CCC Chapter 7 -16(c) (2) amended to read:
Option 8 of MSBC Chapter 1306.0100 Sub. 3 is adopted.
Reason: The incorrect paragraph of the MSBC was incorporated into the 1992
revision. The City is permitted only to adopt option 8 or 8a; other
revisions are not permitted. The 2000 sf option has been enforced since
1987. Renumbering of sections of MSBC also require this section to be
amended (attachment #2 is the old MSBC section, attachment #3 is the
current MSBC section).
CCC Chapter 7 -21 amended to read:
No building or structure except group U occupancies shall be used or occupied until
the building official has issued a Certificate of Occupancy.
Reason: The 1994 UBC which is incorporated by reference into the new MSBC has
been reformatted with new designations for occupancies. The U
designation (formerly M) is the occupancy designation for private garages,
carports, sheds and agricultural buildings. Final inspections and approval
continues to be required for these occupancies except in the case of
agricultural buildings which are exempt from code requirements
(enclosure #4 is the old UBC section, attachment #5 is the current UBC
section).
CCC Chapter 7 -19 (9) is amended to read:
Location of first floor elevation of building on adjacent lots. Vacant adjacent lots
shall be labelled as such.
Reason: The addition of the requirement for designating a vacant lot insures the
reviewer that the surveyor didn't inadvertently fail to show buildings on
the adjacent lots if they exist.
4. CCC Chapter 7 -19 (11) is amended to read:

' Reason: Items c and d are necessary in order for the reviewer to determine if the
proposed structure is in compliance to the approved grading plan or
development contract.

curb due to topographic conditions.
The enclosed memo (attachment #6) was presented to the Public Safety Commission on March
9, 1995. The Commission recommended approval. The addition of 7 -23 is a minor change
recommended by the City Attorney.

remove, convert or demolish, equip, use, occupy or maintain any building or structure in the
city, or cause the same to be done, contrary to or in violation of any provision of this section. '

(a) The organization of the building department and enforcement of this article shall be
conducted within the guidelines established by chapter 2 of the Uniform Building'Code.

Sec. 7 -18. Fees.
(a) The fees to be paid to the city for building permits and inspections shall be as estab-
lished by resolution. The value of copstruction shalll /be determined by the building official.

(b) Upon return of a building permit to 4e city by the holder thereof, with proof satis-
factory to the building official that no construction was undertaken pursuant hereto, he shall
refund to the holder the building permit fee paid by him, except that twenty (20) percent of the
' fee paid or twenty -five dollars ($25.00), whichever is greater, shall be retained by the city. A
similar refund shall be made of any plan-checking fee paid except that no refund shall be made
if the city has caused the plans to be checked.
(c) In addition to the permit fee required by subsection (a), above, the applicant shall pay
a surcharge to be remitted to the Minnesota Department of Administration as required by
Minnesota Statutes 1990, § 16B.70.

Sec. 7 -19. Plans and specifications.
The building official may require that plans and specifications, required under Section
302(b) of the Uniform Building Code, include a survey of the lot upon which the proposed
building or construction is to be done, prepared and attested by a registered surveyor. An
original signature is required on the certificate of survey. The survey shall provide the fol-
lowing information unless otherwise approved by the administrative authority:
(1) Scale of drawing and north arrow;
(2) Legal description of property;
(3) Dimensions and bearing of front, rear, and side property lines;
(4) Front, rear, and side yard setback dimensions of -all proposed structures;
(5) Location of all existing structures on the property, including but not limited to san-
itary and storm manholes, hydrants, catch basins, power poles, phone boxes, fences,
and any encroachments;
(6) Outside dimensions of proposed structure(s) including decks, porches, retaining walls
(include elevations at bottom of footing and top of wall), stoops, stairs, cantilevers,
fireplaces, bay and bow windows, egress window wells;
(7) 'Location of a benchmark stake established by the surveyor at the front setback line
within twenty (20) feet of the proposed structure. Maintenance of the benchmark

stake once established by the surveyor shall be the responsibility of the permit ap-
plicant;
(8) Location of stakes established by the surveyor on side property lines at: '
a. Front setback line.
b. Front building line.
c. Rear building line. 1
The maintenance of these stakes once established by the surveyor shall be the re-
sponsibility of the permit applicant; 1
(9) Location of first floor elevation of buildings on adjacent lots;
(10) Location of all easements of record 1

c. Corners of proposed structures(s). Structure elevation shall be in accordance with

All elevations shall correspond to sea level datum of 1929. Benchmark elevations may 1
be available from the city's engineering department;
(12) Indication of direction of surface water drainage by arrows; 1
(13) Erosion control and grading plan if required by Chapter 20 or development contract;
(14) Wetland boundaries with ordinary high water level and 100 -year flood elevation if 1
applicable;
(15) Driveway grade (minimum - 0.50 %, maximum -10% 1
(16) All trees in excess of six (6) inches in diameter (diameter measured at four (4) feet
above grade).

