Final Plat
PROPOSAL SUMMARY
The developer is requesting final plat approval to subdivide 32.8 acres into 30
single-family lots, four outlots, and right-of-way for public streets, for Tristan
Heights. Approximately 1.2 acres of the 32.8 acres are within the City of
Chanhassen (Outlot A, Highlands of Lake St. Joe 2na Addition). It should be noted
that only two of the proposed lots (Lots 6 and 7, Block 2) in this development will
be located in the City of Chanhassen. However, the entire sanitary sewer and
water system will be provided by the City of Chanhassen. These two (2) lots,
accessed via a private street, are proposed on the 1.2 acres. These two' lots were
preliminary platted as part of the Highlands of Lake St. Joe development. The city is
approving the final platting of these two lots, the extension of sewer and water
through the revision of the joint powers agreement and a development contract, and
plans and specifications for the public improvements.
These two lots are near the highpoint of the site with an elevation of 1018. The sites
slope to the north, east and west on these properties. A bluff exists on the westerly
portion of Lot 6. Canopy coverage on these lots is currently approximately 53
percent. The lots are proposed to be custom graded. Both lots are proposed for
development of walkout units with walkout elevations of 1008. The land to the
north is developed with detached single-family homes within the Highlands of Lake
St. Joe development. Portions of the property are within the shoreland district of
Lake St. Joe, which limits building heights to 35 feet. A wetland exists to the west
of these lots, but should not impact their development.
Staff is recommending approval of the final plat, the revision of the cooperative
agreement and a development contract, and plans and specifications for the public
improvements.

BACKGROUND
On July 8, 1996, the City Council approved the final plat for Highlands on Lake
St. Joe 2na Addition (#93-1) including nine lots and one outlot.
On April 10, 1996, the City of Chanhassen entered into a cooperative agreement
with the City of Victoria and Lundgren Bros. Inc. to permit the extension of city
sewer and water service to serve the development.
On February 26, 1996, the Chanhassen City Council approved a joint resolution
between the City of Chanhassen and the City of Victoria for the concurrent
detachment and annexation of incorporated land. This resolution annexed into the
City of Chanhassen the rear yards of the lots on the western side of the Highlands on
Lake St. Joe development and detached a small piece of property in the southwest
comer of the site.
On May 8, 1995, the City Council approved the preliminary and final plat for
Highlands on Lake St. Joe (35 lots and 2 outlots).
On July 12, 1993, The City Council approved the preliminary plat g93-1 for the
subdivision of the Boley property.
LANDSCAPING/TREE PRESERVATION
The applicant has submitted a landscape plan to the city as required before final
approval. One three caliper inch American Linden is proposed on one lot and one
three caliper inch Summit Green Ash is proposed on the other lot. The balance of
the proposed landscaping is shown within Victoria. The two lots being platted in
Chanhassen have existing trees on site and they will be custom graded.
Tree canopy coverage and preservation calculations for the development of these
two lots are as follows:

Canopy coverage on these lots is currently approximately 53 percent. The lots are
proposed to be custom graded. The target tree preservation for these two lots is 35
percent. The maximum amount of canopy removal permitted on the two lots is
9,053 square feet. Assuming standard tree removal for a twelve-foot driveway and a
60 foot by 60 foot building pad with 15 feet cleating beyond the foundation, Lot 6,
Block 2, Tristan Heights would have 8,460 square feet of canopy removed. This

exceeds the permissible tree removal for the lot by 3,933.5 square feet. Therefore, a
penalty of 1.2 times the area of excess tree removal is imposed resulting in a canopy
replacement area of 4,720 square feet, which equals five (5) trees for Lot 6, Block 2,
Tristan Heights. Based on the same assumptions, Lot 7, Block 2, Tristan Heights
has an estimated canopy removal of 5,550 square feet. This exceeds permissible tree
removal for the lot by 1,038 square feet. Therefore, a penalty of 1.2 times the area
of excess tree removal is imposed resulting in a canopy replacement area of 1,246
square feet, which equals two (2) trees for Lot 7, Block 2, Tristan Heights. One tree
shall be planted in the front yard of the lot and the balance planted in the rear yard.
PARKS AND OPEN SPACE
The proposed development will create two new homes that will place additional
demand on city park facilities. Full park and trail fees will be required pursuant to
city ordinance.

The required setbacks are those required in the RSF district. Setbacks: Front - 30
feet, side - 10 feet, rear - 30 feet, bluff- 30 feet.
BLUFF
A bluff is located in the west central portion of Lot 6, Block 2, Tristan Heights. A
bluff is defined as an area with a slope of 30 percent or greater and having an
elevation change of 25 feet or more. Staff has determined the top of the bluff at
elevation 1010 and the toe of the bluff at elevation 980. The side of the bluff is
located a distance of 48 feet from the west line of Lot 6, Block 2, Tristan Heights.
A 30 foot building setback is required from the top, side and toe of a bluff. The
first 20 feet of this setback area is defined as a bluff impact zone in which no
alterations, including grading and tree removal, shall be permitted.

