Specifically, the City Council previously authorized acquiring a portion of the Charlie James propertifor the West 78th Street Detachment project I under the Minnesota Statute Quick Take provisior4An appraisal was conducted for the property and that amount was offered to Mr. James. His i ture has been received and deed filed with the county recording the ownership in our n "e. . CITY HALL 0002 11 1 RIGHT OF ENTRY AGREEMENT ' This agreement made and entered into this day of , 1993, by and between the City of Chanhassen and T.F. James Company (hereinafter referred to as "Owner "), ' WITNESSETH: ' The City is proposing the construction of Improvement Project No. 92 -3, which involves the reconstruction of West 78th Street. The City is attempting to acquire various property interests from the Owner over portions of the Owner's property described as follows: See Exhibit "A" attached In the spirit of cooperation between the parties with the intent of expediting the construction of the project, the City has requested and the Owner has agreed to grant permission for I the City and its agents to enter upon the property for purposes of commencing construction during the progress of negotiation proceedings. NOW, THEREFORE, the undersigned, as Owner of the above described property, in consideration of monies to be received and other valuable consideration, hereby grants unto the City of Chanhassen and its agents, the right to commence construction on the property described on Exhibit A, prior to final negotiation of the amount to be paid for the acquisition of the interests described on Exhibit A. The undersigned does not waive any claims it may have arising out of the above - mentioned negotiations and reserves any and all claims it may have against ' the City arising out of the City's use and occupancy of parcels described on Exhibit A. It is agreed that the City will pay to the Owner its approved appraised value which would have been required to be paid to the owner under Minnesota's "quick take" law which is set forth at M.S.A. 117.042. This approved appraised value will be given by check to the Owner not later than May 31, 1993. Further, is agreed that the Owner, at its election, may notify the City that it no longer wishes to negotiate the damages to be paid as a consequence of this acquisition and that thirty (30) days from the date that said notification is given to the City, in writing, the City shall file its Petition in Condemnation pursuant to Chapter 117 of Minnesota Statutes for the purposes of 1 determining the damages as is provided by that Statute. Attached is a letter from Van 1 Doren - Hazard- Stallings, Inc. dated May 24, 1993 summarizing the bid results. As noted, the City did receive some very competitive bids based on the project size and time of year. The low bid was by William Mueller & Sons, Inc. of Hamburg, Minnesota. Box 147 chanhassen, MN 55317 I Ref: Bid Opening T.H. 101 Turn Lanes at Cheyenne Trail & Pleasant View Road City Project No. 91 -06 I VHS Project No. 92 -302 Dear Mr. Folch: I Bids were opened for the project on Monday May 24, 1993 at 11:00 A.M. Five bids were received ranging from a low bid of $55,834.00 to a high bid of $77,203.50. The Engineers estimate for the I project is $57,407.00. There were two bids between $55,834.00 and $56,747.10 indicating a very competitive bidding climate. This represents a good bid for the City. II The low bid was by Wm. Mueller & Sons, Inc. of Hamburg, Minnesota. Wm. Mueller & Sons, Inc. has been in business since 1910 and I reports a construction volume of approximately ten million dollars annually for the past 3 years. Their main business practice is bituminous paving. The subcontractors to be used on the project are Machtemes Construction for storm sewer and Central Landscaping I for restoration. Wm. Mueller & Sons, Inc. has satisfactorily completed projects of I at least this size in the City of Chanhassen in the past. Similar project include construction of Turn Lanes on T.H. 101 at Sandy Hook Road and Choctaw Circle, and the reconstruction of T.H. 101 I south of downtown. They have also satisfactorily completed projects in Chaska and Waconia to name a few. We recommend award of bid to Wm. Mueller & Sons, Inc. in the amount I of $55,834.00 for the T.H. 101 Turn Lanes at Cheyenne Trail & Pleasant View Road, City Project No. 91 -06.
