SUBJECT: Request for a permit to move a house to: 1800 Flying Cloud Drive
BACKGROUND
Dennis Nystrom submitted an application for a moving permit on June 29, 2001. The home
was subsequently moved onto the site on July 7, 2001. The applicant stated that circumstances
beyond his control arose which necessitated the premature move to the site. The applicant is
aware that he is in violation of City Code Section 17-41, and the home will have to be moved
from the site if his request for a moving permit or the required variance is denied.
Chanhassen City Code Section 17-43 (enclosed) requires that the City Council conduct a
hearing on the application. A Notice of Hearing was mailed to property owners residing within
350' of the subject property on July 5, 2001.

ANALYSIS
City code requires that a moved home comply with the Uniform Building Code; be well
maintained and in a good state of repair; comply with Chanhassen City Code, Chapter 20; and
not materially depreciate surrounding property values.
Uniform Building Code: Inspections Division staff inspected the home on 7/12/01. The
applicant was given a list of items (enclosed) required to bring the home up to current code.
These items will be incorporated into the building, plumbing and HVAC permits that will be
required as part of the move.
Dwelling Condition: The home, which was built in 1975, has been generally well maintained.
The brick veneer exterior had to be removed before moving the home, and new hard board
siding will be installed. I have enclosed exterior pictures of the dwelling taken by the
applicant.
Chapter 20: The site proposed to receive the house is a 1.1 acre parcel zoned
Agricultural Estate (A2) District. The A2 district permits single-family dwellings and
accessory buildings. The A2 district requires a minimum lot frontage of 200 feet, minimum lot
depth of 200 feet and a minimum lot area of 2.5 acres. The lot complies with the lot frontage
(292 feet) and lot depth (322 feet) requirements. However, the lot does not have the minimum
lot area. Therefore, the lot is nonconforming and requires a variance to permit development.
Had the lot met a least 75 percent of the minimum requirements, a variance would not have
been necessary to construct a single-family home on the property (Section 20-73 (b)). The
applicant has applied for a variance. The public hearing for the variance is scheduled for
August 7, 2001.

A house and accessory buildings used to exist on this property. However, the house was in disrepair and
uninhabitable. In June, the property owner applied for a demolition permit to remove the existing house.
The proposed house should improve the appearance of the site and the value of the property.
Required setbacks in the A2 district are 50 feet from the front and rear property lines and 10 feet from the
side property lines. The property is shaped like a piece of pie. The front of the
property is Highway 212. The rear of the property is the point where the two sides meet.
Surrounding Property. The area has a mix of residential, agricultural, commercial and industrial
properties. The surrounding houses were built from 1930 to 1986. The following table shows the
estimated property values for homes in the area.

The estimated market value of the moved home to the subject location is $165,000, which is above the
average home value for the area.
RECOMMENDATION
Staff recommends approval of the house-moving permit subject to the following conditions:
1. The home must be repaired and altered to comply with current building code requirements, as
directed by the Inspections Division. Building, plumbing and I-WAC permits must be obtained
from the Inspections Division before proceeding with any work.
2. The applicant shall provide a design for an on-site sewage treatment system identifying two (2)
acceptable sites.
3. The applicant shall have obtained the required permits from MNDOT and applicable counties.
4. A lot area variance must be approved by the city prior to the house being moved on to the property.
5. The house must meet the required building setbacks for the Agricultural Estate (A2) District.

DIVISION 1. GENERALLY

All used buildings moved into or within the city shall comply with the following:

(2) The building is well maintained and in a good state of repair.
(3) Chapter 20.

DIVISION 2. PERMIT
Sec. 17-41. Required.
No one may move a used building into or within the city except upon issuance of a permit
issued by the city'council. '

Sec. 17-42. Application.
(a) A person required to obtain a permit by this division shall file'an application with the
ciW, accompanied by a fee in the amount established by' resolution.
(b) The application shall be referred to the city building inspector for the inspector's
recommendation. The recommendation shall be forwarded to the city council.

Sec. 17-43. Hearing.
The city council shall conduct a hearirig on the application for a permit under this
division preceded by at least ten (10) days' mailed notice to all property owners within three
hundred fifty (350) feet of the site where it is proposed to relocate the building. Failure to send
the notice, shall not, however, inval~Aate thee proceeding.

Sec. 17-44. Issuance.
The city council shall approve a permit pursuant to this division subject to: such reason-
able conditions as may be appropriate if the standards set forth..' above are met..If~he building
does not satisfy the. requirements for a permit, the city: council may issue a permit 'on
condition that the building is brought into compliance, within a reasonable period of time as
determined by the city council. The city. cou.ncill may further condition approval upon the
applicant furnishing a letter of credi~ satisfactory to the ci'~ty suffxcient to cover the-necessary
work to bring the building into compliance.