Both lots are located within the shore land district boundaries. Since neither lot is
a riparian property, the district regulations have no discernable impacts on the
proposed subdivision since the city's minimum lot standards meet or exceed the
shore land district requirements. However, the maximum height of structures
within the shore land district is limited to 35 feet.
SURFACE WATER MANAGEMENT PLANT (SWMP)
Water Quality Fees
Because of the impervious surface associated with this development, the water
quality fees for this proposed development are based on single-family residential
development rates at $800/acre. Based on the proposed developed area of 1.15
acres, the water quality fees associated with this proj~t would be $920.00.
Water Quantity Fees
The SWMP has established a connection charge for the different land uses based on
an average citywide rate for the installation of water quantity systems. This cost
includes land acquisition, proposed SWMP culverts, open channels, and storm water
ponding areas for runoff storage. Single-family/low density developments have a
connection charge of $1,980 per developable acre. Therefore, the applicant will be
responsible for a $2,277.00 fee.
These fees are due payable to the City at time of final plat recording.
GRADING
The existing site over the two Chanhassen lots has tree cover over approximately
one-half of the area. Lot 6 also contains a bluff along the western property line of
the lot. Due to the amount of tree coverage, the developer is proposing to custom
grade each of the lots. Detailed grading, drainage, tree removal and erosion
control plans will be required for Lots 6 and 7, Block 2 at the time of building
permit application for City review and approval. In addition, as-built surveys will
be required on each lot prior to occupancy.
If importing or exporting material for development of the site is necessary, the
applicant will be required to supply the City with detailed haul routes and traffic
control plans.
UTILITIES
Municipal sanitary sewer and water for the development will be provided by the
City of Chanhassen. The plans propose on extending sewer and water from both

Ridgehill Road and Minnewashta Parkway to service the development. Overall,
the utility layout looks fine.
The applicant should be aware that no road closing of Minnewashta Parkway will
be allowed for the initial utility connection. During construction, the applicant
will be required to keep a through access open to the public on Minnewashta
Parkway.
A trunk hookup charge is required to be paid at the time of building permit
issuance for each lot. The 2001 trunk sanitary sewer hookup charge is $1,322 and
the trunk watermain hookup charge is $1,723. All lateral connection charges will
be waived since the applicant is installing the lateral utility lines.
Utility improvements throughout the site will have to be constructed by the
applicant in accordance with the City's latest edition of Standard Specifications
and Detail Plates. Detailed construction plans and specifications have been
submitted for staff review. The applicant will also be required to enter into a
development contract with the City and supply the necessary financial security in
the form of a letter of credit or cash escrow to guarantee installation of the
improvements and the conditions of final plat approval. The utility system, upon
completion, will be owned and maintained by the City of Chanhassen.
DRAINAGE
Drainage calculations have been submitted and are in accordance with the City's
Surface Water Management Plan (SWMP).
STREETS
The plans propose on accessing the Chanhassen lots through the use of a common
drive. Staff would recommend that the drive be constructed to a 7-ton design
requirement. Also, any existing driveways that enter the site off of Minnewashta
Parkway shall be removed and replaced with concrete curb and gutter.
EROSION CONTROL
Staff recommends that silt fence be added along the north property line of Lot 16,
Block 2 and along the north side of the common drive which serves Lots 6 and 7,
Block 2. All disturbed areas, as a result of construction, shall be seeded and
mulched or sodded immediately after grading to minimize erosion. A rock
construction entrance has been proposed at the entrance to the site off of
Minnewashta Parkway.

PRIVATE STREET FINDINGS
In order to permit private streets, the city must find that the following conditions
exist:
(1)
The prevailing development pattern makes it unfeasible or inappropriate to
construct a public street. In making this determination, the city may consider
the location of existing property lines and homes, local or geographic
conditions and the existence of wetlands.
(2)
After reviewing the surrounding area, it is concluded that an extension of the
public street system is not required to serve other parcels in the area, improve
access, or to provide a street system consistent with the comprehensive plan.
(3) The use of the private street will permit enhanced protection of the city's
natural resources including wetlands and forested areas.
Finding: The prevailing development pattern does not make it feasible or
appropriate to construct a public street. The proposed private street serving
these lots is not necessary to provide access to adjacent properties. A bluff
and steep slopes are located on the back sides of these lots. Were a public
street installed, even more trees would be impacted than proposed under this
plan. Staff directed, after reviewing a plat with public streets serving these
parcels, that the developer use a private street to preserve to the maximum
extent feasible the existing trees in the area.
REVIEW CONDITIONS OF APPROVAL
1. The applicant shall enter into a development contract with the City and provide
the necessary security to guarantee the installation of public improvements.

