I THIS JOINT POWERS AGREEMENT, made and entered into, by and between the State of
Minnesota (Department of Natural Resources), hereafter referred to as the "Commissioner ", and
1 the City of Chanhassen (c \o Todd Hoffman, Parks and Rec Director, City of Chanhassen, 690
Coulter Drive, Chanhassen MN 55317) hereafter referred to as the "Local Unit ",
1 WITNESSETH;
1 WHEREAS, the Commissioner has determined that Eurasian watermilfoil (Myriophylum
§picatum) is a nuisance plant, detrimental to recreation and native plant species; and
I WHEREAS, the 1989 Minnesota Legislature appropriated funds to control the spread of
Eurasian watermilfoil; and
I WHEREAS, the Commissioner of Natural Resources has particular responsibilities with regard
to the control of aquatic vegetation in protected waters; and
I WHEREAS, pursuant to Minnesota Statute 103G.617, the Commissioner has the authority to
coordinate control programs with local units of government, special purpose districts, and lake
associations; and
1 WHEREAS, the Commissioner, pursuant to Minnesota Statute 84.026 is authorized to enter into
contracts with any public or private entity for the provision of statutorily prescribed resource
1 services; and
WHEREAS, an infestation of Eurasian watermilfoil exists in Lotus Lake (DOW #10-0006),
1 Carver County,
NOW, THEREFORE, the Commissioner, and the Local Unit agree as follows:
I A. The Commissioner shall:
1 1. Direct a private contractor currently under contract with the Department of
Natural Resources to carry out appropriate control of Eurasian watermilfoil in
Lotus Lake.
I 2. Pay the first $2,000 of the treatment cost. Pay 50% of the treatment cost above
$2,000 up to a maximum treatment cost of $15,000 (total amount the DNR would
I pay on a single lake is $8,500).
Bill the Local Unit for their costs of the control work.
4. Conduct an aquatic vegetation survey on Lotus Lake.

B. The Local Unit shall:

1. Pay to the State, upon completion of control work, 50 % of the cost of control I
work above $2,000, up to a total treatment cost of $15,000. If the total cost of
the control work is greater than $15,000, the Local Unit must pay the balance.
This agreement shall be effective from the date of execution by the Commissioner of Finance 1
through November 30, 1993. This agreement may consist of more than one treatment. This
agreement may be terminated at any time by either party upon 10 days written notice to the other I

1 Dear Roger:
I I agree wholeheartedly that public concerns and complaints over posted speed limits is one of the most frequent
and difficult complaints that we have to deal with. I have dad an opportunity to review the two preliminary maps
for potential posted speed limits on the County highways -and major City streets within Chanhassen. Taking into
account road classification, traffic volume, adjacent land use, etc., I would favor the proposed speeds shown on
I Map A. Given the amount of development now occurring on County Road 117 /Galpin Boulevard north and
south of Trunk Highway 5, a speed closer to 40 miles per hour may be more appropriate. I also have some
concern for Trunk Highway 101 north of Trunk Highway 5. Given the number and spacing of local street
I intersections and direct driveway accesses, it may be worth considering a speed limit of 35 or 40 miles per hour.
If you should need additional information or assistance in this speed reduction matter in conjunction with a
request to the Minnesota Department of Transportation, please let me know.

In response to your letter of August 11, 1993, I have forwarded this matter to the attention of
Paul Krauss, the city's Planning Director. As you are aware, the Park and Recreation Department
did not administer this ordinance and in contacting you, was responding to a complaint
concerning the mooring/storage of watercraft at a city park. In this regard and as I discussed
with you, I ascertained the mooring of the paddleboat was taking place in front of park property
with the aid of an aerial photograph. In light of the most recently adopted ordinance, however, 1
this issue is mute.

