The attached Change Order No. 2 is proposed to be administrated through the Upper Bluff
I Creek Trunk Utility Project No. 91 -17 for the purpose of constructing a portion of the trunk
sanitary sewer through the wetland area adjacent to the Lake Ann interceptor for the
Johnson /Dolejsi /Turner Project No. 92 -5. The overall project plans and specifications for
111 the Johnson /Dolejsi /Turner Project No. 92 -5 are currently being prepared in conjunction
with the contract agreement executed between the City, Lundgren Brothers Construction
and Rottlund Homes, Inc.
I The local trunk sanitary sewer for this improvement project is proposed to connect into the
Lake Ann interceptor which crosses through a portion of Prince's property. The area
I immediately adjacent to the Lake Ann interceptor is a designated wetland. The pipe
installation in this area would be better facilitated from both an economic and
environmental standpoint under frozen conditions than during a typical summer construction
I season. In fact, the MPCA, who is one of the permitting agencies for this project, has
recommended that this work be scheduled during the frozen soil months to minimize
disturbance and damage to the wetland and normally soft subsoils. It is estimated that
I constructing this segment of pipe during the winter months could save approximately
$15,000- $20,000 versus summer construction.
1 The overall project plans for the Johnson /Dolejsi /Turner Project No. 92 -5 are expected to
be completed this spring with construction potentially taking place this summer.
I Implementing this work as a change order to the currently existing Upper Bluff Creek
Project No. 91 -17 would allow this work to be completed by the contractor during the month
of March when soil conditions would likely still be frozen. The cost associated with this
1 change order, estimated to be $67,690, is proposed to be ultimately charged against the

1 Johnson /Dolejsi /Turner Project No. 92 -5. The contractor's quote for the change order is
based on construction during frozen conditions. If this work cannot begin before the spring
thaw, this change order will be canceled and the wetland crossing will be bid as a part of
the overall Johnson /Dolejsi /Turner Project No. 92 -5.
I It is therefore recommended that Change Order No. 2 for the Upper Bluff Creek Trunk
Utility Improvement Project No. 91 -17, for the purposes of completing the wetland sanitary
sewer crossing for the Johnson /Dolejsi /Turner Project No. 92 -5, be approved conditioned
I upon the work being initiated prior to spring thaw and that all associated costs will be the
responsibility of Project No. 92 -5.

I Attached is a construction change order to complete a portion of the Johnson- Dolesji-
Turner project (City project 92.5). The construction covered by the change order consists
of the sanitary sewer crossing of the wetland area adjacent to the Lake Ann interceptor
1 sewer on Prince's property.
The change order is proposed at this time because we would like to complete the wetland
1 crossing under frozen conditions. Crossing the wetland under frozen conditions is desirable
from both an economic and an environmental standpoint. The estimated change order
amount is $67,690.00. The cost to complete the work under summer conditions would be
1 approximately $15,000 to $20,000 higher.
Since project 92-5 has not yet been bid, we are proposing to change order the wetland
I crossing to Project 91-17A (Upper Bluff Creek Utilities, Phase 1) with the understanding
that the change order costs will be the responsibility of Project 92 -5. The remainder of the
I Project 92 -5 construction will be bid this April and constructed from May to August.

to complete the difficult wetland crossing construction. Please note that the Contractor has
quoted the change order based on frozen conditions. If we have an early spring and the
work can not begin until after the ground has thawed, we will not execute the change order
I and will bid the wetland crossing along with the rest of Project 92 -5.

This letter is submitted by the Minnesota Pollution Control Agency (MPCA) under
authority of Section 401 of the Clean Water Act (33 USC 1251 et seq.) and Minn.
I Stat. chs. 115 and 116. The applicant proposes a project to be eligible for a
nationwide permit as referenced above. The project involves a proposal to
install a 12 -inch diameter gravity sanitary sewer through a wetland located in
I the SW 1/4 NE 1/4 Section 10, T 116 N, R 23 W, Carver County, Minnesota.
The MPCA will waive certification of the referenced project with the following
II conditions since the project's individual and cumulative impacts do not appear
to be significant as defined by present water quality standards.
1. The impacts to wetlands should be avoided to the maximum extent possible.
I Those impacts that are unavoidable should be minimized to the to the
extent possible. All impacts should be mitigated.
I 2. Work should be scheduled during the frozen months if possible when damage
to the normally soft soils will be minimized.
3. Any clearing of vegetation should be kept to a minimum and all cleared
II
areas should be immediately revegetated with an appropriate monitoring
plan to assure a successful growth.
II 4. Side casting of excavated material in wetland area should be done on mats.
5. Insure that trenching is closed immediately and compacted properly after
I pipe installation to avoid drainage of the wetland from occurring.through
the trench system.
6. Erosion and sedimentation prevention practices shall be incorporated into
II the task.
