would be preferable to maintain
greater separation from the toe of the road to the wetland. If
not, it is acceptable in its present location provided it is indeed
outside the limits of the wetland. The crossing of Eagle Creek
also requires a DNR permit, as you are aware. I forwarded you the
appropriate application materials recently under separate cover.
Another comment I made was the suggestion that Wetland 02 was
identified on final drawings as DNR Wetland 070 -245. There should
be no opposition to this. Although not a requirement, I also
suggest easement or restrictive covenant language for Lot 14, Block
3, around DNR Wetland 170 -245. It would help assure that the
wetland area is not graded, filled, or vegetation cut off of it.
After writing about stormwater management, I found the runoff
calculations prepared by Ryan Contracting. The findings appear
reasonable. Provided the city engineer approves of the runoff
calculations and proposed ponding volumes, I accept the runoff
management as depicted. If the city engineer deems it necessary to
provide additional ponding, it should be incorporated into the
plans.

I have reviewed the materials submitted relative to the proposed
Eagle Creek Bluff P.U.D. in your community, and offer the following
comments for consideration.
Wetland 12 on the drawings is Department of Natural Resources"
(DNR) Protected Wetland 170 -245W. It appears Eagle Creek Bluff
Drive may encroach into the wetland. DNR rules would prohibit
placement of fill in the wetland for any purpose. I recommend
Eagle Creek Bluff Drive be located to the north to ensure
separation and a buffer between the street and wetland. This would
help protect water quality and maintain a vegetative buffer around
the wetland.
Final plans should indicate that Wetland 170 -245W (Pond 12) is DNR-
regulated. Easements, restrictive covenants, or other protective
measures should be considered around that portion of Wetland #70-
245W lying on Lot 14, Block 3, so that future property owners are
aware of the protected status of the wetland.
Because this site is in a sensitive area which includes the
headwaters of a trout stream, a comprehensive stormwater
management/ drainage plan should be considered. How was the 3.4
acre -foot pond sized? How much of the proposed development will be
routed through the pond? Will wetlands 12 and 13 be recipients of
direct from the development? I recommend additional ponding
be required, so that all runoff is pre - ponded before entering'any
natural wetlands, particularly wetlands 12, 3,. and 4, the
headwaters of Eagle Creek. Information regarding runoff rates,
volumes, and routing should be provided.

This is a general project update notice to keep you informed of the proposed utility
' construction along Galpin Boulevard.
The City has entered into a construction contract with S.M. Hentges, Inc. of Shakopee to
' construct utilities along Galpin Boulevard. Construction is scheduled to begin the week of
October 3rd. The project completes necessary looping of water main as well as providing
sewer and water service to the new school site.
' Construction will consist of water main installation along the east side of Galpin Boulevard
south of Highway 5 and along the west side of Galpin Boulevard north of Highway 5. The
t construction will also include sanitary sewer construction on the west side of Galpin
Boulevard in the area near the intersection of Galpin and Timberwood Drive.
' The project will create a couple of inconveniences this fall. Galpin Boulevard be closed for
a few days due to construction of utility crossings. The construction will also disturb
Timberwood Drive at Galpin Boulevard for about a week. A temporary gravel surface will
be placed around the construction to provide access to the Timberwood area.
Most of the construction is scheduled to be completed this fall. However, a separate project
reconstructing Galpin Boulevard south of Highway 5 is scheduled for 1995. If you have any

curb and gutter. The project will include the installation of storm sewer, street lighting,
landscaping and bituminous pathway along County Road 17 and storm sewer, street
lighting and landscaping along Lake Drive.
The proposed alignment will be constructed completely within the existing right -of -way
for this road. Existing County Road 17 is a four -lane divided roadway from Trunk
Highway 5 to approximately 2,000 feet south. The remainder of the existing roadway to
Lyman Boulevard is two lane undivided. In areas where existing County Road 17 is two
lane, the existing roadway is located on the west side of the right -of -way. A majority of
the widening would, therefore, occur to the east side of the existing roadway.
' County Road 17 does not currently meet State Aid Standards, therefore this project
includes the necessary improvements to bring the roadway up to these standards.
Development of areas adjacent to County Road 17 has significantly increased the volume
of vehicles, bicycles and pedestrians utilizing the roadway. The proposed improvements
will include additional traffic lanes and a separate path for bicycles and pedestrians which
will result in a safer environment for all users of the roadway.
Carver County anticipates completing* the surcharging operations, required for the project,
by the end of 1994. Following the surcharging phase, preliminary and final plans for the
' roadway and utility improvements will be prepared. Construction of the roadway will
occur during the 1995 construction season.
The project is proposed by Carver County. The Responsible Governmental Unit (RGU) is
Carver County.
II. REASONS FOR ENVIRONMENTAL REVIEW - As stated in the project description

