Approve Extension of Construction Work Hours for 1.5 MG Water
Tower - Project No. 97- lB- 1
The general contractor for the water tower project, Caldwell Tanks, Inc., has
submitted a request for an extension of work hours. The water tower is located
within the Arboretum Business Park development on what is known as the old
Wrase property.
The working hours as defined in the contract are from 7:00 a.m~t~ 7:00 p.m.
Monday through Friday and 9:30 a.m. to 5:00 p.m~,0t~aturdaY~'~ith no work on
Sundays or legal holidays. The contractor is requesting permission to work 7 days
a week from 7:30 a.m. to 6:00 p.m. This request represents working 10 hours on
Saturday, rather than the 8 hours currently allowed and 10 hours on Sunday, which
currently is not allowed.
Given that this project is located within an industrial park with no residential
homes nearby and that it is in the best interest of the City to insure that the water
tower be completed bY July 15, 1999, staff recommends the contractor's request
for an extension of work hours be approved. Further, if the Engineering
Department receives noise complaints due to this extension of work hours, this
issue will be brought back to Council for further consideration.

Dear Ms. Benson:
Further to our conversation'this morning, please accept this letter as our formal application for a variance to
the City's ordinance governing working hours on construction projects. Our understanding of this
ordinance, is that working hours are from 9:30am - 5:00pm Monday through Saturday, and no work at all on
Sundays.

As we discussed, this is a very large project with a short completion tim6~"i~he present time, this contract
is scheduled for completion in July. Given the distance our crews must travel to work on this project (some
as much as 1200 miles) and the aggressive completion schedule, we feel it would benefit all parties involved
if we would be allowed to work 10 hrs/day. This would normally be 7:30am - 6:00pm seven days a week.
We have instructed our crews that no work is to proceed on Sundays until the City has had an opportunity to
review this request, however, please confirm if we can work our 10 hour days Monday through Saturday
without formal approval of the City Council (i.e. from today until April 12th).
