BACKGROUND
The purpose of this memo is to inform you of the city's current construction related
permit fee schedules and to propose the revisions I feel are necessary. The city is
permitted to adopt any fee schedule it desires. I will address permit and plan review
fees for building, HVAC (heating, ventilation, air conditioning), plumbing, gas
piping, ISTS (individual sewage treatment systems), fire sprinkler and fire alarm
permits.
New state statutes require all plan review fees to be "based on costs commensurate
with the direct and indirect costs of the service." It is staff's opinion the fees are
"commensurate" with services. Fees from numerous cities were compared on the
basis of my recommendation. These cities are listed in Attachment H.
Attached is the resolution adopting the revised fees.
ANALYSIS
Building permit fees. Our current fee schedule is the 1994 Uniform Building' Code
(UBC) fee schedule. This schedule was adopted by resolution #87-95 on October
13, 1997. The UBC is a national model code adopted by the State of Minnesota and
published on a three-year cycle. Most metro area cities have adopted the 1997 [IBC
fee schedule. We requested fee information from 20 cities; 18 of the 20 cities polled
(90%) currently use the 1997 UBC fee schedule. The 2000 International Building
Code (113C), which is scheduled to become effective in July of 2002, does not have a
fee schedule.
The fee schedules are based on a percentage of the building valuation, with the
percentage decreasing as the building valuation goes up. The 1997 fee schedule

represents a 12% increase over the 1994 fee schedule. The plan review fee, which will remain 65%
of the building permit fee, will increase accordingly. I have included the two fee schedules as
attachments A and B.
Recommendation: I recommend the city adopt the 1997 UBC Fee Schedule. The increase
Will help offset the rising costs of administering the building code and keep Chanhassen's fees
in accordance with surrounding cities.
I-IVAC permit fees. Our current HVAC fees were established by Resolution # 94-06, adopted on
January 10, 1994. This fee schedule is also based on a percentage of the job valuation. The
schedule as adopted has two errors that need to be corrected as explained below and indicated on
attachment C.
1. There is a mathematical error in the fee schedule. For permits with a value greater than
$50,000, the fee should be $932.50 for the first $50,000 not $700.00 as the schedule
currently reads. As the schedule is set up now a permit for work valued at $50,000 costs
$232.50 more than a permit with a job value at $50,001.
2. The word evaluation found in item #2 of Resolution No. 94-06 should read valuation.
Recommendation: I recommend the city adopt a new HVAC fee schedule incorporating
the changes identified.
Plumbing permit fees. Our current plumbing permit fees were established by Resolution No. 89-
131, adopted on November 20, 1989 (attachment D). The fees include a base permit fee and
additional fees based on the number of fixtures being installed; i.e., sinks, toilets, tubs, showers,
dishwashers, etc.
With a fixture based fee structure, we often encounter situations in the field where the number of
fixtures "roughed in" or installed exceeds the number the permit was issued for. The result is that
the contractor has to pay additional fees for the additional fixtures. These fees are simply added to
the permit in place. Plumbing permits will soon be issued with our permit software, which will not
allow us to add fees to an existing permit. A new permit will have to be issued to allow us to
accept additional fees.
I believe it would be beneficial to all involved if plumbing permit fees were based on the job
valuation, just as building and HVAC permits are. It would provide for a consistent fee schedule
for mechanical work and would allow the city to be more flexible when job situations require
additions or changes. In a survey of eleven surrounding cities, we found that six of them issue
plumbing permits based on valuation, with the fee schedules similar to our current HVAC fee
schedule.