III. ENVIRONMENTAL REVIEW PROCESS - The CSAH 17 Reconstruction Environmental
Assessment Worksheet was submitted to the Minnesota Environmental Quality Board
(EQB) on July 25, 1994. The EAW Notice of Availability was published in the Minnesota
EOB Monitor on August 1, 1994. Copies of the EAW were mailed to all of the agencies
and organizations on the EQB official EAW Distribution List. The 30 -day comment period
ended on August 31, 1994
IV. REVISED WETLAND REPLACEMENT PLAN
Figure 9 of the EAW presented the proposed Wetland Replacement Plan for the CSAH 17
project. Since the publication of the EAW, the City of Chanhassen has reviewed said plan,
and requested revisions to the proposed location of the wetland mitigation area. The
attached figure indicates the latest plan for the proposed wetland replacement for
CSAH 17. This plan includes both wetland creation and wetland restoration. The plan
also results in providing more wetland compensation than is required for this project.
According to the attached plan, approximately 3.0 acres of wetland will be created adjacent
to Wetland A.
V. COMMENTS ON THE EAW - During the comment period, letters of comment were
received from the following agencies:
• Minnesota Department of Natural Resources
• Minnesota Historical Society
• Metropolitan Council
The comment letters on the CSAH 17 Reconstruction EAW are attached. Following is a
summary of the key comments received and responses to said comments.
A. Minnesota Department of Natural Resources
A. The Minnesota Department of Natural Resources (MnDNR) commented that Item 11a
should indicate that the project will result in the loss of 13 acres of upland and wetland
habitat for fish and wildlife.
RESPONSE - The project will result in the conversion of 13.6 acres of wetlands, woodlands, and
grasslands to landscaped right -of -way (8.6 acres) and impervious road surface (5.0 acres).
B. The MnDNR comments that the EAW should indicate whether wetlands have been
delineated and detail wetland types and acreage impacted by the project- related activity.
RESPONSE - Wetland boundaries were staked and surveyed by BRW, Inc. in July of 1994 in
accordance with the 1989 Federal Wetland Delineation Manual. The wetland delineation forms
completed for each of the three wetlands have been submitted to the City for review along with
the appropriate application and replacement plan forms.

' C. The MnDNR commented that Item 18b should indicate that Lake Susan is the ultimate
receiving waterbody for some of the site's storm water runoff, and that the EAW should
detail the location and design of the proposed sedimentation basins.
RESPONSE - The record should reflect that Lake Susan is the ultimate receiving waterbody for
some of the site's storm water runoff. The attached figure indicates the design and location of
the water quality pond area.
D. The MnDNR suggested that native plant species be used for revegetation purposes and
' implementation of water quality best management practices to limit erosion impacts.
RESPONSE - The County acknowledges that native plants species are preferred by the DNR
' for revegetating areas and, therefore, will explore the cost and availability of potential native
seed mixes.
' As stated in Section 18(b) of the EAW, the City of Chanhassen and the Riley - Purgatory -Bluff
Creek Watershed District must approve the water treatment pond designs proposed for this
project.
' B. Minnesota Historical Society
A. The Minnesota Historical Society commented that they believe that there is a good
probability that unreported property may be present in the study area. Therefore, they
recommend that a survey of the project area be completed.
' RESPONSE - During the 30 -day review and comment period for the CSAH 17 EAW, BRW Inc.
conducted a Phase I Archaeological Investigation along CSAH 17 in Carver County. Based on
the findings of said survey, BRW recommends that no additional archaeological investigations
I be conducted in conjunction with this project. A copy of the Phase I survey is attached to this
document.
C. Metropolitan Council
A. The Metropolitan Council reviewed the EAW to determine its adequacy and accuracy in
' addressing regional issues. Based on their review of the document, they indicated that an
EIS is not necessary for regional purposes.

RESPONSE - The Metropolitan Council's comment letter is included as an attachment to the
Findings Document. No response is required.
VI. DECISION ON' NEED FOR EIS - Minnesota Rule 4410.1700, Subp. 7, specifies the
following criteria to be used in deciding whether a project has the potential for significant
environmental effects.
• Type, extent and reversibility of environmental effects.
• Cumulative potential effects of related or anticipated future projects.
• The extent to which environmental effects are subject to mitigation by ongoing public
regulatory authority.
• The extent to which environmental effects can be anticipated and controlled as a
result of other environmental studies undertaken by public agencies or the project
proposer, or of an EIS previously prepared on similar projects.
Based on the information contained in the EAW, the comments received on the EAW and the
criteria listed above, .Carver County makes the following determinations:
A. The Project does not have the potential for significant environmental effects.
B. The preparation of an Environmental Impact Statement (EIS) on this project is not needed
or recommended.
C. The County may issue permits to allow construction in compliance with the rules of the
EAW and in conformance with the Minnesota Environmental Policy Act.

