If you recall, the first phase of the structure (tan and green) was purchased and installed by the city in 1991, at a cost of $9,995.00. This year the commission identified a fund reserve totaling $25,000.00 to match district dollars for purchase of Phase II, or Phase II and III. Both of these phases could be installed, for approximately $25,000.00 per phase. A small diagram depicting these phases is enclosed. Ms. Helen Merchant has in her possession, a large rendering of the playground. Pending approval of the Park Department's budgets, we stand prepared to participate with the district in enhancing the play area at City Center Park/Chanhassen Elementary School. This money was included as a 50% share toward the purchase of the second phase of play equipment for the west playground. The City Council approved this allocation as part of the 1992 budget process. 1 The first phase of the Landscape Structures (green and tan play equipment) was installed last spring at a cost of approximately S10,000. The second phase, as identified on the plan which I left with you, has a value of approximately $20,000 installed. If the School District is in a position of funding 50% of this cost, S10,000, a 1 purchase order could be placed. As can be seen from the plan, the installation of the second phase will enlarge the play value of this structure tremendously, wili7ing the entire length of the play surface already in place. The third phase would further fill the area and can be purchased at any time in the future. 1 The completion of the playground improvement project this past fall was an exciting time for the School District and the City. Superintendent Clough recently mentioned this project in a letter which appeared in our local newspaper. It is the hope of the City and the Park and Recreation Commission that we can continue to improve 1 the opportunities at the school and playground through this joint venture. The U.S. Fish and Wildlife Service (Service) is concerned with the sediment II entering Rice Lake, which is located on the Minnesota Valley National Wildlife Refuge. The heavy erosion results in a heavy layer of silt accumulation on submergent vegetation in Rice Lake and restricts the potential for new growth 1 by increasing turbidity and drastically reducing the penetration of sunlight. The objectives set for Rice Lake in the Refuge Master Plan cannot be met because of this condition. Although sediment does enter Rice Lake from other II areas, the severity is not equaled per unit area in any other area of the watershed. Past experience at the quarry has shown that erosion control practices have I been insufficient to control runoff and resulting sedimentation. At the present time, erosion from the quarry has resulted in up to 2 feet of sand /gravel fill on approximately 0.5 acres of wetland on the refuge. The II erosion from the quarry has created a delta of fill in Rice Lake that starts at the culvert under US 169 -212. The fill material includes sand and rock up to 4" in diameter. Not only does this have negative effects on the Minnesota River Ecosystem but it is also a violation of the National Wildlife Refuge I System Act. The erosion has also resulted in filling the 48" culvert under US 169 -212 with approximately 36" of sand /gravel. I Because of the Service's concern with sedimentation into Rice Lake, I recommend that Section B (Effluent Limitations and Monitoring Requirements) be revised to include a greater frequency of measurement of Total Suspended II Solids. Measurements should be required after all rainfall events. The current frequencies of measurement may not be sufficient to monitor the effectiveness of erosion control efforts. The City of Eden Prairie, as an abutting community to Moon Valley, has interest in the individual NPDES permit for this gravel mining operation. Our Staff concurs that sediment from Moon Valley has washed over U.S. 169 -212 and deposits into the Minnesota River bottom flood plain and Rice Lake. Rice Lake is located both in Chanhassen and Eden Prairie. This sediment impact upon the floodplain and lake has occurred over the years, and measures installed last year did not appear to control the problem. 1 The following comments are submitted on the permit: (Permit Item) • 1. (B.) The effluent characteristics from the outfall should meet with the approval of the D.N.R. and the U.S. Fish & Wildlife Service due to its impact upon the water quality of the public waters /refuge area. 1 2. (C. 5,6 & 8) The City of Eden Prairie would want to be on a notification list of any expansion plan or new outfall location. 1 3. (C. 10.) The requirement for temporary protection of exposed areas should be closely monitored. This can have significant results in controlling erosion. 1 The City appreciates the opportunity to comment on the permit. This facility's operations has periodically impacted the safety of U.S. 169 -212 (heavy sediment on and over the road) and the water quality of a lake and floodplain shared by Chanhassen and Eden Prairie. We have administratively reviewed the permit renewal application and offer the following comments. • I In January 1990, the Minnesota Pollution Control Agency and EPA developed a goal to reduce nonpoint source pollution in the•Minnesota River by 40 percent by July 1996. The Council responded by adopting an interim nonpoint source pollution strategy which took effect September I 30, 1992. That strategy calls for use of National Urban Runoff Program (NUR ?) criteria in designing stormwater ponds and Best.Management Practices (BMPs) in dealing with nonpoint source pollution. 1 According to this permit application, stormwater is discharged to •Rice Lake at outfall 010. Rice Lake discharges to the Minnesota River after high rainfall events. Stormwater discharge from the . site is in violation of turbidity standards and turbidity and total suspended solids (ISS) are a 1 major problem in the Minnesota River: To obtain the best•'uveraU view of exact amounts of TSS discharged to Rice Lake, the Council recommends that the permit require monitoring which focuses more on a composited event -based sample rather than a instantaneous grab sample. Because of turbidity violations in the past, the Council also recommends a stormwater • management plan be required for the site. Many of these "projects" are park improvements which were scheduled as a part of the department's annual capital improvement programs. With work unable to be completed, citizen unrest with the lack of progress became apparent. In an effort to alleviate these problems, I solicited quotations for a variety of the held -over work items. This work list was developed based on the level of priority 111 placed on each item. Finely Brothers Enterprises and Kusske Construction were sent quote sheets. With the lateness of the season, Kusske Construction elected not to submit quotes. To ensure that the prices received from Finely Brothers were competitive, I reviewed