The fees for residential plumbing permits would be essentially the same as they are now. Using our
current HVAC valuation based fee schedule, I calculated the permit costs of ten residential
plumbing permits; the costs were basically the same as our current fixture based fee schedule.
Commercial permit fees would generally increase. The fees for small commercial jobs, which have
valuations comparable to that of a new home, would be about the same. The fees for larger jobs
(over $15,000 valuation) would increase approximately 10% - 40%; the largest increase being for
commercial sewer and water permits. Currently the fees charged for commercial water and sewer
installations do not cover the costs associated with the amount of inspections that are required. For
example, a permit was issued for site utility work based on a fixture count, at a cost of $250. A job
that size usually requires 2 to 3 inspections a day for approximately 2 weeks at a cost to the city of
approximately $750. not including plan review time. The job valuation was $50,000. If the fees
were based on valuation, the fee would have been $1,025. In surveying six other cities in the metro
area, we found that their fees range from $631. to $1149. for a job of equal size.
Recommendation: I recommend the city adopt a valuation based fee schedule for
plumbing permits. The fee schedule should be the same one used for HVAC permits. The
work is similar in nature and is often performed by the same contractors. Accordingly, the
permit costs should be the same as well. This change would allow the city to cover the
costs associated with extensive commercial construction projects. A valuation based fee
schedule may also eliminate the need to adjust the fee schedule in the future, as the permit
cost would rise as the job valuation increases.
Gas Piping Permit Fees: The city's current gas piping fee schedule was established by Resolution
No. 98-91, adopted on October 12, !998 (Attachment E). The fee schedule for residential permits
consists of a base fee plus an additional fee for each gas opening. The fee schedule for commercial
permits consists of a base fee, an opening fee, and a footage charge.
As currently structured, a resident or contractor obtaining a permit to install residential gas piping
for three appliances would pay $50.50 for the permit. This fee is in addition to any plumbing or
HVAC permit fees (gas piping is typically done by either the plumbing or HVAC contractor). In
most cases this fee is excessive for the amount of work being done. A permit based on valuation
would cost $30.50 using our current HVAC fee schedule, a reasonable fee for the service provided.
Recommendation: I recommend the city adopt the HVAC valuation based fee schedule
for gas piping permits. This will simplify the permit process and allow all types of
mechanical permits to be issued in a consistent fashion.
Individual Sewage Treatment System (ISTS) Permit Fees: The city's current fee schedule for
ISTS permits was established by resolution No. 87-05A, adopted on January 26, 1987 (Attachment
F). The schedule is based on the type of system being installed; i.e., $100.00 for a standard trench
system, $200.00 for a mound system, $225.00 for an alternative system, and $100.00 for repair or
rehabilitation. The schedule also establishes a $20.00 fee for pumping septic tanks.

As established, a permit for a simple repair would require a fee of $100.00, which is excessive, as
most repairs require only one inspection. The fees for new system installations are adequate for the
most part, but there should not be a difference between fees for a trench and fees for a mound
system. If the fees were based on valuation, the permits for new systems would range from
$190.00-$275.00 for work valued at $7,000 and $10,000, a reasonable fee for the service provided.
To my knowledge, we have never charged a fee for pumping a septic tank and the ISTS ordinance
does not require a permit to pump a tank.
Recommendation: I recommend the city adopt a valuation based fee schedule for ISTS
installation and repair permits. Pumping a septic tank would not require a permit. The
schedule would be the same as the adopted building permit fee schedule. In addition to the
reasons stated above, a valuation-based schedule would be consistent with the fee schedules
for other types of permits.
Fire Sprinkler Permit Fees: The city's current fire sprinkler permit fee schedule was established
by Resolution No. 89-10, adopted on January 23, 1989 (Attachment G). The fees are based on the
number of sprinkler heads being installed. Plan review fees are not charged.
Plans and applications for fire sprinkler permits are reviewed by the Fire Marshal or the Fire
Inspector. They inspect the sprinkler systems and associated components. A survey of sixteen
surrounding cities found that twelve have valuation based fee schedules; the others are device
based, as is our current system. Of the twelve cities that use a valuation based fee schedule, five
use the UBC fee schedule. Plan review fees range from no fee, to 65% of the permit fee.
Recommendation: I recommend the city adopt the 1997 UBC fee schedule for fire
sprinkler permits. I also recommend the city charge a plan review fee equal to 10% of the
permit fee. This will result in an overall fee increase of approximately 60%. While this is a
large increase, I believe the fees have been too low for the service provided. Fire sprinkler
systems can be very complex and require plan review and inspections to assure they comply
with the code. Fire sprinkler permit revenue for the year 2000 was $10,220 for 64 permits
issued. The proposed fee structure, if adopted, is consistent with the cities surveyed and
would fall in the middle to upper middle range of fees.
Fire Alarm System Permits: Currently, permits are not required for fire alarm systems, although
we review and inspect the systems that are installed. Fire alarm systems are required in buildings,
based on the use of the building and the number of sprinkler heads installed. We typically see
alarm systems installed in schools, apartment buildings and assembly occupancies (i.e., churches,
theaters). The purpose of the alarm system is to alert the occupants of a possibly hazardous
situation and to notify authorities of the same. Of fourteen cities that we surveyed, 10 require
permits for fire alarm systems. Of those 10 cities, 7 issue the permits based on the valuation of the
job.
Recommendation: I recommend the city require permits for the installation of fire alarm
systems and adopt the 1997 UBC fee schedule for fire alarm system permits. I also