II Dear Todd:
After further investigation and correspondence with the State Legislative Library and
Information Center office, the office of the Commissioner of the Department of Natural
' Resources, the office of the commissioner of the LMCD and the WBLCD and several other
knowledgeable authorities, I wish to inform you that there is a consensus of opinion
that the Chanhassen City ordinance #160 Section 1 section 6 -2(b) is considered an
"unreasonable restriction" on the riparian rights of the lake shore owners in Chanhassen
for the following reasons;
- It does not address the right of a lake shore owner that may so chose not to have
a boat licensed in his or her name from allowing them the right to allow a non
blood relative and or a friend from using that lake shore property to dock /moor
and or land store a boat.
•
' - It does not address the issue of lake shore rental property, most certainly an
unreasonable restriction of the property owner of a home, cabin or apartment.
It has been mentioned that unlike the LMCD & WBLCD, Chanhassen is aiming to be ex-
tremely more confining and restrictive on the lake shore owner than trying for re-
sonable limitations. The LMCD, in an effort not to conflict with the owners riparian
rights and therefore gain legal authority and the power of enforcement, allows one boat
' per 50' of lake shore, up to 5 boats per lake shore home, of which 3 must be licensed in
the name of the owner or his immediate family of the lake shore home or property. The
immediate family does not even have to reside at that location. Moorings and docks are
governed by the same restrictions as long as they do not present a navigational hazard .
Furthermore please be advised of the following;
- The ordinance as adopted and passed by the city council and recorded in the min-
utes of 5/18/93 meeting says nothing pertaining to "blood relative ". (see page
42 of the city council minutes). Neither does the publications in the Vilager
on 4/9/92 or 6/25/92. The council minutes of 4/27/92 page 25 as written also
does not so state the ordinance this way. The 5/18/92 minutes addresses the
"PROBLEM" as one of the possibility of people renting space. The previous
' ordinance of 2/2/92 as written addresses this "PROBLEM" very specifically, "the
lake shore owner may not receive or be entitled to any payment for the written
permission." An amendment to limit the number of boats would have been more in the
' public interest, this was done more for private interest.
- Although not of any real importance, it does seem interesting that for some un-
known reason, all of the council packets for all of these meeting are nowhere to

be found? 1
- Sections 86B.205 sub 3-4 and Sections 103F.211 & .221 of the State of Minnesota
statutes provides, among other items, that the city must submit any water surface 1
zoning ordinance to the Commissioner of the Department of Natural Resources for
his'review and approval BEFORE adoption. According to the DNR records and the city II
council meetings records, this has in most cases, this case in particular, been
done after the ordinance has been passed and adopted. In this case the DiNR
approval was not until 5/26/93. It should also be noted that the copy of this
ordinance that was sent to the DiNR, that was approved by the DNR and in their
file, IS NOT the same written copy that is in the file at the Chanhassen City 14a111 1
- Through very little effort, I have now accumulated a list of 23 boats, their owners
and the property owners of which these boats are in violation of the current (as a
point of law quite possibly invalid) ordinance, some of which are very prominent II
community members.
It was brought up in conversations t'hat that a city may limit the number,
type, size and duration that vehicles may be in your driveway in the front of your home
and place those same limitations on your back yard, especially in the case of your back- II
yard being lake shore, but totally unreasonable should those restrictions specifically
confine those vehicles to those that are registered in your name or the name of a blood
relative.
It would seem to me that in their haste, the city staff and council lost sight of the
purpose and objective of such an ordinance, to REASONABLY MITT the number of boats
while upholding the riparian rights of it's citizens with an ordinance that was founded II
on sound legal principles through the proper legal process and maintain enforceability.
I would also like to state for the record that I along with several other people I have
now talked with, find it incomprehensible that although you had, in the process of tagging
my boat, been rather certain as to it not being in compliance with the 2/2/92 ordinance,
where however unable to specifically inform me how far to move it in order to be in
compliance. I have, as previously discussed with you, in the presence of several other
people, located the metal surveyor stakes for that parcel of property. I wish to inform
you that the boat mooring was not on public property, that only on occasion could the
boat possibly swing in the wind to come in contact with the property line.
I would appreciate a response from either you or the city to this letter so I may
determine what further course of action I may wish to take.