them with Charles Folch, Mike Wegler, and Dale Gregory. Of the eight items, we determined five of them were priced at a level which was in the interest of the city. A copy of the confirmation letter to Finely Brothers in the amount of $17,739 is attached for your signature. Much of the work is asphalt related and can be completed within two weeks. I appreciate your having taken the time to share your views with me on this important matter. The House Energy and Public Works committees both approved ' legislation this year designed to help states finance construction of drinking water treatment plants that are needed to comply with federal mandates. H.R. 1701 which would amend the Safe Drinking Water Act, would authorize $3.6 billion over four years to establish a new revolving loan program under the Environmental Protection Agency. ' The second bill, H.R. 1865 would authorize $2.6 billion over three years for drinking water treatment assistance. However, this legislation differs in that it would use the revolving loan fund structure already in place under the Clean Water Act to distribute money to the states. I understand the financial and regulatory concerns of ' smaller communities with respect to the Safe Drinking Water Act. I have a long history of opposing federal mandates, and I have promoted legislation to fund mandates, such as the Safe Drinking Water Act amendments. State and local governments are suffering financial hardships across the nation, and I find it unconscionable that the federal government continues to impose unfunded mandates without regard for community needs and 1 budgetary constraints. For your review, I have enclosed a copy of the statement 1 which I gave on the Senate floor on October 27, 1993 in honor of National Unfunded Mandates Day. ' As a member of the Senate Committee on Environment and Public Works, I will have the opportunity to closely examine any Safe Drinking Water legislation that should come before the Senate. B2 West Roseville, MN 55113 1 Dear Evan: You have asked for information concerning the long term use /reuse of the Jeurissep farm located I on Pioneer Trail relative to the Indirect Source P'ermit for Hwy. 212. Information provided by MnDOT indicates that it is not "economically feasible" to protect this one home from impacts due to the highway. ' The farm is located outside of the current MUSA lin in e an area our Comprehensive Plan has designated for a 1995 Study Area. This designation implies that the future use of this area 1 should be defined in this time frame, although it is not likely to be brought into the MUSA line in this time frame. We are in fact proposing to undertake such a study in the near future. Additionally, when we completed our Comprehensive Plan in 1991, we thought this area would be brought into the MUSA line concurrent with Hwy. 212 construction. However, as you are aware, the construction keeps ,getting delayed due to financial constraints. At the same time, ' development pressures in Chanhassen have been accelerating, advancing the date we will need . to bring this area into the system much earlier than we thought a few years ago. While there has been no official action taken to determine when a MUSA line amendment may be requested, it I is my belief that it will occur in the next 3 -5 years. As indicated above, land use determination for the area in question remains to be made in the I future. A reasonable guess is to assume that the area would contain low to medium density residential uses. However, in the past, the Planning Commission has discussed having a high -end office park near the County Road 17 interchange. This issue will be determined by the planning I effort we will be undertaking for the study area. Under any likely scenario, it is likely that the farmhouse would be removed. Typically, it would be considered to be incompatible with potential development to keep an older farmhouse. To the best of my knowledge, the home has I no intrinsic historic value that would warrant an investment in upgrading. However, you should be aware that the owner has approached the City about creating a new lot to accommodate a home for his son. Any such investment in a new home or the upgrading of the existing home I 1 Mr. Evan Green 1 November 10, 1993 Page 2 1 could make their removal or relocation uneconomical and new development would likely provide for their preservation. I If the home(s) are preserved in the future, the City may well have no way to encourage the installation of noise mitigation. In instances where new development is being proposed, we commonly request increased setbacks, use of landscaped berms, etc. to offer enhanced buffering. Unfortunately, we are not in any position to guarantee MnDOT that either the City or developer would be willing to assume the full responsibility for providing the mitigation and we are not 111 going to be able to give you a definitive plan until the area actually develops. II Like you, I think this is one of the most important problems facing our state and local governments. I am outraged that for the past several years -- primarily because of II lack of federal funds -- Congress has passed legislation requiring states to set up various, sometimes ridiculous programs but has not II provided the money to implement them. Congress has been too slow in realizing the weight of this burden it II places on states and local communities. By requiring compliance with countless unfunded federal mandates, Congress forces these governments to either raise taxes or divert money they would ordinarily use for police, fire or other necessary services. 1 That is why I am a cosponsor of H.R. 1295, which would require the Congressional Budget Office to estimate what a bill will cost state and local governments and private industry prior to consideration. I Summary of Oct. 26 meeting Present: Luke, Margie, Arlene, Therese, Sue, Cheryl Cheryl was able after 12 hone calls to P contact Prof. Goodpastor, Chair of U of St Thomas Business dept and foremost authority on Business Ethics in the USA. He will gladly address a combined lunch meeting of our chambers but will be in India during Values Week. We I chose March 21st as the target date. His fee is $750 which we plan to be covered by the admission price. The chambers will be contacted now by Luke and Margie and Sue to ask if they are willing to do this. I Luke and Cheryl will prepare a letter to raise financial support for Values Week which will go to ALL businesses 1 in Chan, Chaska, Victoria, Carver they will include some mention of Prof. Goodpastors upcoming address. The new letterhead will be used; mailing will be done using bulk rate at Comm Ed or CHS we hope. Chan Bank will be going ahead with Outstanding Youth Award again this year. We still have not heard from 1st National about the Crystal Acheivement Award Luke will talk with Li Kevin McShane. If they say no then Luke will begin asking around about a new sponsor for it.