recommend that, when plan review is required, a plan review fee of 10% of the permit fee
be charged. This fee schedule is consistent with the schedule proposed for fire sprinkler
systems and would offset the costs associated with review and inspection of these systems.
SUMMARY: If the above recommendations are implemented, all construction related permit fees
would be valuation based. The valuation concept is based on the proposition that the valuation of a
project is related to the amount of work to be expended in plan review, inspections, and
administration of the permit. With a valuation-based schedule, fees do not have to be revised as
often. The valuation of a project is determined by guidelines established by the State of Minnesota
and the Uniform Building Code. The city also establishes valuation criteria for work not addressed
by these guidelines
The overall impact to permit revenue is somewhat difficult to determine. Building permit and plan
review fees account for 78% of all permit revenue. The proposed increase of 12% for those fees
would increase revenue $100,000 based on the valuation of permits issued last year. Revenue for
site utility and commercial plumbing permits would increase 10-40%. I would estimate an increase
of approximately $5000 a year on average. Fire sprinkler permit revenue would increase $6000,
based on the $10,000 received in 2000. The proposed changes to the other permit fee schedules
(gas piping, ISTS, fire alarm) would have minimal impact on revenue. Any increases would be
offset by decreases in other areas, and the number of these types of permits is minimal.
RECOMMENDATION: Staff recommends the City Council adopt the attached Resolution
establishing new fee schedules for construction related permits.

RESOLUTION PURSUANT TO
INDIVIDUAL SEWAGE TREATMENT SYSTEM ORDINANCE
WHEREAS, the City of Chanhassen Individual Sewage
Treatment System Ordinance, Ordinance No. 10-B regulates the
installation, repair, and maintenance of'individual sewage treat-
ment systems, and
WHEREAS, .said Ordinance stated that by resolution the
City Council shall establish certain permit fees'~ license fees,
minimum qualifications for certain licensees; and
WHEREAS, said Ordinance adopts the Minnesota Rules
Chapter 7080 regarding Individual Sewage Treatment System
Standards; and
WHEREAS,.the State of Minnesota has established an
Individual Sewage Treatment System Advisory Committee to review
and evaluate proper design guidelines contained in'Minnesota
Rules Chapter 7080.
NOW THEREFORE, BE IT RESOLVED, that the Chanhassen City
Council hereby adopts the following license fee schedule pursuant
to said Ordinance No. 10-B:

A RESOLUTION ESTABLISHING A FIRE SPRINKLER' PERMIT AND
FEES ASSOCIATED. WITH SAID PERMIT
WHEREAS, As many of the City's-commercial developments are
required to have sprinkler systems, the City Fire Inspector
spends considerable time reviewing plans and inspecting the
installations.
WHEREAS, many cities in the metropolitan area require a per-
mit for the installation of sprinkler systems..
NOW, THEREFORE, BE IT RESOLVED by the Chanhas~en City Council
as follows:
1. That a permit be required for the installation o-f
sprinkler systems; and