Plaintiffs, Frank Beddor, Jr., Todd Novaczyk and Sherry
Novaczyk, and Robert L. Post and Sandra J. Post, for their
complaint against defendants, City of Chanhassen, its Mayor
Don Chmiel and City Council Members, allege and state as follows:
INTRODUCTION
1. This action is brought under the citizen suit provision ,
of the Minnesota Environmental Rights Act ( "MERA "), Minn. Stat.
S 116B.01, et seq. Defendant City of Chanhassen ( "Chanhassen ") has '
determined to proceed with a project ( "proposed project ") which
would involve the extension and alteration of two roads and which
would adversely affect natural resources protected under MERA. 1
Plaintiffs are landowners who live in the affected area, and
include one landowner whose property defendant Chanhassen has
determined to condemn in order to proceed with the proposed
project. Defendant City of Chanhassen has determined to proceed

11 with its proposed project in spite of being presented with feasible
alternatives which would eliminate or mitigate the proposed
' project's adverse effects on the environment. Plaintiffs are
therefore instituting this suit seeking the declaratory, equitable
' and other relief provided under MSA § 116B.07.
' II.
PARTIES
' 2. Plaintiff Frank Beddor, Jr. is the owner of a parcel of
property sometimes known as Beddor Lot 5 located in Chanhassen,
' Minnesota.
• 3. Plaintiffs Todd Novaczyk and Sherry Novaczyk are owners
of the property located at 6371 Pleasant View Cove, Chanhassen,
Minnesota 55317.
4. Plaintiffs Robert L. Post and Sandra J. Post are owners
of the property located at 489 Pleasant View Road, Chanhassen,
Minnesota 55317.
5. Defendant City of Chanhassen is a municipal corporation
organized and authorized by Article XII Section 4 of the Minnesota
Constitution and does business at 690 Coulter Drive, Chanhassen,
' Minnesota 55317.
III.
1 GENERAL ALLEGATIONS
6. Defendant Chanhassen has proposed a project which
involves the extension of Nez Perce Drive through Plaintiff
Beddor's property, Beddor Lot 5, to Pleasant View Road and which
would also involve the widening and realignment of a second road,

Peaceful Lane. The proposed project has been set forth in a
Feasibility Study done for the City of Chanhassen dated July 8,
1992. The Feasibility Study provides two alternatives which differ 1
only slightly, primarily in the design of the intersection between
Nez Perce Drive and Peaceful Lane.
7. The proposed project is related to another project which

has been proposed to defendant Chanhassen, by JMS Development, the
"Tower Heights Addition." Under the Preliminary Plat proposal for
the Tower Heights Addition, the realigned Peaceful Lane and
extended Nez Perce Drive would serve as an access to and from the
Tower Heights Addition. 1
8. On May 24, 1992, the City Council of the City of
Chanhassen voted to institute condemnation proceedings with respect 1
to property owned by Plaintiff Beddor known as Beddor Lot 5. At
the same City Council meeting, the City Council voted to proceed 1
with the proposed project.
9. On July 12, 1993, Defendant Beddor and others appeared
before the Chanhassen City Council and asked that they reconsider
their decision to proceed with the proposed project and to
institute condemnation proceedings. The City Council voted not to
reconsider their decisions.
10. On July 21, 1993, the City planning staff for defendant
Chanhassen recommended that the proposed Preliminary Plat for the
Tower Heights Addition be approved by the City. On July 21, 1993,
the City Planning Commission held a hearing on the request for the
plat approval, and then continued the hearing until August 18,

1993. Under MSA 462.358, if the proposed preliminary plat is
approved, the developer of the Tower Heights Addition may claim
1 vested rights to implement the plan reflected in the proposed plat,
including the parts of the plan which will cause the damage and
1 destruction of natural resources which are the subject of this suit
challenging the proposed project.
1 11. On July 26, 1993, defendant Chanhassen initiated
' condemnation proceedings against defendant Beddor and his wife,
Marilyn Beddor, through which the City intends to take by eminent
1 domain Beddor Lot 5 in connection with the proposed extension of
Nez Perce Drive and realignment and expansion of Peaceful Lane. A
1 hearing on the petition for condemnation is scheduled to be heard
on August 25, 1993, in the District Court for Carver County,
Minnesota.
1 12. If the proposed project were to be implemented, many
mature trees would be destroyed, causing a significant loss of
1 habitat and wildlife in the area.
13. The proposed project would also dump additional traffic
onto Nez Perce Drive and Pleasant View Road. The increase in
1 traffic will cause a substantial increase in the amount of noise
and air pollution to persons living adjacent to these roads. The
1 effects of noise and air pollution caused by the increase in
traffic constitutes harm to natural resources located in the area
1 of the proposed project.
1 14. Increased traffic on Pleasant View Road, which has been
the site of numerous traffic accidents, will also increase risks of

