' PROPOSAL
The applicant is proposing to divide a platted lot into two single family lots. The subdivision
regulations permit a metes and bounds subdivision of a platted lot if the legal description is
simple and if the created lots meet the regulations of the zoning district. A metes and bounds
subdivision requires a public hearing, which is heard in front of the City Council. A metes and
bounds subdivision of a platted lot does not go in front of the Planning Commission. The Zoning
Ordinance requires lots in the RSF district to have a minimum of 15,000 square feet in area, 90'
of public street frontage and 125' of lot depth.
1 The applicant currently resides in a single family residence on a platted lot, Lot 1, Block 1,
Rolling Hills. The subject site contains 40,823 square feet, has street frontage along Crestview
' Circle and has access to sewer and water from Lake Lucy Road to the north. The applicant is
proposing to subdivide the subject parcel by a metes and bounds description into two single
family lots. The two lots contain 19,535 and 21,288 square feet, both have frontage along
' Crestview Circle, and sewer and water service. The two lots have over 90' of public street
frontage along Crestview Circle and meet the 125' lot depth. The metes and bounds description
divides the parcel in half, with the new lot line at a slight angle to accommodate the existing
1 driveway.
The survey illustrates existing conditions and setback limitations. The created lots provide a
1 buildable area for the vacant lot and provides adequate setbacks for the existing residence (the
existing residence only has a 17' front yard setback -this is an existing situation). The applicant
is proposing to build a new home for himself on the vacant lot (Parcel A) and to sell his existing
1 home (Parcel B). It should be noted that a stone wall exists on the property and is where the
interior lot line is proposed. Technically, there are no setbacks for retaining walls, so this can
be permitted. The applicant should notify whoever purchases Parcel B of this situation and come
1 to an agreement as to who maintains the wall.
1 Crestview Circle has a 50' wide right -of -way with only a 15' gravel surface. Crestview Circle
currently services 5 homes. The proposed subdivision will add one more home onto Crestview
Circle. The City Code requires an improved street with a paved surface of 31' back to back.
Staff has reviewed this situation and has determined that requiring the street to be brought up to
city standards is not necessary as a result of the additional lot. The city maintains the street and
has not experienced problems with the existing situation. The site is adjacent to Galpin
' Boulevard (CR 117) to the west. Carver County is requesting a 100' right -of -way along Galpin
Boulevard. Currently, there is a 66' right -of -way. The applicant must provide an additional 17'
of right -of -way along Galpin Boulevard (CR 117) (removing the additional right -of -way from
1 Parcel A still maintains enough square footage to meet the minimum 15,000 square feet).

RECOMMENDATION 1
Staff recommends the City Council approve request #93 -6 Metes and Bounds subdivision as
I shown on the plans dated February 16, 1993, with following conditions
1. The applicant shall pay park and trail fees at time of building permit application.

2. Provide required drainage and utility easements for Parcels A and B.
3. Dedicate 17' of right -of -way along the westerly lot line of Parcel A. 1
