City Council approval requires a simple majority vote of the City Council
present.

Prior to the completion of the assessment hearing, any property owner wishing
to object to their assessment must file a signed written objection or they waive
their right to appeal. The Council may accept or modify the assessment amount
as presented.

even a bituminous overlay. These streets were last sealcoated in 1994 and 1999.

The streets are in poor condition with an average pavement condition index of 38. A road under
45 typically indicates distress that would require a full -depth reconstruction. The west portion of
Shore Drive has a pavement condition index between 52 and 64; however, these scores are
artificially high since there are three watermain break patches in this vicinity and this area has
been patched extensively.
The plat for the area shows the roadway right -of -way is 50 feet wide. The width of the roadways
varies from 24 feet to 28 feet wide. The existing road section is bituminous pavement with no
curb and gutter. No sidewalk is in the project area and no new sidewalk is proposed to be
included with the project.
The proposed improvement calls for reconstruction of the roadway. The width of the roadway is
proposed to be about the same width of the existing streets. Concrete gutter is proposed to be
added to this area to improve drainage and help extend the life of the streets.
The proposed design includes a modified street section that reduces the amount of sand from 24"
to 18" and the amount of Class 5 from 12" to 8 ". These revisions were recommended by the
City's soils engineer, Braun Intertec, to provide the same structural strength as the standard street
section based on known subsoil conditions.
Some trees within the right -of -way in front of some residential lots will be impacted by the
reconstruction work. The plans include the removal of approximately 45 trees within the project
area due to water service and hydrant replacement. Staff will work with affected property
owners to minimize the tree removal as much as possible.
Sanitary Sewer Improvements
Staff has investigated and televised the condition of the sanitary sewer in this area.
Approximately 1,600 feet of sewer is proposed to be replaced due to the condition of the pipe.
No sanitary sewer backup problems have been recorded in this area; however, a number of pipe
sags have been identified and these areas should be replaced at this time. The sanitary sewer
services that access these sections of the pipes are also proposed to be replaced between the
lateral sewer and the right -of -way. Sanitary sewer pipe replacement will be by the traditional
open cut method. The sewer that will be replaced is between 10 and 22 feet deep.
The remaining sewer pipe is in good structural condition, although some require mineral
removal, grouting and /or lining to reduce the incidence of inflow and infiltration. These minor
repair areas are also proposed to be fixed at this time. This work can be done without digging up
the pipe.
Watermain Improvements
The watermain in this area is 40 years old and should be replaced at this time. The mains are
made of cast iron and 11 documented breaks have been recorded in this area, the most recent
being on March 25, 2012. Water services between the lateral watermain and the right -of -way are
proposed to be replaced, as well as the curb stop. The new watermain is proposed to be eight
inch diameter PVC pipe.

The bid included alternates for open cut and directional drill installation of the new watermain.
The directional drill technology requires excavations at each end of the installation, which
minimizes the disruption to the ground surface. Open cut trenches are still required to install the
new water services and curb stops. The bid price for directional drilling ranged from $100,000
to $260,000 more than the open cut method, with the exception of one bid. The GM
Contracting, Inc. bid for directional drilling was about $5,000 cheaper than open cut, however,
their bid prices for the street, sanitary sewer and storm sewer were $675,000 higher than the low
bidder, Northwest Asphalt, Inc. Staff is recommending awarding the contract with the open cut
method.
Storm Sewer Improvements
The Minnewashta Heights plat area is approximately 56 acres in size and the actual watershed
within the project area is 32 acres. Currently there is very little stormwater infrastructure or
piping system in the area. The majority of the stormwater runoff generated by this neighborhood
discharges directly into Lake Minnewashta. The area is fully developed so construction of new
stormwater treatment ponds to treat runoff before it discharges into Lake Minnewashta is not an
option.
Runoff from Maplewood Court will be piped to the existing stormwater ponds off of Landings
Drive, west of the project area. The runoff from the Highway 7 right -of -way will no longer be
conveyed to this pond to provide capacity for the drainage from Maplewood Court, A MnDOT
drainage permit application has been approved.

