Approve Addendum "A" to Development Contract for Shadow
Ridge Addition - Project No. 99-8
The replat of Outlot A, Shadow Ridge into Shadow Ridge 3ra Addition results in
the necessity to amend the original development contract to include the new plat.
No additional public utility or street improvements will be necessary in conjunction
with this replat except for the extension of a sewer and water service to the lot.
The attached Addendum A extends the conditions of approval from Phase I to also
apply to the Third Addition.
It is therefore recommended that the City Council approve Addendum A to the
development contract for Shadow Ridge conditioned upon the developer supplying
the City with administration and recording fees in the amount of $3,535.33.

ADDENDUM "A"
TO SHADOW RIDGE
DEVELOPMENT CONTRACT
SPECIAL PROVISIONS
AGREEMENT dated April 12, 1999, by and between the CITY OF CHANHASSEN, a
Minnesota municipal corporation ("City"), and WILLIAM D. COFFMAN, JR. AND CAROL
C. COFFMAN, a husband and wife (the "Developer").
1. BACKGROUND. The parties have previously entered into a development contract
for Shadow Ridge dated September 12, 1994 (the "Development Contract"). The Development
Contract was recorded on October 18, 1994 as Carver County Abstract Document No. 173224.
The developer is now replatting Outlot A, Shadow Ridge into Shadow Ridge 3rd Addition.
2. EXTENSION OF DEVELOPMENT CONTRACT. The Development Contract
shall remain in full force and effect with the modifications listed in the special conditions below.
3. SPECIAL CONDITIONS. In addition to the terms and conditions outlined in the
development contract, the following amendments shall apply:
a) Plan "B" Grading, Drainage and Erosion Control Plans dated August 5, 1994, shall
also include the Grading, Drainage and Erosion Control plans for Shadow Ridge 3rd Addition
dated March 18, 1999, prepared by Schoell & Madson, Inc.
b) Construction Hours. Construction hours for required improvements under this
contract and for home and building construction in the plat, except for work that cannot be heard
outside the home or building, shall be from 7:00 a.m. to 6:00 p.m. on weekdays, from 9:00 a.m. to
5:00 p.m. on Saturdays with no such activity allowed on Sundays or any recognized legal holidays.
Under emergency conditions, this limitation may be waived by the consent of the City Engineer. Any
approved work performed after dark shall be adequately illuminated. If construction occurs outside of
the permitted construction hours, the Development shall pay the following administrative penalties:

c) Noise Amplification. The use of outdoor loudspeakers, bullhorns, intercoms, and
similar devices is prohibited in conjunction with the construction of homes, buildings, and the
improvements required under this contract. The administrative penalty for violation of construction
hours shall also apply to violation of the provisions in this paragraph.
d) Development Signs. The Developer shall post a six foot by eight foot
development sign at each entrance to the project. The sign shall be in place before construction of
the required improvements commences and shall be removed when the required improvements are
completed, except for the final lift of asphalt on streets. The signs shall contain the following
information: project name, name of developer, developer's telephone number and designated
contact person, allowed construction hours.
e) The proposed single family residential development of 0.98 developable acres is
responsible for a water quality connection and a water quantity charge of $2,447.00 which shall be
payable to the city prior to recording the final plat.
f) Outlot A, Shadow Ridge 3~a Addition, is not subdividable or buildable until Yosemite
Road is upgraded to the city's urban standard and municipal sewer and water is extended adjacent to
the parcel and wetland setback and buffer area issues are resolved.
g) Upon completion of site grading, all disturbed areas shall be restored with seed and disc-
mulched or wood-fiber blanket within two weeks of completing the site grading unless the city's best
management practice handbook planting dates dictate otherwise. All erosion control measures shall be in
accordance to the city's best management practice handbook.
h) Pay park and trail fees as specified by city ordinance.
i) A sanitary sewer and water hook up and connection charge shall be collected at
time of building permit issuance for Lot 1, Block 1. A credit of $2,500.00 shall be applied to the
sewer and water connection charge for the developer installing a water and sewer service to the
property.
j) The developer shall escrow with the city $2,500.00 to guarantee street restoration
in conjunction with extending the sewer and water service to Lot 1, Block 1. In addition, the
developer shall provide the city with a two-year maintenance bond to guarantee against poor
material and faulty workmanship.
k) Lot 1, Block 1, Shadow Ridge 3rd Addition, will be subject to future street and
storm drainage assessments in conjunction with the upgrade of Yosemite to city urban street
standards.
1) Erosion control fencing shall be installed and maintained around the grading limits
until all disturbed areas are revegetated and the city authorizes removal. The developer shall
escrow with the city $1,000.00 to maintain erosion control measures.
4. RECORDING. The Development Contract and this Addendum "A" shall be recorded
against all lots and blocks and outlots in Shadow Ridge 3rd Addition.