traffic accidents which will endanger both human life and wildlife.
15. In addition, the proposed project would damage or destroy
a pond and wetland area by draining water polluted with road salt, '
oil and other pollutants to the pond and wetland area, and by
altering the pond and wetland area to provide for drainage. The 1
pond and wetland area, and the wildlife associated with that area,
are natural resources protected under MERA.
16. The City has failed to conduct any studies regarding how
the proposed project will impact the environment in the vicinity of
Nez Perce Drive and Pleasant. View Road. A petition to require the
preparation of an Environmental Assessment Work Sheet under
Minnesota Rules 4410.1100 was filed with the Minnesota
Environmental Water Quality Board on July 21, 1993. 1
17. Feasible alternatives to the proposed project are
available which would eliminate or mitigate the environmental '
effects of the proposed project. A feasible alternative entitled
"The Solution" was presented to the City Council by Defendant Frank 1
Beddor on July 12, 1993, which would connect Nez Perce Drive to
Lake Lucy Road via an outlet reserved for such a connection.
This feasible alternative would have substantially less

environmental impact than the proposed project.
18. This feasible alternative is additionally safer because 1
it does not result in dumping additional traffic onto Pleasant View
Road, and yet provides dual access to the residential developments
in the area. 1

19. The City has failed to evaluate any such feasible
alternatives.
IV.
COUNT ONE
20. Plaintiffs restate Paragraphs 1 through 19 above.
21. Chanhassen's proposed project is conduct that will
immediately adversely affect or is likely to materially adversely
affect the air, land, and water or other natural resources in
violation of Minn. Stat. S 116B.04 by unnecessarily destroying
1 trees, causing an increase in noise and air pollution from traffic,
causing unnecessary safety hazards for area residents and wildlife,
' by damaging or destroying the pond and wetland area encompassed
' within the proposed project, and by failing to consider feasible
and prudent alternatives.
22. Chanhassen's proposed project will result in the
pollution, impairment, or destruction of air, land, water, or other
1 natural resource, in violation of Minn. Stat. §§ 116B.03 and
' 116B.04 as set forth in paragraphs 1 through 21 above.
WHEREFORE, Plaintiffs pray for relief as follows:
1 1. Declaratory and temporary or permanent equitable relief
by the court pursuant to Minn. Stat. S 116B.07.
2. For such other relief as the court may deem just and
equitable.

Carlson to serve on the State Advisory Council on Metro Governance. A formal press
release from the Governor's office is expected out this week.
The composition of this special study taskforce includes five legislative members each
from the Senate and House of Representatives and five public members. The public
members are appointed directly by Governor Carlson. I was asked to submit my
application in consideration for an appointment to this committee.
The charge to the taskforce committee will include the study of the metro area
governance structure (Met Council, RTB, city, counties, etc.) and core city /suburban
issues (housing, jobs, infrastructure, etc.).

Governor Carlson received recommendations for my appointment from Rep. Tom 1
Workman, IR- Chan., SMTC /Eden Prairie Council member Patricia Pidcock and Lisa
Sisinni, Executive Director Eden Prairie Chamber.