Sec. 7 -20. Denial of permit.
The building official shall deny a permit for construction or enlargement of a dwelling on 1
ground which is too low for adequate drainage of surface waters. He shall also deny a permit
for construction or enlargement of any building when it appears that the proposed elevations 1
of the lot for which the permit is to be issued, in relation to the established or proposed grades
of adjoining or nearby streets, will probably cause a change in the existing drainage of surface

waters which will result in substantial hazard or inconvenience to persons residing in the city
or traveling on its streets.

Sec. 7 -21. Certificate of occupancy.
No building or structure of groups R3, R4, M, A, E, I, H, B, or R, division 1 occupancy, shall
be used or occupied, and no change in the existing occupancy classification of a building or
structure or portion thereof shall be made until the building official has issued a certificate of
occupancy thereof. w

Sec. 7.22. Stop orders.
If pursuant to the Minnesota State Building Code the building official posts a - stop work
order, it is a misdemeanor punishable to the maximum extent authorized by Minnesota Stat-
utes section 412.231 for anyone to destroy or remove the stop work order unless authorized by
' the building official.

ARTICLE M. EXCAVATING, MINING, FILLING AND GRADING*
Sec. 7.30. Purposes and intent.
The purpose of this article is to promote the health, safety and welfare of the community
and to establish reasonable uniform limitations, standards, safeguards and controls for exca-
vating, mining, filling, and grading within the city. Excavating, mining, filling, and grading
permits for more than fifty (50) cubic yards, but less than one thousand (1,000) cubic yards of
material in a twelve -month period may be processed administratively. Excavating, mining,
filling, and grading of one thousand (1,000) cubic yards of material or more in a twelve -month
period shall.be processed in the same manner as an interim use permit.

(b) Municipal option. The sprinkler system requirements in

buildings, buildings increased in floor area, and buildings
which will have the occupancy classification changed.
(c) Requirements. Automatic sprinkler systems must be
installed and maintained in operable condition in buildings in
the occupancy classifications listed in items 1 through 13. The
square footage requirements stated in the following items
' establish the threshold where the provisions apply; in the case
of mixed occupancies the threshold number of the most
restrictive occupancy applies to the entire building, except for
minor additions that do not increase the occupant load or
significantly increase the fire load.

Chapter 11
REQUIREMENTS FOR GROUP M OCCUPANCIES
Group M Occupancies Defined
Sec. 1101. Group M Occupancies shall be:
Division I. Private garages, carports, sheds and agricultural buildings.
EXCEPTION: Where applicable (see Section 103) for agricultural buildings,
see Appendix Chapter 11.
Division 2. Fences over 6 feet high, tanks and towers.
For occupancy separations, see Table No. 5 -B.

Construction, Height and Allowable Area
Sec. 1102. (a) General. Buildings or parts of buildings classed as Group M,
Division 1 Occupancies because of the
use or character of the occupancy shall not
exceed 1000 square feet in area or one story in height except as provided in
Subsection (b). Any
building or portion thereof that exceeds the limitations
specified in this chapter shall be classed in the occupancy group other than Group
f
p
M, Division I that it most nearly resembles.
(b) Special Area Provisions. The total area of a private garage used only
as a parking garage for
private or pleasure -type motor vehicles where no repair
work is done nor fuel dispensed may be 3000 square feet, provided the provisions`

set forth in Items 1 or 2 below are satisfied. More than one 3000 - square -foot
Group M, Division 1 Occupancy may be within
the same building, provided each
3000 - square -foot area is separated by area separation walls complying with
Section 505 (e).