The northern part of Elm Tree and the majority of Dogwood Avenue will continue to drain to
Minnewashta Heights Park. There is an existing drainageway on the south side of the park

deep and will be planted with shrubs so that landscape maintenance will not be required.
An Iron - Enhanced Sand Filtration system is an underground treatment system that captures
suspended solids, particulate phosphorus, and dissolved phosphorus. The iron forms rust (iron
oxide) and the dissolved phosphorus attaches to these iron oxides, thereby removing it from the
stormwater runoff. The iron filtration system is
designed to treat the first 1/2 to 1 inch of a rain
event. Any excess runoff will bypass the iron filing
system, into the storm sewer discharge to Lake
Minnewashta.
This system is also known as the Minnesota Filter
because it was developed at the St. Anthony Falls
Laboratory at the University of Minnesota. Several
communities such as St. Louis Park and Prior Lake
and watershed districts have used this system
successfully for stormwater treatment where
standard treatment ponds are not an option.
Rain gardens (biofiltration areas) are stormwater management practices intended to mimic
natural conditions. They treat runoff from smaller drainage areas and promote infiltration, which
reduces the volume of water getting to Lake Minnewashta and removes the nutrient load
associated with the infiltrated volume. These areas may be planted with a variety of plants
ranging from prairie species to a perennial garden to shrubs and mulch.

Rain gardens have been installed on homeowner properties along Pontiac Circle and Foxford
Road and in Lake Ann Park. There are no specific areas within the proposed project area where
rain gardens would be required. Participation in the rain garden program is voluntary.
The rain garden option was presented at both neighborhood meetings and in January, 2012 a
letter was sent to owners whose properties drain toward the lake reminding homeowners about
the option to have a rain garden installed. The bids included the construction of five rain gardens
based on resident interest at the time. After the project was out for bid, additional residents
expressed an interest in having a rain garden installed on their property. Funding for additional
rain gardens will be from the SWMP -035 LID Implementation Project fund.
The plans include the installation of St. Anthony Falls Laboratory Baffles (SAFL Baffles) in four
of the sump storm manholes. The intent of sump manholes is to provide an area within the storm
manhole for solids to settle and limit sediment deltas at storm pond inlets, however during heavy
rain events, the volume and velocity of runoff through the manhole resuspends the solids. The
resuspended sediment is then conveyed to the inlets of downstream water features which
decreases the capacity of ponds and requires maintenance in that the sediment must be removed.
The SAFL Baffles are designed to prevent runoff from becoming turbulent in the sump manhole,
thereby reducing the resuspension of solids.
ASSESSMENT HEARING PROCEDURE
Staff will provide a brief explanation of the work along with the proposed assessment amount.
Any issues that the City Council wishes to discuss regarding the project financing is appropriate
during the public hearing portion of the project. Public testimony should be received for the
project. The property owners should be reminded that if they wish, they must file a written
objection with the city either prior to or during the actual project hearings. Objections after the
public hearing are invalid.
The assessment objection is a request by the property owner for the Council to review the
assessment amount. Staff may have an immediate response to individual comments, or in some
circumstances, the objection should be received and referred to staff for investigation. The
remaining assessment roll should be adopted. If the City Council feels the objections cannot be
addressed immediately, a report will be presented to Council regarding all objections on that
particular project at the next City Council meeting. Council should adopt the remaining
assessment roll at that time in order for the process to stay on schedule. If there are no objections
filed, or if Council feels confident staff's investigation will not result in any changes being made
to the assessment roll, a motion by the City Council adopting the assessment roll as prepared is
needed for the project.
ASSESSMENT OBJECTIONS
Objections may be filed up to and at the public hearing. At the time of this submittal, no written
objections have been received. If any written objections are received in the interim prior to the
Council meeting, they will be provided to the council at the public hearing. Staff comments and
recommendations will also be provided at the public hearing. The City Council may choose to
adopt staff's recommendation or revise the assessment roll. If additional objections are filed

either prior to or at the hearing, they should be received and if necessary referred to staff for
investigation and resolution.
PROJECT SUMMARY: ASSESSABLE COSTS
Improvements within the project include reconstruction of the street, the replacement of sanitary
sewer and watermain, and storm sewer improvements. Forty percent (40 %) of the street
improvement costs are proposed to be assessed against the benefitting properties.