This letter is to inform ou that the Target parking lot lights have not been located according to

the approved landscaping/lighting plan. I have spoken with John Dietrich at RLK and Troy
Corrigan at Ryan Construction and told them the lights have to be relocated to meet the plan
approved by the city. One of the issues raised by Target during review by the city was the
' planting islands and the problem with snow removal. The parking lot lights (as approved with
the site plan) were to be located in the landscaping planters. The location of the lights appears
to cause even more impediment to snow removal and is inconsistent with the character and
quality of the site plan that was approved.
Target had requested that they be given a variance to allow parking lot lighting to be 1 foot
candle at the property line. The City Council denied this request and stated that the lights must
meet city ordinance and be 1/2 candle foot at the property line. I will check to ensure compliance
with this requirement. Troy Corrigan informed me during our phone conversation that the lights
were placed in order to get maximized light coverage with minimal poles. I informed him that
the lights did not meet with the city approved plan and must be corrected.
Failure to comply with the approved city plans may result in a delay of your certificate of
occupancy. Your immediate attention is greatly appreciated.

This letter is to bring you up to date on the tax court case
involving PRN Music Corporation. Yesterday we went before Judge II Doar here at the courthouse. Prior to that time, I and Orlin
Schafer, county assessor, met with Jim Dorsey, Tom Wilhelmy, Red
White and another gentleman from PRN.
At the meeting with the Judge I indicated that I was withdrawing my II
motion for summary judgment pending further discovery. We have
scheduled Orlin Schafer's deposition for August 19th. It is
anticipated that we will be taking the desposition of the person in II
the Chanhassen city government who is responsible for the financial
data on the TIF district. II All discovery must be completed no later than September 30, 1993.
After that date either party may file a motion for summary
judgment. There is also a conference call set for December 1, 1993
II
to bring Judge Doar up to date on the case.
Judge Doar was in no hurry to resolve this case because many of the
issues are the same as those in the FlyteTime tax court case, which II
was heard by her and is on appeal to the Minnesota Supreme Court.
I mentioned to Dorsey and Wilhelmy that the Chanhassen HRA will be

either intervening in the tax court case or will be filing a
declaratory judgment action in district court. I trust that you
will let me know what the decision will be soon. 1

I have tentatively scheduled the assessment hearing on the above - referenced project for the September 27, 1993

City Council meeting. This time schedule yields approximately a month and a half to complete all the remaining
work, final the project and administrate the required assessment roll and property owner notification. Enclosed
you will find a sample copy of the City's standard assessment notice. Please revise this sample notice accordingly,
use a 71/2% interest rate for a term of 8 years and prepare a statement for Hilloway Corporation, developer of
Ithilien who has agreed to pay a 20% assessment share. Please also revise the storm sewer connection charge.
The notice and corresponding assessment roll should be returned to the City by no later than September 8, 1993.
City staff will then mail the notice. Also enclosed is a sample copy of the notice of public hearing on
assessments to be published in the City's official newspaper. Please revise this notice accordingly and return to
the City for publication by no later than September 8, 1993.

' Dear Don:
Pursuant to Minnesota Rules 4410.1100, the City has to make a
determination on the need for an E.A.W. within thirty (30) days
after receipt of the petition from the E.Q.B. The City Council
decision to require or not require an E.A.W. should be accompanied
by a solid report from City staff or a consultant. If the decision
is made not to require an E.A.W., formal "findings of fact" should
be prepared supporting the decision.

I The City of Chanhassen would be pleased to provide 3 Opticom emitter units, and have them
installed in the 3 squad cars used primarily in Chanhassen. If this is something you would like
to take advantage of, contact Fire Marshal Mark Littfin at our office, Mark will be happy to
I arrange for installation. The only cost to the County that I can see at this time would be
! changeover costs when you rotate your vehicles to have the units reinstalled in your new
vehicles, and any necessary repairs after the warranty.

This letter is to let you know we strongly support the proposal to purchase land and to build a 1
park at the intersection of King's Road and Minnewashta Parkway. As residents of the
Minnewashta Parkway neighborhood, we believe it is time for a park in western Chanhassen.

As you are aware, there are no parks in the area now and the trail being constructed as part of
the road improvement would provide good access for all residents along the Parkway .
We especially support the recommendation from the Parks and Recreation committtee that the
park be large enough to allow for sports fields, playground equipment, picnic and beach areas.
In conclusion, please follow the Planning Commission's recommendation to not approve the
Heritage Development Plan with a small park in a remote location but instead approve and fund
the 10 acre park while the undeveloped, centrally located property still exists.
Thank you for your thoughful consideration of this issue.