' stormwater runoff. The EAW should detail the location and design of the proposed sedimentation basins
to ensure that no downstream water quality impacts will occur to Lake Susan. The figure provided (7 -A)
does not provide a sufficient level of detail in this regard.
' We recommend use of native plant species for revegetation purposes and implementation of water
quality best management practices (BMPs) to limit erosion impacts.

SCOPE OF WORK '
This report describes the phase I archaeological investigations along CSAH 17 in Carver
County, Minnesota as recommended by an Environmental Assessment Worksheet (EAW) '
for the project (BRW, Inc. 1994). In addition to the recommendations in the EAW, an
evaluation of the architectural resources impacted by the project is also addressed. The ,
project consists of approximately 7,500 feet of County Road 17 between Trunk Highway
5 and Lyman Boulevard (CSAH 18), and 400 feet along Lake Drive east of County Road
17 in sections 14 and 23, T. 116 N., R. 23 W., Chanhassen Township (Figure 1). The '
current two lane undivided roadway will be rebuilt with an additional two lanes
constructed on its eastern edge, making it a four lane divided road. The total right -of -way
will be 150 feet wide (75 feet on each side of the new centerline). Construction will '
impact about 75 feet beyond the present eastern terminus of the shoulder. About 50 feet
of that is road ditch, leaving approximately a 25 foot corridor of land to be investigated
for archaeological resources. Impacts to architectural resources include those which '
would directly affect any properties and those with indirect impacts (e.g. visual or noise).
The investigations described in this report were conducted in August, 1994. The
fieldwork described in this report was conducted under Minnesota State Archaeologist ,
license number 94 -25.
SURVEY METHODS AND RESULTS I
Literature Search '
The files of the State Historic Preservation Office (SHPO) were examined for any '
previously recorded cultural resources within the project area and within a radius of about
three miles. No known Native American archaeological or architectural resources are
located in the project area. There are, however, 12 Native American sites (one habitation, '
six lithic scatters, two artifact scatters, two mound, one early American burial) within
three miles of the project area. Half of these are located around Lake Susan, about one-
quarter of a mile east of the project area. Looking further afield, the Minnesota Statewide ,
Archaeological Survey (MnSAS) conducted an archaeological survey of Carver County in
1977 (Minnesota Historical Society 1981:16 -19). The results of this survey indicate that
areas along the margins of wetlands frequently contain archaeological sites (Scott '
Anfinson, personal communication 1994).

' Field Survey
A pedestrian survey of portions of the project area indicate that it has been extensively
impacted by road, sewer, residential and commercial construction. All of the standing
structures within the area of potential effect are residential dwellings, office or light
' industrial buildings situated outside of the right -of -way. Those structures subject to
indirect visual or noise impacts appear to have been constructed within the last 20 years.
There are no structures to be impacted which are 50 years or older.
' The EAW for the project suggests that an area of about 1,500 feet between Minnesota
State Coordinate System N / 672,000 and N / 673,500 may require an archaeological field
' reconnaissance (BRW, Inc. 1994:15). A pedestrian survey of this area indicates recent
extensive impacts to the northern two -thirds of this area in the form of residential
construction, access roads, storm sewers, and grading and stockpiling of fill. That leaves
' about 500 feet of right -of -way to be intensively investigated. This area, along high ground
on the western edge of a wetland, is currently in tall grass (Figure 2).
This area was investigated by excavating a single transect of shovel tests near the outer
limits of the proposed right -of -way. The soil from these tests was screened through 1/4
inch hardware cloth. A total of 10 shovel tests were excavated along this transect. The
' first three tests were spaced at 15 meter intervals. Excavations revealed a black (10YR
2/1) silt loam ranging from 10 to 20 centimeters thick overlying a yellowish -brown (10YR
5/4) silt loam which extended to the bottom of the deepest shovel test at 50 centimeters
' below the surface. No cultural materials were recovered from these shovel tests. The
boundary between these two strata are sharp, indicating that this area consists of road fill.
Working on this assumption, the remaining shovel tests were spaced at 30 meter intervals.
' These tests revealed the same disturbed stratigraphy as the first three shovel tests. An
examination of the topography of the area of shovel testing, particularly farther to the
' south, also suggests that the western margin of the wetland consists of road fill and
impacts (cutting and filling) resulting from the initial construction of CSAH 17.
SUMMARY AND RECOMMENDATIONS
' A phase I archaeological and architectural reconnaissance survey was conducted as part of
the expansion and reconstruction of CSAH 17. A pedestrian survey of the project area
indicates that most of the land within the right -of -way of this project has been greatly
' altered by road construction, residential and commercial developments. There are no
standing structures 50 years or older which will be impacted by the project. Shovel tests
along the western margin of a wetland in the southern portion of the project area indicates
' that it consists of road fill from the initial construction of CSAH 17. On the basis of these
results, we recommend that no additional archaeological or architectural investigations be
conducted in conjunction with this project.