Per the city assessment practice, forty percent (40 %) of the street costs are proposed to be
assessed to the benefiting property owners; the City will be responsible for the remaining 60 %.
One hundred percent (100 %) of the utility costs will be paid for by the respective enterprise
funds.

Terms for the assessments proposed are at equal annual installments over ten (10) years at an
interest rate of 5.25 %. The estimated unit assessment identified in the feasibility report was
$6,952.53. By reducing the pavement section, the estimated assessment was reduced to
$6,025.26. The final unit assessment amount is $50.79 lower than the engineer's estimate for the
revised pavement section.

A neighborhood open house is scheduled for April 18, 2012 to discuss the final project design
and assessment amounts with the residents. Staff will provide a verbal update at the Council
meeting.

WHEREAS, pursuant to an advertisement for bids for the 2012 Street Improvement (Minnewashta
Heights) Project, bids were received, opened and tabulated according to law, and the following bids were
received complying with the advertisement:

1. The mayor and clerk are hereby authorized and directed to enter into a contract with Northwest
Asphalt, Inc. in the name of the City of Chanhassen for the 2012 Street Improvement (Minnewashta
Heights) Project according to the plans and specifications therefore approved by the City Council and
on file in the office of the city clerk.
2. The city clerk is hereby authorized and directed to return forthwith to all bidders the deposits made
with their bids, except that the deposits of the successful bidder and the next lowest bidder shall be
retained until a contract has been signed.

WHEREAS, pursuant to proper notice duly given as required by law, the Council has met
and heard and passed upon all objections to the proposed assessment for the improvement o£
Minnewashta Heights Neighborhood
Dogwood Avenue Elm Tree Avenue
Fir Tree Avenue Greenbriar Avenue
Maplewood Circle Shore Drive
NOW THEREFORE, BE IT RESOLVED by the City Council of Chanhassen, Minnesota:
Such proposed assessment, a copy of which is attached hereto and made a part hereof, if
hereby accepted and shall constitute the special assessment against the lands named therein,
and each tract of land therein included is hereby found to be benefited by the proposed
improvement in the amount of the assessment levied against it.
2. Such assessment shall be payable in equal annual installments extending over a period of
ten (10) years, the first of the installments to be payable on or before the first Monday in
January, 2013, and shall bear interest at the rate of 5.25 percent (5.25 %) per annum from the
date of the adoption of this assessment resolution. This assessment will show up on the first
property tax statement for 2013. To the first installment shall be added interest on the entire
assessment from the date of this resolution until December 31, 2012. To each subsequent
installment when due shall be added interest for one year on all unpaid installments.
The owner of any property so assessed may, at any time prior to certification of the
assessment to the county auditor, pay the whole of the assessment on such property, with
interest accrued to the date of payment, to the city treasurer, except that no interest shall be
charged if the entire assessment is paid within 90 days from the adoption of this resolution;
and he may, at any time thereafter, pay to the city treasurer the entire amount of the
assessment remaining unpaid, with interest accrued to December 31 of the year in which
such payment is made. Such payment must be made before November 15 or interest will be
charged through December 31 of the next succeeding year. The property owner decides not
to prepay the assessment before the date given above, the rate of interest that will apply is
5.25 percent (5.25 %) per year. The right to partially prepay the assessment is not available.
4. The clerk shall forthwith transmit a certified duplicate of this assessment to the county
auditor to be extended on the property tax lists of the County. Such assessments shall be
collected and paid over in the same manner as other municipal taxes.

I Justification I
The City uses a Pavement Management System to monitor the condition of the City streets. While proper preventative maintenance extends the
life of the street and is cost effective, a street will eventually deteriorate to a point that further maintenance is no longer cost effective.
Rehabilitation projects extend the life of the street. In cases with utility or poor sub grade needs to be replaced or where streets have deteriorated
to a point where rehabilitation will no longer be practical reconstruction of the street is necessary. A feasibility study is written to consider the
merits of the project and scope of work.