1. For amixed- occupancy building, the exterior wall and opening protection
for the Group M, Division 1 building
portion of the shall be as required for
the major occupancy of the building. For such mixed - occupancy building,
the allowable floor area of the building shall be as permitted for the major

occupancy contained therein.
2. For a building containing only a Group M, Division 1 Occupancy, the
exterior wall and opening protection shall be as required for a building
classified as a Group R, Division 1 Occupancy.
(c) Headroom Clearance. Garages in connection with Group R, Division 1
Occupancies shall have an unobstructed headroom
clearance of not less than 7
feet above the finish floor to any ceiling, beam, pipe or similar construction
except for wall- mounted shelves, storage surfaces, racks or cabinets.
Location on Property
Sec. 1103. For fire - resistive protection of exterior walls and openings, as
determined by location on property, see Section 504 and Part IV.
Special Hazards
Sec. 1104. Chimneys and heating apparatus shall conform to the requirements
of Chapter 37 and the Mechanical
Code.

tier. All portions of tiers shall be within 200 feet (60 960 mm) horizontally from such openings.
311.9.6 Location on property. Exterior walls and openings in exterior walls shall comply with
Table 5 -A. The distance from an adjacent property line shall be determined in accordance with Sec-
tion 503.
311.9.7 Stairs and exits. Where persons other than parking attendants are permitted, stairs and
exits shall meet the requirements of Chapter 10, based on an occupant load of 200 square feet (18.6
m 2 ) per occupant. Where no persons other than parking attendants are permitted, there shall not be
less than two 3- foot -wide (914 mm) stairs. Lifts may be installed for use of employees only, pro-
vided they are completely enclosed by noncombustible materials.
311.9.8 Standpipes. Standpipes shall be installed when required by the provisions of Chapter 9.
311.9.9 Sprinkler systems. When required by other provisions of this code, automatic sprinkler
systems and standpipes shall be installed in accordance with the provisions of Chapter 9.
311.9.10 Enclosure of vertical openings. Enclosure shall not be required for vertical openings
except as specified in Section 311.9.7 for lifts.
311.9.11 Ventilation. Ventilation, other than the percentage of openings specified in Section
311.9.2.2, shall not be required.
311.9.12 Prohibitions. The following uses and alterations are not permitted:
1. Automobile repair work.
2. Parking of buses, trucks and similar vehicles.
3. Partial or complete closing of required openings in exterior walls by tarpaulins or any other
means.
4. Dispensing of fuel.
311.10 Helistops.
311.10.1 General. Helistops may be erected on buildings or other locations if they are
constructed in accordance with this section.
311.10.2 Size. The touchdown or landing area for helicopters of less than 3,500 pounds (1588 kg)
shall be a minimum of 20 feet by 20 feet (6096 mm by 6096 mm) in size. The touchdown area shall
be surrounded on all sides by a clear area having a minimum average width at roof level of 15 feet
(4572 mm) but with no width less than 5 feet (1424 mm).
311.10.3 Design. Helicopter landing areas and supports therefor on the roof of a building shall be
of noncombustible construction. Landing areas shall be designed to confine any Class I, II or III -A
liquid spillage to the landing area itself and provision shall be made to drain such spillage away
from any exit or stairway serving the helicopter landing area or from a structure housing such exit or
stairway.
311.10.4 Exits and stairways. Exits and stairways from helistops shall comply with the provi-
sions of Chapter 10 of this code, except that all landing areas located on buildings or structures shall
have two or more exits. For landing platforms or roof areas less than 60 feet (18 288 mm) in length,
or less than 2,000 square feet (186 m 2 ) in area, the second exit may be a fire escape or ladder leading
to the floor below.
311.10.5 Federal Aviation Administration approval. Before operating helicopters from helis-
tops, approval must be obtained from the Federal Aviation Administration.
SECTION 312 — REQUIREMENTS FOR GROUP U OCCUPANCIES
312.1 Group U Occupancies Defined. Group U Occupancies shall include buildings or struc-
tures, or portions thereof, and shall be:

1. For a mixed- occupancy building, the exterior wall and opening protection for the Group U,
Division 1 portion of the building shall be as required for the major occupancy of the building. For
such mixed - occupancy building, the allowable floor area of the building shall be as permitted for
the major occupancy contained therein.
2. For a building containing only a Group U, Division 1 Occupancy, the exterior wall and open-
ing protection shall be as required for a building classified as a Group R, Division I Occupancy.

Under no circumstances shall a private garage have any opening into a room used for sleeping

Class I, II or III -A liquids shall not be stored, handled or used in Group U Occupancies unless
such storage or handling shall comply with the Fire Code.
312.5 Garage Floor Surfaces. In areas where motor vehicles are stored or operated, floor sur-
faces shall be of noncombustible materials or asphaltic paving materials.
312.6 Agricultural Buildings. Where applicable (see Section 101.3) for agricultural buildings,
see Appendix Chapter 3.

Reason: The addition of the requirement for designating a vacant lot insures the
reviewer that the surveyor didn't inadvertently fail to show buildings on
the adjacent lots if they exist.