2. The applicant shall construct public utility and street improvements in
accordance with the City's 1993 Standard Specifications and Detail Plates.

shall be submitted to the City's Engineering Department for review and formal
approval by the City Council.
3. The applicant shall obtain all necessary permits from the Watershed District,
DNR, Army Corps of Engineers, MPCA, Health Department and MWCC.
*This condition still applies.
4. The applicant shall provide the City's Engineer Department with storm sewer
calculations designed for a 10-year storm event and ponding calculations that
show that the ponds will retain a 100-year storm event, 24 hour duration, and will
discharge at the predeveloped runoff rate. In addition, the ponds shall be
designed and constructed to NURP standards and data showing the nutrient
removal capacity of all ponds. The applicant shall not place fill material below
the 100-year flood elevation on Lake St. Joe which the Watershed District
currently determines at elevation 949.5. Bonestroo has determined the 100 year
flood elevation is 947.0. Staff is working with the Watershed District to resolve
where the 100 year flood elevation is located. The applicant's engineer shall
review the possibility of consolidating the two storm water retention ponds
located on Outlots A and B into one ponding area. The ponding area may be
established on either outlot or on Lots 1 or 2, Block 1, outside the wetlands. All
storm water retention ponds shall be designed and constructed in accordance with
the recommendations provided by the City's storm water management consultant,
Mr. Ismael Martinez, is outlined in his memo dated January 15, 1993.
*This condition shall be modified as follows: The developer shall pay surface
water management fees to the City of Chanhassen in the amount of $3,197.00 at
the time of final plat recording.
5. Site restoration, vegetative cover and erosion control efforts shall follow the
City's Best Management Practices Handbook for erosion and sediment control.
Type 1II erosion control fence shall be installed at the toe of slope adjacent to
Lake St. Joe. In cases where the side slopes exceed 200 feet in depth from the toe
of slope, an addition row of Type I silt fence should be installed. All areas
disturbed during site grading shall be immediately restored with seed and disc-
mulched or wood-fiber blanket within two week of completing site grading,
except for areas where utility construction will immediately commence. All
access points from the construction site to hard-surfaced road shall be surfaced
with crushed rock in accordance with the City's Best Management Practices
Handbook.

construction will immediately commence. All access points from the construction
site to hard-surfaced road shall be surfaced with crushed rock in accordance with
the City's Best Management Practices Handbook.
6. All access points to the water retention ponds should be dedicated on the final
plat as 20-foot wide drainage and utility easements. The access points for
maintenance purposes shall be a minimum of 4:1 slopes. Drainage and utility
easements shall be dedicated over all wetlands and water quality/retention ponds
on the final plat.

7. The applicant shall place a sign on barricades at the end of the southerly and
westerly street extension into the city of Victoria indicating, "THIS STREET
SHALL BE EXTENDED IN THE FUTURE." Notice of the extension shall be
placed in the chain-of-title of each lot. All street intersections should be aligned
perpendicular to each other.

8. The pending assessments for the Minnewashta Parkway improvements
(Project No. 90-15) shall be spread equally over the number of new lots in this
phase of the development.

9. Compliance with the Park and Recreation Commission's recommendations.
*This condition shall be modified as follows: Full park and trail fees will be
required pursuant to city ordinance for the two lots. One-third of the fees will be
payable at the time of final plat recording. The balance of the fees will be payable
with the building permit.
10. Compliance with the city's wetland regulation including permanent
monumentation staking setbacks and native vegetation. The wetland in the
southwest coruer needs to be reviewed and compliance with the wetland standards
as determined by its classification.

12. Variance from the lot width requirements from the shoreland regulations be
given on Lots 14, 15, 16, 17, 18, 19,20,21,22,23,25 and 27, Block 1, for the
following reasons:
a. All lots abutting Lake St. Joe meet the 125 foot lot width, only lots not
adjacent to the lake are recommended for a variance.
b. Requirement of making the lots conform to the 125 lot width
requirement will not affect the density of the project.
c. The MnDNR's shoreland regulations regarding lot widths on non-
riparian lots are inappropriate when applied within the metro area.
*These conditions do not apply with this phase of the development.
13. Compliance with the city's landscaping plan including streetscape along
Minnewashta Parkway and the requirement of one tree per lot.
*This condition shall be modified as follows: Five (5) trees for Lot 6, Block 2,
Tristan Heights and two (2) trees for Lot 7, Block 2, Tristan Heights are required for
tree replacement purposes. One tree shall be planted in the front yard of the lot and
the balance planted in the rear yard.
14. The existing dock on Lake St. Joe from the Boley property shall be removed.

15. The lots which are partially in the city of Victoria shall be platted last in order
for the two cities to work out an annexation-detachment agreement. If no
agreement can be made between the cities, the Declaration of Rear Yard
Easements, drafted by the applicant's attorney and approved by the City Attorney,
shall be recorded with the subdivision, apprising homeowners of the city limits
and restrictions to its use.

conditions be added:

Staff recommends that the City Council approve the following motion:

WHEREAS, the City of Chanhassen desires to detach a parcel of property
approximately 0.9434 acres in size and legally described as follows:

Beginning at the Southwest comer of said Outlot B; thence on an assumed

Municipal Board with the intent and request that the Municipal Board
concurrently detach Parcel A from the City of Chanhassen and annex Parcel A
to the City of Victoria and detach Parcel B from the City of Victoria and annex
Parcel B to the City of Chanhassen at the earliest possible date.
The motion for the adoption of the foregoing Resolution was duly made by Senn
and seconded by Hason and upon vote being taken thereon, the following
